  1. Thanks for the rude messages. i thought this was supposed to be a sensible forum to help the ripped off. CAB are the people who are dealing with this matter. They have stated that sub prime mortgagors have been robbed. They requested that I ask for all documentation. Lib Dem MP Vince Cable is on the case The FSA have just received a bundle of papers from myself, including the Terms and Conditions booklet Barclays are also investigating Instead of posting rude comments, try phoning Barclays Customer Services. Ask them if they bought SPML. Also check the Finacial Times. google in SPML/Eurosail and go to Companies House, Irish Stock Exchange. There you will find,in black and white, that both companies are insolvent, December 2009 and that both Barclays and Morgan Stanlety are involved re securities and notes. Stop playing around. You will soon see who is right
  2. I.t is true, Barclays are investigating my complaint and Vince Cable,Lib Dem, has also paid attention, judging by the Daily Mail on Saturday. Everyone, write to Barclays and reveal what has been going on. send copies to Brown, Vince Cable and whoever the Conservative Shadow Chancellor is. Now is the time, as an election is in the offing. This gives the advantage to those who have been ripped off
  3. I have just had a letter back from Barclays Head Office. They have appointed someone to look at my compaliant, re Capstone/SPML. It could be that Barclays do not know what is happening, as most SPML customesrs do not realise that Barclays bought Capstone and SPML from Lehman Bros. The problem lies with the judges, in re possession cases. I think the system should bre changed, with such cases going in front of people with specialist financial knowledge. I suggest that people write out a report regarding SPML, detail history, as briefly as possible and send it to Barclays Head Office in London., Customer Relations. London. E14 5HP. I will be sending the FSA a copy of SPML's Lending and Mortgage Conditions, to show how customers have been duped through the burying important information, in the middle of incomprehensible taxt. That is how SPML was able to sell on mortgages etc without informing mortgage holders. Page 4 para 7:Transfer of Company's rights On another thread, someone said it was not important. Yes it damn well is, it involves people's homes and thousands of pounds worth of equity.
  4. Hi Joby 73 I see that you mention this has been going on for 4 years. When was the suspended re possession prder granted? If it was granted befor 20th September 2008, then it is null and void, as SPML were owned by Lehman Bros. Any arrears dating to that period are owed to Lehman Bros administrators, not SPML/Barclays. Barclays bought SPML and thus its mortgages, in other words it bought the debt, minus the arrears. Capstone were also a Lehman Bros holding, bought by Barclays. I wrote to the Chief Executive of Barclays Bank last week, demanding an explanation. In the US, many mortgages were just wiped out when the collapse came. Why not in the UK? Capstone are not a mortgage company, they are service providers, collecting money for Barclays Bank. That is why Barclays is making profits and able to pay out huge bonuses. Robbing the poor to feed the rich. Capstone are behaving in the same way as other debt collecting companies who have purchased toxix debts, they use fear tactics to force people to pay monies. They have no legal standing an are breaking the Consumer Credit Act 1974 (on top of everything else). Why are the FSA not acting on behalf of SPML victims? The whole shebang should be hauled into court, not least because there are people who may have lost their homes because of illegal actions. Judges in this country treat criminals better than the victims of these rogue mortgage companies

  6. I have just completed a 4 page letter to the Chief Executive of Barclays bank, John Varley . Barclays bought SPML. That information was on the front page of the Financial Times earlier this week. I am demanding answers, such as wh holds themortgage deeds on the property and why were SPML collecting arrears payments,after Lehman Bros collapse. SPML was rebranded Eurosail 4 Firsts UK 2007, in 2007. SPML demanded that Eurosailetc were added to our Bulidings insurance Policy, as mortgagee. This was queried by Swinto because Eurosail was not a registered mortgage company. That is why letters continied to be headed SPML SPML provided the mortgages for Northern Rock Capstone is not a registered mortgage company. It is a service provider. Capstone also faced insolvency. They are service providers and advisors to Barclays Bank. The collection account that SPML mortgage monies goes into, via Barclays, is London Corporate Banking. I await confirmation that SPML/Eurosail is insolvent. If they are, then they can't initiate legal action. Next thing that I am going to do is request title deeds from the Land Registry
  7. You are correct. We have been advised not to sell by 2 estate agents who came round to value the property, one of who had inside knowledge of Lehman Bros London operations
  8. All you have to do is write to Vince Cable,in the sane way that you can write to any politician. Your MP can also speak for you. The relevant Cosumer credit Act is dated 1974. I know what I am talking about and have already presented it to SPML/Eurosail?Capstone and am working from advice received from Trading Standards
  9. No Barclays bought the Japanese assets of Lehmans, confirmed by Barclays. CAB do know what is going on and I have ben advised by 4 specialist mortgage advisors, one of whom worked for Lehman's branch in London. The general consensus is that those people who took out mortgages with SPML and the rest have been robbed. Likewise what is happening on the Costas. Read the e mail, this has gone to the Lib Dems, Vince Cable in other words to go before Parliament. I am not talking nonsense.
