  1. I've not been a BT customer for some time now but find I'm still stuck with the BT line rental rip off no matter which company I chose to supply my phone or broad band service. When I challenge them about this they say nothing to do with us its BT! Well I'm sick and tired of being taken for a ride and think the government should abolish this cash cow which BT just keeps on milking. To this end I have raised and e- petition requesting that line rental be abolished. please go and read the petition and if you agree sign it. You never know if we get enough people complaining they might actually do something about it.   2. I was going through my bank statement on-line to day and spotted Direct Debit (DD) had been taken a few days ago for the amount of £20.00! Now this was my company account and I only have 3 DD on this and I know them well and none should have been for £20.00. The info shown was LV LIFE with a reference number next to it. I called the bank to find out what it was! I was told that it was a DD that had been set up with out the need for a signature and had been set up to take £20.00 every month for Life Insurance. I asked how this was possible as I had not instructed this DD. I was told that as the set up had been made by the Insurance company using a method that did not require a signature the bank could do nothing to stop it being set up! I told my bank that we had no dealings with LV LIFE ( Liverpool Victoria Insurance) and had never instructed them or provided them with our account details and instructed them to cancel the DD and reclaim the payment. I'm happy to report that the bank did this immediately. However what is concerning is that this was ever allowed in the first place! Also the bank stated that other than cancelling the DD they could not investigate any further. They said I would need to contact the company to find out why the DD had been set up. I explained that we had no dealings with LV LIFE and would not know who to contact but the bank was insistent that we would need to contact them! I was not happy with this and asked for the complaint to be raised with the banks fraud section which they said they would and I'm waiting to be contacted by them. Just thought that this might be useful as a warning to others to check there bank statements as apparently any company can set up a direct debit on your account without having to tell you and the banks just accept this and payout! If you don't spot it and cancel it you lose your money so be careful.
  3. Well I've not had any further contact from CRL or Tesco regarding my wife incident in February. It clear from this that they are only going after cases they are sure they can win or are sure are unable to defend themselves. I would defiantly recommend challenging them. You need to do it in writing and in a clear and firm way.
  4. Well it's been 40 days since the first letter from Civil recovery Ltd which stated that unless we pay within 21 days they would take further action. I can only assume that there simply incompetent and not capable of keeping up with there own threats! or simply are not wiling to risk taking the matter to court. just goes to show that you need to stand up to these bullies and fight back.
  5. Hi triton, sorry to hear about your problem! your not alone in this! hundreds of people are being caught out by this despicable behaviour by Tesco. I'm not a legal expert but their are people on this forum that can help. I'm not sure if ignoring them is the best answer! although many do recommend this. I decided to write to them (CRL) once stating this would be my only correspondence with them on this matter. At least this way I have been seen to try and resolve the matter if it ever does go to court. Certainly from my findings so far it would appear that they simply keep pestering people with letters that get more and more demanding hoping they will give in and just pay up. They simply behave like bully's! knowing that many people will simply pay up just to stop the threatening letters.
  6. The Centre for Retail Research helped to introduce civil recovery to UK retailers. It also set out some clear guidelines for the application of civil recovery by UK retailers. The guidelines defined civil recovery as, “Civil recovery is the name of a process allowing retailers and other businesses to obtain compensation using the civil law from wrongdoers who cause loss by theft, fraud, damage, trespass, or similar offences. Recovery can be used against staff thieves as well as customer thieves.” The guidelines states that “Civil recovery should never be used to avoid involving the Police.” Yet this is now common practice by most of the large retailers like Tesco. They have no interest in contacting the police all they want is your personal information to allow them to issues civil recovery demands. The guidelines state that “It is important that these civil recovery processes are only used against actual thieves, not innocent parties.” Shops like Tesco are now routinely applying civil recovery to ordinary customers who simply forget to pay for an item.They simply don't care if you are a long standing customer who may just have made an honest mistake! They see you as just another opportunity to make more money. The guidelines state that “It is also important that civil recovery is used equitably” How can companies like Tesco and Civil Recovery Ltd claim they are acting impartially when the security guards who make the allegations work for Total Security’s Limited which is run and owned by the same person that owns and runs Civil Recovery Ltd.? Even the Centre for Retail Research now believes the guidelines need to be reviewed and updated. “A Code of Practice was developed for ACPO and the National Programme. It probably needs a revamp by now to cover: What categories of offenders should ALWAYS be reported to the police including juveniles. What is best practice to be followed by retailers in administering civil recovery (eg the use of warning notices near shop entrances, the phrasing of the civil demand letter, how to handle disputes, etc). Policy about access by police to information held by retailers about shop thieves. A civil recovery law is needed to provide a proper framework for the process that would be fair to all parties. This would give retailers the right to levy a civil demand against any shop thief, and lay down a framework of penalties covering large and small thefts, juvenile and adult offenders, first-time offenders and habitual offenders.” This clearly shows that misuse of the law by many retailers is now starting to cause concern among the people who helped introduce it to the industry. It’s interesting to see that the client list for the Centre for Retail Research includes most of the worst offenders in the abuse of civil recovery guidelines. “Client List: includes Tesco, Boots, Dixons, HMV, Bhs, B&Q, Lloyds Bank TSB, Photoscan,The Co-operative, Checkpoint Systems, London Archives Libraries and Museums, The Scottish Office, and The British Retail Consortium.”
