Claimant has account ******** with defendant from ***** 2000 conducted on their standard terms and conditions. Claimant is claiming the return of £274 taken by Defendant in charges over 6 years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from 30th june 2001 to 18th sept 06 of £59.21 and also interest at same rate up to the date of judgment or earlier payment at a daily rate of £0.06 . -

Hi there Well I sent off my lba a few days ago (monday) and received a phone call today from a very polite lady who already new I wasn't going to accept their very reasonable offer of £190:o :o :o , I'm only reclaiming £274. I gladly refused so in 1 and a half weeks I shall be putting in my money claim form. Carlie -

Life reared its ugly head and I am now only able to post off my prelim, its sealed and ready to go, so 14 days away and I'll be sending my lba. You would of thought they got the message by now and we would be getting our money a bit quicker, oh well their loss. carlie -

HEELLLOOOOO Well I finally received my statements today, Have been through them all twice and have charges totaling £274, so Will be sending my prelim today, I am so looking forward to a nice wad of cash in my bank account, lets just hope they take it to court so I can add interest. Hello Phoned walifax today aqnd there was no record of the dpa request, so the very nice lady on the end of phone debited the fiver and my statements should be arriving in the next 7-10 days. I am starting to think it easier to phone them in the first place like my friend did he got his statements last week:confused: . Never mind hopefully Things will start to move forward now. carlie -

I have now opened a parachute account YAY. Will just leave it dormant for the time being as I havent had any charges in well over a year, so doubt they have reason to close my account when I get mt money back. Am also helping my brother and sis in law to get theirs back, my brother has about a grands worth and he is chuffed as it will get him out of debt. Still waiting to get my statements through, hope I don't have to wait too long;) carlie -

I would definately try and get another account if possible, I know the post office do a very basic one, I doubt they will turn you down, as they are for the benifit for people on benifits, although anyone can open one. HTH carlie -

Personally I would phone the post office and see where it has got to, and then if they don't know ring the bank and ask when will they be sending out your statements. If they have no idea what you are on about, they probably havent got it and you will need to send another one. Also chase up the p/o as they have lost it. Carlie -
Well after looking through the site for a good week and finally sorting out my activation( long story dont ask) I have finally handed over my Data Protection Act and advised a fair few mates to do the same. I guess I am owed roughly 200 squid from when I was in debt a few years ago, hoping it will be more:D . It will be lovely to be able to go shopping with out having to worry about where the money is coming from. I know we shouldn't have had the ludicrus bank charges in the begining, but it will lovely to have a lump sum, instead of drips and drabs. Good luck to everyone. Carlie
