  1. Hi, I have received a default notice from welcome in relation to a car I purchased via HP in 2006. I owe £1205.62 and due to being out of work have missed payments. I have kept Welcome informed and I'm due to start paying again next week. The default notice says the following: total amount payable under this agreement £9503.40 total amount paid to date £6979.16 so how can my outstanding balance only be £1205.62? This balance also appears on statements I have been sent so which amount is wrong? I understand that if you have paid over a third of your agreement back they have to take you to court to get back the goods ? Can someone confirm for me that with the figures they have given I have paid over a third? Could someone also advise that I'd this goes to court do judges usually favour the claimant in these cases or the defendant. I intend paying £160.00 per month so the car will be mine in 7 or so months. HP was refinanced on one of they're "special" arrangements back in 2008 reducing the monthly payment from near £300 to £160 that's why it's taken so long to pay off.   2. Hi Squaddie, thanks for that I will do what you have suggested. I'm being dumb but how would i work out one months interest on the Uncle Buck loan? The agreement states the APR is 2339.30 and the total charge for credit is 30% (360% pa) I have a figure for the Wonga but not the Uncle Buck. Many thanks
  3. Hi I have Motor Mile finance chasing me for a couple of pay day loans. I received all the emails and texts threatening home visits etc. I have had to send letters my recorded mail for them to acknowledge me. I've finally had a reply and they have provide details of the loans taken out (1) October 2008 with Wonga for £180 but with interest now £588.08 (2) July 2010 with Uncle Buck for £200.00 but with interest it is now £2,035!! My question is for anyone who can help - what can I do about the interest that has accured on these loans especially the Uncle Buck one. I will offer them what I can afford inline with other debts I have but can I do anything about the interest??? Thanks
  4. Hi, Ive just checked my rates and on 01/06/2012 it was 5.90% then 01/09/2012 - 5.75%, I hope this helps I would be interested to see what rates you have. Good luck

Hi All I have 2 accounts with Welcome Finance, HP and personal loan, I know I have been charged fees by them for missing payments or whatever but could someone please point me in the right direction about getting these fees refunded. Also I double checked my balance with them then other day and it does not match what my credit file says (credit file amount owed shows oustanding balance as slightly lower) where do i stand with this? I quoted to them the balance shown and they said it has never been that amount according to their records. Thanks
  7. Hi, I have had a few dealings with this company and Bryan Carter and FPC are the same people. From past experience DO NOT try to negotiate with them over the phone. Do everything in writing, if they have your telephone number they will ring constantly on any number they have for you ignore the calls. I had a Vodafone debt transfered to them for approx £400.00, I offered them £2.00 per month over the phone and explained that was all I could afford but the offer fell on deaf years they were not interested. I wrote them a letter offering £2.00 per month and it was accepted!! They don't even ask for proof of income/circumstances, keep copies of what you have written, send by recorded post if possible. If your offer is accepted (which I sure it will be) just keep making the payments, because as soon as you miss one they will be on your back again, but apart from that once you reach/keep an agreement they leave you alone (not like some debt companies that constantly harress for more money e.g APEX, ) Good Luck

Hi, back at court today for the hearing, once again the claimants representaive was very nice and once again advised that Kensington wanted outright possession but like he said it was'nt down to what Kensington wanted...... Judge was also very nice listened to what I had to say, what I had to offer (once again the claimant had failed to provide up to date financial details and he was a little bit miffed (seems to be common practice for Kensingtons solicitors Drysden Fairfax) this judge however didnt get his calculator out like the last one and just took what I offered (dont know whether this was good or not) anyhow he suspended the possession, and advised that if we were to get into difficulty again what the process could be (eg going back to court etc etc). The person who was due to go in before me did'nt turn up and even though going to court is very scary and it does make you feel very sick and nervous before hand I'd urge anyone who finds themselves in this position to turn up at court, I've found that the judges arent as scary once you get in there and are generally on your side, better than loosing your home.

Hi There's 108 months left offered £60, this judge however said that the interest needed to be added onto it which is currently approx 5.74% per annum taking it up to £88 per month (he worked it out) Their representative said that some judges include the interest other don't this one just happened to include it.
  10. Hi No not yet the solicitors have to send another notice of possession letter to the correct local housing authority housing dept and I guess they will do that once they apply for a new date. They were pretty quick last time. Thanks
  11. Further to the above I think they have included the charges of £550 in with the total outstanding balance do maybe they can charge interest on top?

Just a quick couple of questions if anyone can help? 1) Kensington and the solicitors are stating that the arrears are £6551.02 but I have calculated that £550.00 are returned direct debits fees and monthly arrears fees are they allowed to include that in the arrears amount or should it be £6001.02 which is arrears less charges? 2) I have stumbled upon a letter dated August 2011 that's states that due to an error on their part I am due a refund of £5.75 plus 76p interest and this payment will show on the account on the next statement well I've checked and double checked and it doesn't look like its be refunded. I'd appreciated if someone could advise on where I stand with regard to the above, many thanks
  13. Forgot to say that judge mentioned that there could be grounds for breach of data protection and that solicitors make good money out of these cases and they should be getting their facts and information right first time

Hi, I thought I would provide an insight into my court hearing today with Kensington mortgages, they are seeking possession for £6500 of arrears which have built up due to husband being off work due to sickness. He is back at work now and payments have just recommended however Kensington keep refusing proposals even thou you provide them with all the evidence they request eg payslips.doctors letters and notes and bank statements. The mortgage is just in his name and he is currently abroad working (to pay the mortgage) and I have been worried sick about attending court on his behalf. Anyway went to court today, met with their representative who was very nice but advised they were still seeking outright posession , I had asked to be made aparty to proceedings on the defence form and Kensington had written authority from my husband to discuss my account so the representative and judge were ok for me to be there on his behalf. The judge was very nice asked me what I was proposing turned out that what I proposed or the arrears was not enough within the Norgan rules (he wanted the daily intererest to be added as well) so I was about £28 short. However when the judge was looking though the witness statement I bought to his attention that the solicitors had sent notification to the wrong local housing authority? The judge was not very happy at all and unfortunately he had to adjourn proceedings he told the solicitor off and also advised that the mortgage company could not charge solicitors fees for today's court appearance. I now know what amount I have to offer next time in court and in the meantime I will be going back to Kensington with a new proposal. I will keep the forum updated on my progress.

Hi, thanks for your post, no they wont negotiate, the lady I deal with at money advice plus says that the lady I have dealing with my home at the council is one of the worst she has come across. Is there anyone of the forum who can help me prepare a statement or anything to take/send to the court?
  16. Hi, Ive just been told by my council landlord that they are taking me to court for non payment of rent. My arrears currently stand at £1200.00 I have been paying my rent over the last year or so but its because the arrears go back to 2008 and havent been cleared that they are going on about. I have made a few arrangements in the past but these have been broken due to loosing job, being off sick, employer not paying wages etc etc and have always kept in contact with the council to explain. I was unable to pay my rent last month as I had hardly any salary and how to get food, gas, electric etc. Anyway I wrote to them and explained my situation and offered to repay my normal rent plus £50.00 towards the arrears but this time no go. I'm on my own with my 12 year old son and do have a regular income and have just taken on an extra part time job so going forward things are looking ok, could someone please advise me what to do the council have sent me a financial assessment form and a NR11 form, apart from filling these in I dont know what to do with them I have been a council tenant for 20 years and have not been to court before for my rent. Help Please. Thank you