  10. According to Trading Standards, or whatever they are called now, under no circumstances do you open your door to debt collectors. SPML have committed a criminal offence under the relevant Act, I think it is the Consumer Credit Act 1970 (googl it and you will get the correct date). If debt companies threaten to send a doorstep collector, I inform them that if they do so, I will call the police. With regards re-possession hearings, you do not liase with the company;s solicitors, who lie anyway. You contact CAB before the hearing. You then have a right to appeal. SPML can not chase you for a purported £100k, that is illegal. 3.5 years ago , SPML was owned by Lehman Bros, and any sebts are owed to their administrators, not SPML/Barclays Go straight to CAB as they are on the case. CAB have asked me to request all documents from SPML, so that they can look at them. They know what is going on. Don't be frightened, there is help out there.
  11. With regards to re possessionaction, please make sure that you contact your local council re: mortgage rescue package. They or CAB can arrange legal representation if you are eligible. The plot thickens with regards SPML/Eurosail, both being declared insolvent. Capstone are service providers. not registered mortgage comapnies. In our case, arrears built up when Lehmans owned SPML, because neither SPML nor Capstone would explain who Euro sail were. I now know that SPML was re branded Eurosailm, but continued to use the SPML brand as Eurosail etc is not a registered mortgage company. Likewise the suspended re possession order was taken out when Lehmans owned SPML. When Braclays bought Lehman Bros assets, they bought the mortgage, not the arrears, those are owed to the Lehman Bros administrators. Therefore, SPML have been collecting arrears illegally from us since the collapse of Lehmans. Also they acted illegally by taking us to court for a review of the arrear,Sept 2009, which resulted in the payments towards the arrears being increased. I have compiled a report, not just relating to SPML, but the whole sub primemortgage and finance farce, and have sent the first copy to Vince Cable (my husband is a Lib dem councillor) Copies are also going to the FSA and FOS, and Barclays. The last misive that I got re repayment rates, came with a Capstone heading,not SPML, making me suspect that the company is defunct. So the next question is, where does it leave mortgage holders, especially those with assets in the property? And, what about Building's Insurance? these are twq questions I will be putting in a letter to the Chief Executive of Barclays Bank. In additio, I will want to know why payments are not being processed when I present them at Braclays Bank. we have a payment book and the name on the giros is not SPML, it is London Corporate Banking. Something vert fishy is going on. With regards charges, the complaint needs to be made to the FSA. The FOS just act as arbitors (and take ages)., negotiating between the lender and borrower. If SPML is indeed defunct, them there is no one to negotiate with!
  12. Are Rooftop Mortgage co still trading? I thought they went down with Bears Stearn ? If they are then I am gunning for them too as they took £10,00 more than the judge stated in his judgement. They used eviction as a threat. Thi was when we remortgaged with SPML, who appear to be insolvent. No wonder three mortgage advisors told me to investigate and CAB. What about First National? they were the ones that caught us in the first place.
  13. Legal Aid is available for qualifying people. CAB are the people to go and find out about this. I was about to see a solicitor but hubby managed to do some 9vertinm (to pay the mortgage) which took us over the limit! Hopefully next month will see me starting a case against SPML et al
