  1. Just to add to cabots photoshop skills, I received a REPRESENTATION of my NoA! They used Barclaycards new logo 2008 when my NoA was dated 2005! Was Created the same date they sent it and took them 1 hour 14 minutes and 30 seconds! lol
  2. I have 2 blackhorse loans that I'm claiming on and was told by blackhorse to put the same number in as they didn't issue seperate insurance policy numbers.
  3. hi Fred it's listed as one of the complaints that is looked in to and has the knock on effect when consolidated in to a new loan
  4. Hi deedee, it is certainly something to think about. I think I would be justified in claiming damages from how they have treated my Sar to incorrectly recording on my credit file, four defaults and the wrong date for the ccj satisfaction. Would be a fair bit on my claim, 19.9 - 23.9 % compared to 8%
  5. Okay my reasons for LOAN 1 (1998) being mis-sold are; *Was arranged over the phone with a prefilled agreement I only had to sign in one place with the PPI aspect already entered and no opt out on the form PPI was front loaded single payment added to the loan and this wasn’t explained to me PPI and loan monthly repayments and interest shown but no Total Amount to Pay PPI was I believe an advised sale to me with no needs analysis or proper explanation of the PPI I had twelve weeks full sick pay with my job and a good redundancy package Loan was repaid early with no noticeable rebate Was not informed I would not receive a Pro Rata rebate Wasn't clearly explained to me that I could cancel the policy and that it was optional Was not explained PPI involved the purchase of an Insurance Policy *My reasons for LOAN 2 (2003) being mis-sold are; *Was arranged at the local office with a prefilled agreement I only had to sign in one place with the PPI aspect already entered and no opt out on the form I was told it was a condition of the loan The price of the policy was worked out on a consolidated loan that didn’t have a correct rebate and had mis-sold PPI on it PPI was front loaded single payment added to the loan and this wasn’t explained to me PPI was I believe an advised sale to me with no needs analysis or proper explanation of the PPI I had twelve weeks full sick pay with my job and a good redundancy package Was not informed I would not receive a Pro Rata rebate Wasn't clearly explained to me that I could cancel the policy and that it was optional After being defaulted on the loan I didn’t receive a rebate from the policy (I had paid 20 out of 45 payments) Was not explained PPI involved the purchase of an Insurance Policy * I'm going to work out my figures from each monthly payment with the day it was paid to the end of this month with 8% annual interest. With the remainder left owing I shall add 8% annually from the date the account closed until the end of the month. * I'm aware that the amount may go up or down! lol *I shall also state as per FSA guidelines that I shall be put back into the position I was in if I hadn’t taken out PPI i.e. . . . credit report, CCJ
  6. Thanks deedee, it does help to sound out your thoughts! Right from what I can see looking at the loan statements, LOAN 1 was consolidated into LOAN 2. It looks like they actually added to the outstanding amount the interest they were going to lose!!! LOAN 2 had a missed DD in March 2005 then DD's were cancelled and LOAN 2 was defaulted in May 2005 BUT from March to October interest was still added, until taking me to court and getting a Judgement in December 2005. Then there is a charging order costs in March 2006 that is then refunded in May 2006? With the PPI claim can I get them to remove the ccj And default?
  7. I've been going through the paperwork I have received and it looks like I have 4 defaults on one loan! 3 in may and 1 in October, guess which one is on my credit file?
  8. Update again! lol Got home tonight and my agreements have arrived already. Time to start working out the sums
  9. The saga continues…. Last week after I faxed BH a letter explaining the completion address they had on record and an approximation of my signature as it may have been in 2003 I then posted a copy along with my PO. Well on Monday I received yet another letter from BH saying Thank you for you recent letter. We require £10 payment to progress your request! Well it was time to get on the phone AGAIN! Spoke to customer complaints (RECORDED) who checked my file and asked me about what letter I was referring to as my file had not been updated since 2007! Then had to explain that this is now day 63 of my SAR request and that they had better find my letters. He then went to physically check with customer complaints after realising that whoever was dealing with my request was not putting their name on the letters. Also asked me for the counter foil number of my PO so they could check if it had been cashed.Eventually he asked me to FAX the letters I had received to them so that they could work out from the signatures who was sending me the letters. Well the FAX number I was given doesn’t accept incoming calls! So back on the phone!!! This time the person I spoke to (RECORDED), after explaining everything again, asked if the SAR was for a PPI claim. Didn’t want to say it was until I had my SAR details, so told him it was for my own record keeping. I was then told that he could send me my Agreement, T & C's, completion letter and details of my account FREE OF CHARGE!!!! And that I didn’t have to do a SAR to get this information. Is this normal????? I asked him to send that out to me and that I still wanted to progress with my SAR as I not happy with how it has been handled so far. I was then given a different FAX (that seems to have worked) and then he read out the loan details to me so that I could decide if I wanted to make a claim. He then went on to explain how to start my claim if I decided to make one. Talk about a refreshing change. So awaiting my loan details, it takes 5 days apparently, and them sorting my SAR out!