  7. Matalan Ltd are another company on the list that is also embroiled in this unpleasant behaviour. Recant events have shown that these company's can not trust or rely on the quality of the security guards employed by the company they contract the work out to. Matalan Murder! "murdered store manager betrayed by an Edmonton security guard have spoken of their grief. Jamie Simpson, 33, from Herne Hill, was stabbed to death during a botched robbery at a Hackney Matalan store in March 2008. The store security guard Roy Williams, 31, of Snells Park, was cleared of his murder, but found guilty of conspiracy to rob. Williams, who was good friends with the victim, told six other men how to gain entry to the store and avoid CCTV cameras. He was aware the armed robbers intended to lie in wait for Mr Simpson and approach him after the store closed." I called Matalan head office and was put through to customer services who refused to say which company had provided the security guard service for this store but did confirm the service was contracted out and that the contractor had been since changed. I just wonder how many people has this dishonest and untrustworthy guard accused of shoplifting at this store and have had Civil recovery enforced on them. Anyone in this situation would have a good case to recover any moneys paid. More importantly it raises the question of the quality and professionalism of the people used by these contractors and what if any security / criminal background checks are carried out on individuals before they are given a uniform and allowed to act as judge and jury over innocent shoppers. I hope the family of Jamie Simpson take civil action against the company who supplied the security guard and Matalan Ltd as both are accountable for the actions of the despicable security guard Roy Williams.

  10. I'm not going to give up on this issue! I decided to contact the OFT and the Citizens advice Bureaux. The CAB got back in contact and were very interested in my wife's case. They are still investigating and need to collect as much information as possible against companies like CRL and Tesco. They also had some very good advice. I have sent them all my correspondence with CRL and Tesco. I will be defending this all they way.

Please be assured that there was absolutely no intention to cause you any further annoyance. I'm sorry that you remain unhappy, however we have followed the correct procedures.   12. I decided I would keep up the pressure on Tesco so I replied to their latest communication. Who knows maybe someone at tesco will come to their senses! " Dear Kim, Thank you for getting back to me. No apology required I fully understand that it can take time to respond to all the emails you must receive. Yes I have had a response from a Helen Duke, Customer Service Executive. She was replying on behalf of Sir Terry Leahy who she stated was away from the office. However I have to say I found here response to be very disappointing. She was very dismissive and unsympathetic of my wife situation. More over in the two communications I had with Ms Duke she clearly contradicts herself and is misleading in the statements she makes. I can only conclude from these communications that she is either deliberately trying to misinform me or simply is not fully aware of the true nature of the event, in which case here communication is simply unprofessional. One particular statement made by Ms Duke caused concern. She stated in both her communications that Civil Recovery Ltd were “a wholly independent authority”. I have investigated this statement and found it to be totally false. Civil Recovery Ltd is NOT an Authority. Authority is defined as: a. The power to enforce laws, exact obedience, command, determine, or judge. b. One that is invested with this power, especially a government or body of government officials Civil Recovery Ltd does not meet any of these criteria. They are simply a privately owned limited company who has been trading for less than 12 months. Their date of incorporation as shown at company’s house is 31/03/2009. This is a small family owned business, owned and run by a MR RAZA LOUIS GARDEZI who is a company director. The second point is as to Civil Recovery Ltd being “wholly independent”. Once again this is simply not true. The Security guard who made the allegation against my wife works for TOTAL SECURITY SERVICES LIMITED. My investigations have shown that TOTAL SECURITY SERVICES LIMITED is a company owned by MR RAZA LOUIS GARDEZI who is a director of the company. So the company that the Security Guard making the allegations works for, and the company which MS Duke claims to be an “a wholly independent authority” who are sending my wife the threatening letters demanding payment are both owned and run the same MR RAZA LOUIS GARDEZI. I fail to see how she can describe Civil Recovery Ltd as being “a wholly independent authority”. I find the behaviour of TOTAL SECURITY SERVICES LIMITED and Civil Recovery Ltd to be highly questionable. The Citizens Advice Bureaux have described the behaviour of companies like Civil Recovery Ltd as “Citizens Advice considers such claims letters, and their threat of escalating costs, to constitute ‘deceitful’, ‘unfair’ and ‘improper’ business practice, as defined by the Office of Fair Trading.” In light of these findings I would ask that you please revoke the 4 month ban imposed on my wife. I would also ask that you instruct Civil Recovery Ltd who claim to be action on your instructions to with immediate effect stop sending my wife their threatening letters demanding payment. I look forwarded to receiving a positive reply."

