  1. Dg have written to me saying they will settle by cheque within 7 days
  2. Following my claim via mcol, the bank acknowledged service the following day and stated that they would file a defence. The following day I received a letter from DG offering the full amount....but would credit my account because I owe them money...which I am paying back on a monthly basis. I returned the settlement letter and closed out this paragraph, I added I requested the monies to be settled in cheque form payable to me.....I also added a letter stating if my closed accounts were credited I would not accept the settlement. I have today received a letter from Julie Kyle....Thank you for returning the signed settlement letter (x2) We confirm the agreed sum will be credited by way of cheque in the next 7 days. If the credit does not appear please telephone the writer and we will chase the bank

I have been offered a full refund but they want some off it to pay back what I owe..the account is closed, the sum is been reduced monthly via payplan ..I have refused their settlement to do this unless it is refunded in full by cheque outlining the fact that I already have an agreement with them to reduce this debt (which they actually caused) I am waiting for a reply from DG solicitors

  5. Previous to my previous threads.....I filed my claim on 12th October against two accounts at First Direct both were acknowledged yesterday. I have received two letters from DG solicitors(hsbc soliciors) today (without prejudice etc) they have offered the full amounts on both accounts £3677 and £3704 but say that they will pay off my outstanding debt first. This debt is part of a debt management programme for which they agreed and are accepting monthly payments..and is up to date/no payments missed ....do I have to do what they say or can I demand a cheque for my new account....I have recently been left by my ex so need the money for essentials for me and my kids and solicitors fees for the divorce

  7. First Direct are quick normally by courier you will have to sign, I waited less than a week TB
  8. They will reply within the 14days normally 9-10 days, FD are good at meeting dead lines.....this is just a standard holding letter b4 you get the Robert Kernaghan reply!
  9. I entered my two money claims against FD on the 12t October account 1 inclusive of court fees and 8% interest £3677.68 and account 2 inclusive of CF and 8 % £3704.34 . In addition I have sent the bank revised schedules incuding the 8%. Both claims have been acknowledged today 18th so we will now see what happens:rolleyes: :rolleyes:

  12. hi thanks for quick reply, no I havent asked for 8% I have prepared those schedules for court only...the schedules FD have are reclaiming..od fee (charged at £30 a time..for going over limit) ex ex od limit normally about £100, unpaid item and so recall....(37.50 a time) TB

On 2nd October I received the standard letter from Robbie Kernaghan offering £3588 without prejudice blar blar....I wrote back immediately accepting it as part payment only and requested the full amount £5931 and reminded them that they have until 11 Oct to settle. I have received a further letter today dated 9th October they are sorry that I am unhappy however, as this was the banks final response, there is nothing of further value they can add. Whilst the offer to refund 2588 still stands, they wil lnot refund any additional interest etc etc. I think they have mistyped the £2588 as £3588 is on my last letter and settlement proposal to sign and return. Can I now file my court papers I have prepared on moneyclaim...they have until the 11th to refund however they have said it is their final offer????
  14. yes now send a Lba, fd will reply quite quickly and may offer a part settlement which you should refuse

I have claimed all fees which to date have not been disputed...od fee, ex od fee, recall so, unpaid item( I have been offered an about 66% of my claim which i have refused ) The od fee of £30 is applied when you exceed your limit, I agree with joebloggs above,this sum does not reflect the true cost of any loss sustained and in addition to this fee they charge ex od fee
  16. CAN Someone help me...please ...I have prepared two claims (two closed current accounts at FD) on moneyclaim to submit this Thursday, I have already refused a partial settlement. The first claim is £2853 plus 8% interest 704.68 plus court costs ...The second £3088 plus £496.34 interest plus court costs....I cannot work out if the schedule I have prepared on excel has to be attached somehow on line with the claim or is the up to date schedule including the 8% interest sent direct back to the bank? The bank already have a schedule of all charges I am claiming (minus the 8% interest) any help would be appreciated

I have today sent my reply to old Robbie Kernaghan rejecting his offer of £3588.00 in full and final settlement (total claim £5931) they have until the 11th Oct now to ignore me and I will then file my N1....and claim my 8% interest... My two accounts are closed and I have a debt payment plan with Payplan so I am sure they will try to reduce my debt with this money...however the loan I took out was a debt consolidation one because of my OD run up with charges sometimes over a period of two days before my pay going into the bank they charged me over £200 in fees...I aint backing down to them they have caused far too much grief over the years...and thanks to this site I am now brave enough to stand up to the bullies!!
  18. I Sent my LBA letter 6 days ago reclaiming £6947.21 back from two current accounts..the charges I have asked to be returned are OD FEE,EX OD FEE, UNPAID ITEM, SO RECALL. Both my accounts are now closed...First Direct have crippled me over a period of five years. Today I received a letter this letter has offered £3588.00 in full and final settlement of this matter. The letter is from Robert Kernaghan (bet he is fed up of these complaints!!)..... In circumstances where you have authorised a payment that would, if met by us, lead to your account going overdrawn or to exceed your od limit, we have to consider whether to make this payment. A fee is payable for this service as set out in the published tariff. The circumstances in which the fee will apply are clearly set out in the Account terms and conditions, ....blar blar...we are confident of our position and believe that if your claim for a refund proceeded to Court, we would successfully resist any legal challenge in relation to these fees.....FD mindful of the management of time and irrecoverable legal costs we may incurr....(well that bits true at least...theyve got all my money!).... so they have offered the above sum and credit it to my non exsisting account (kind of them) Mr K wont refund recall/unpaid fees or additional interest!! What a headache aye!
