  1. I am assuming they are outstanding! which is a little confusing as I have heard nothing from these companies or anyone working on behalf of them for the last 4 years.... . I had an account with First Step Finance back in 2008 and I have written to them requesting a summary on my account before I closed it. While I was with them I recieved no such summarys although I did receive a couple letters stating accounts had been closed.
  2. I'll send the SAR out and go from there...... Many Thanks for your help! It is on my credit file, along with a few others which when I check a couple months back were not on there! And these were as far as I was aware from FSF they were written off! So should they still be on my file?

Well the debt stands now at £460.68 but looking through old statements the balance at which I stopped using the card was £195, I fell into some financial difficulty and payments slipped and the debt rose to around £700 all of which were charges. I was on a payment plan which got it down to what it is now but it is abit hazy as to when I last paid towards this debt as I moved house a few times and had had a company trying to get my debts written off which was stupid as I now know I could have done all that myself!! It is on my file as a default which is due to come off next year. But I do find this unfair as all the £700 bar £195 of it were charges and interest accumulated. I was also charged according to my statement an overlimit charge when at that stage I was not over limit which in fact did than take me over the limit if that makes sense?
  6. Ok my post yesterday was a little long and a complete rant!! In short, I have been getting phone calls from Freds about an account which is in dispute with MH, no letters were sent prior to this from Freds to say they had been passed the account and nothing has been heard from MH since Sept last year when I sent them a letter in response to the CCA they sent (2 months after the cut off date) I have stated I will not discuss the account over the phone and any communication should be in writing, after I stated this they sent me a letter asking me to phone them to discuss the account I need some advice really, do I sent them an account in dispute letter? Because I had sent MH a letter offering a final reduced payment but received nothing back from them. Send an SAR and claim all the charges and PPI back? Becasue I know there were an awful lot of charges as I came across old statements last night and every month they were charges for being overlimit, and I noticed some were even added when I weren't over limit which is strange? Any advice would be much apprecited thank you

I am very very angry with Santander right now, I wrote them the other day with regards to the default notice they have put on my credit file with regards to my overdraft back in October last year. I arranged to pay them £30 a month to get my overdraft out of the red and back in the black, but due to the excessive charges they were putting on my account it was like swimming agains the tide! But I carried on paying becasue I didn't want any adverse credit on my account seen as I had just started to improve my credit rating. So after a couple months paying this money into my overdraft account I got a letter stating that the were going to issue me a default notice on the account if I did not get it up to date within 28 days, I put the letter in my bag ready to call them to ask them why I had received this as I was paying £30 a month as agreed into my overdraft. The next day I recieved the default notice, not 28 days later! When I saw the date on the letter it was dated the day before the first letter so the default was issued before I had even had any knowledge of it. Surely this cannot be legal? I then recieved a very irrate phone call from Apex management telling me that Santander had sold the account to them, I then again quiried why they were selling it on when it was being paid, I was told sometimes they sell them on the clear out old accounts. I wrote to Santander asking them to remove the notice as I had been keeping up with the repayments and they told me it was all perfectly legal, even tho I sent a copy of the letters and highlighted the dates, but how when I was not given 28 days to sort the mistake out? So I wrote to them again the other day and they came back again saying they were within their rights to issue the notice, even though I was making agreed payments. I need to some help as to what to do next becasue this will be on my account for the next 5 years just as I was getting back on my feet. Thanks
  8. I was just wondering if I could claim back the money First Step Finance took off me for a couple years without doing what I thought I was paying into my "pot" for them to do?? They didn't resolve may problems and when I done it myself it took me just over a month not 2 years. Has anyone had a similar situation with them and is there anything I can do? I was paying them £290 a month for just under 2 years and nothing back from them, the occasional letter and that was it and earlier this year I had my creditors looking for me again which was when I decided to send my own CCA's which has now rendered my debts unenforceble. Your help is much appreciated

  10. Fredrickson have written sayin no agreement has been produced so has refused to deal with the account any longer and sent it back to the originator. Cabot have sent letters saying they have not be able to retrieve the information but are still looking Mackenzie Hall have not contacted me since their original letter acknowledging my request and that they have given the creditor 40 days???? to retrieve the information. That 40 days is now up and I still have not heard from them.

  12. How can they just contruct an agreement, surely it has to be signed?
  13. But there is no evidence of a contract as the agreement has been lost or distroyed.

  15. No the last payment made to them was about 3 years ago, before I asked for the agreement.
  16. Hi guys well good news I have heard nothing from any of my creditors with regards to my request for the agreement so I am assuming they don't have it!! Now is there anyway of claiming the money back I have paid them or do I just call it quits now and move on? Thanks again for all your help

  18. Ok so I have an update, Cabot are refusing to close the account and said they are keeping it on hold after 2 years and that they will contact me "when" they receive the agreement. But they have had 2 years..... Also Mackenzie Hall sent me a letter back stating they have given the creditor 40 days to find my agreement but thats not right? The other 2 I am wiating for a response which the 12 days are up on the 15th. So what should I do about Cabot's response and MH?? Also I know about the clause with the asking for the agreement as by law they are supposed to have it already when they buy the debt, is there a letter I can send with regards to this?? Thanks :o)