  15. surprisingly I've just had a reply from the main customers service desk at Tesco. I email them at the same time I emails Tesco's Boss. Here is the email. "Dear Mr Brown, (name changed) Thank you for your email, I must apologise that it's taken us a few days to reply, we have been experiencing an increased number of contacts due to the Clubcard mailing. I was very concerned to read your account of what happened to your wife in our Hayes Bull Bridge store, I can appreciate how upset you both must be. I understand that one of my colleagues in our Chief Executives office has replied to your complaint and I'm confident that they will be able to address your issue. Thank you for letting us know and if you have any further queries please do not hesitate to contact us at [email protected] quoting xxxxxxxxx.(number removed) Kind Regards Kim Wright Customer Service Manager Tesco Customer Service" Well what can I say! even I'm confused now. Look like they don't know what each is doing! It also looks like Helen Duke is involved in this [problem] in some way! as she was defending CRL in there actions. A least Kim is expressing some understanding of my wife's situation. I wonder if it's worth perusing this with Kim?
  16. Some more information. The TSS Managing Director is Ricky Gardezi. looks like this lot like to keep it in the family. Now they go to grate lengths to keep people away from any personal addresses they constantly use PO boxs. Well here are the actual addresses. All planing details are public domain. Also use google maps steet view and take a look at the offices of TSS and CRL. Remember TSS claims on its website that "TSS (Total Security Services) Ltd aims to be the UK's Number One retail security supplier of manned / uniformed guards." Looks more like a mickey mouse outfit. Also not sure but this also came up when researching Ricky Gardezi! OC Lodge Now I'm not sure its the same person but made me smile:) The more I look into this the more amazed I am that these large blue chip company's are dealing with such a small doggy company. I wonder if any of the directors of these blue chips have ever visited the TSS offices?

  18. I have written Sir Terence Leahy twice now but it would appear that all his emails are being intercepted by Helen Duke Tesco's Customer Service Executive. It's clear from her 2 replies that she has no knowledge of the UK law! In fact she actually contradicts her self in the two emails. In the first she claims CRL are wholly independent authority that will investigate the incident now that they have all the details! In my reply to this I pointed out to her that no investigation would be carried out as I had already received the threatening letter demanding payment from CRL and that it was dated the same date as the incident. In her second reply Helen Duke contradicts her first reply by stating that in order resolve the matter quickly the details were passed to CRL on the same day! It's clear from these Communications with Helen Duke that Tesco are fully aware of the under hand methods being used by CRL. In fact I would go as far as saying Tesco are colluding with CRL. All the findings of my research so far indict that there is likely to be strong financial links between Tesco TSS who provide security guards and CRL. From the behaviour of the guard involved in my wife's incident ( He refused to drop the issue dispite Tesco staff asking him to ) it would appear that the guards are probably set targets for convictions. It will be interesting to see if they get any bonuses for the number of convictions they make each day. Other wise why would the guard insist on proceeding after being asked not to. This could be working like the parking ticket [problem] that was being operated by many privet parking warded companys working for local authoritys. They were seting their parking wardens daily targets for the number of tickets they were expected to issue. If a warden achieved this he was rewarded with a bonus. Now security guards are known to be poorly paid workers, most get just the minimum wage! It is very likely that a targets and bonuses are being used by company's like CRL. I don't have any hard evidence at the moment and will need to do further investigations so would welcome any security guards working for these company's to come forward and blow the whistle.