  10. Morning Everyone.I'm about to start my brothers PPI and charges claims against Welcome Finance. We are now in receipt of his SAR so will be able to refer to the agreements and statements of his accounts. In total he had 4 loans with them over a period of about 8 years; he only finished his last one in March this year. All of the loans have PPI, Medicare, Lifecare and acceptance fees.Am I right in thinking that he should reclaim PPI by itself and all other fees and charges should be a separate claim?I have spent a lot of time reading the forums with regards to reclaiming PPI so feel confident in sorting that claim out. It's the charges I'm not to sure about! Do I charge contractual interest for charges? Thanks in advance
  11. In my experience a favourite tactic of Lloyds and their subsidiaries is to return your payment if they experience a problem in fulfilling a SAR. (Twice now for me)I have started including the line "SHOULD YOU EXPERIENCE A PROBLEM FUFILLING MY REQUEST I EXPECT YOU TO CONTACT ME WITHOUT THE RETURN OF MY PAYMENT". Don't know if it will make any difference but you know how pedantic they can be!
  12. Thanks Rebel,SAR's are being sent at the weekend, just wasn't 100% sure of change of employment circumstances, if this is something they can claim my sister should of told them about.
  13. Morning All,About to start looking into my sisters PPI and credit card charges claims. At the time she took them out (thinks they were postal/ flier applications) she was employed as a hairdresser. Not to sure at this time if it was mis-sold BUT a few years later she went self employed but was still paying PPI.So should she be looking to claim at least the PPI since she went self employed?thanks in advance.
  14. Morning All.Phoned BH (RECORDED) because BH had my sibling's address as the completion address and my signature has changed this is the reason they have not completed the SAR. I'm going to fax them a letter detailing the above with an approximation of my old signature as well as detailing as much info about the original loan as I can remember.
  15. Update time Raging with the bh idiots! Postal order returned again! Despite me sending it to bh's solicitors and including my old address, current address, agreement number, email address and phone number I get a letter today saying your signature and address don't match so we have returned your postal order until you provide with the information! And it was bh themselves that returned it NOT their solicitors who I made the sar request to!
  16. Thanks sillygirl, I will do. I am slowly learning bazooka! My only worry is as I had two accounts will it be the termination of the last account that will be the cause of action?
  17. Hey bazooka, I've only had the initial call with them and I recorded it!
  18. Also this.http://www.bbc.co.uk/blogs/thereporters/robertpeston/2011/05/lloyds_to_settle_ppi_claims.html
  19. Cool. :-DWill hopefully be putting mine in soon!
  20. Morning,First off thanks for the replies. When I spoke to Mucky Hall yesterday when I asked for more details (amount and by whom) about the supposed last payment their excuse was that they only limited information and couldn’t see those details.I know for a fact that I haven't made this payment as I had no bank account and that checking my credit file this morning YB have a linked address record with my address wrong. lol Let's see what they come back with when I ask for proof of the payment. :-DI should add that Mucky Hall are only working on behalf of the Lewis Group and don't own the debt.At the time when the repossesion happened I had a lot going on and didn't really know my rights. Since discovering this site I have started SARing various companies with intentions of reclaiming PPI and charges. But if there is a case for YB to answer to then I will chasing that up as well.
  21. I ment to say in my original post I have never gave any financial institutions my wifes mobile number, in fact it is still in her maiden name! Also with regards to YB messing up my DD's the first I knew of it was when my house was repossessed!
  22. To be honest I always thought I would probably be the one to blame for not checking my mail. I've currently started SARing my old loan company, next was going to my old mortgage then the bank.
  23. Afternoon everyone. Today my wife received a call on her mobile from Mucky Hall wanting to speak to me! Due to the DPA they could not tell her anything but gave her a Ref and Contact number. I phoned Mucky Hall (recorded the call) to see what it was about. It transpires that they are working on behalf of the Lewis Group with the original debt belonging to Yorkshire Bank. The amount they claim is owed is just over £700. I DID NOT ADMIT OR ACHKNOWLEDGE THE DEBT BELONGING TO ME! A bit of background to the alleged debt. I banked with YB for 14 years but haven’t been a customer now for almost six years. I had two accounts with YB, my main account that my wages were paid into and a second account that I paid my bills from by DD. I then had a weekly Standing Order that paid a fixed amount from my main account to my second account. This was something my local branch advised me to do. For the most part it worked, occasionally I would not have enough in my second account to cover the bills and YB would then take the required amount of my main account THEN inform me. In January 2005 for some reason they stopped paying my bills. By April 2005 it looks like they had stopped paying all my bills including my mortgage. At the time I was doing a lot of overtime and staying at my fiancés house so I wasn’t checking my mail. In May 2005 I even had a substantial redundancy payment in my main account. I took three months off work and got married. In October 2005 I have a new job and went to get my wages out and my card didn’t work. I phoned the bank and was told my account had been closed. Two weeks later my house was repossessed and found out my loan had been defaulted as well as other outstanding debts. Fast forward to today and this is the first I have heard anything about this debt. I believe this debt is solely made up of charges and interest. I informed mucky hall to remove the telephone number as it does not belong to me and everything in writing to me.Mucky Hall claim that they started working on the account in March 2011 and that they last payment was in January 2007! It wasn’t made by me!!! What's my best next step? Thanks in advance.
  24. Problem with my last post. Wont let me save my formatting changes.