  19. Sorry Conniff I have been advised not to post these on the forum. If you pm me your email I can email you a copy. The forms used in store are used to trick people into handing over their personal details. In my wife's case she was given a blank form which stated that she was being band from all Tesco stores for 4 month. She was asked to sign the form to acknowledge she had been advised of the ban. Having signed the form here details were then added to it by the Tesco Staff and a comment added about the alleged theft. This Form was then signed by the security guard and other Tesco staff. You should refuse to sign any form presented to you by Tesco staff or the security guards.
  20. I would like as many people as possible who have suffered at the hands of the civil recovery bandits to help fight against them. First make sure your story is heard. The Citizens Advice Bureaux is asking people to contact them with their storys so they can build up a better picture of what these company's are geting up to. You can do this by simply going to their website and telling your story. RLP makes use of the ACPO on its website in an attempt to make it look official! they even have a picture of a police officer on there home page.   21. Ok had another quick reply to my last email to Tesco customer services see below. Dear Mr Brown (name changed) Thank you for your further email and I can appreciate your views. Please let me assure you that Sir Terry is aware of all contacts that come into his office. I can fully appreciate that you're upset by this matter, especially as this has involved your wife. However with respect, you and I are third parties in this matter as we were not present when this situation occurred. Therefore we can only reflect on the information that has been provided to us. Regarding the ban given to your wife, I'd like to explain that customers enter our premises by invitation. All our Store Managers have the right to revoke that invitation at their discretion. A decision to involve the Civil Recovery Service is not taken lightly. However when it is, it is necessary for such matters to progress very quickly to try and ensure a speedy resolution. No one likes these matters to be dragged out. Therefore, the details of this case were passed to them the same day this incident occurred and the letter was sent to your wife by that day's post. This was to give your wife the opportunity to pay the requested costs incurred before further action was taken. The way Civil Recovery works is that in this example, when someone is apprehended for shoplifting, they will be served with a notice telling them they have committed a civil offence as well as a criminal offence, and they must compensate the retailer for damages, losses and expenses. If the customer declines or refuses to pay the stated costs, often with an offer of a reduced payment depending on the circumstances, the retailer can then sue them through the courts. Further information on this can be found at www.lossprevention.co.uk Civil Recovery are indeed linked to Tesco due to the fact that they deal with such matters on our behalf. However, they also work on behalf of many other retail companies. They are an impartial, investigatory body who undertake to initially deal with civil offences such as shoplifting, in the hope of a quick and final conclusion to the matter for both the customer and the retailer. I do hope this information has been helpful. Kind Regards Helen Duke Customer Service Executive Its clear from these replies that Tesco are simply not interested in any attempt to resolve these issues. From this I can only conclude that if you are ever stopped and accused of shoplifting and know you did not do this intentionally, then you should. 1) Stay calm 2) Return the good when asked and show your receipt 3) Offer to pay for the goods ( they will refuse you offer) 4) NEVER give your personal details to the security guard or store staff 5) Do not sign anything 6) If they do not accept your apology and offer of payment then leave the store 7) If they try and stop you leaving the store call 999 and ask for the police and inform them you are being unlawfully detained against your will. Remember all they want are your details so that they can make a civil recovery claim. Without your details they can do nothing. If they call the Police ask to talk with them in private. There is no obligation for you to provide your details to anyone other than the police. I hope this will prove helpful to others finding them selves in the same situation.
  22. I decided to email Sir Terry Leahy, Tesco's Chief Executive just to see if I would get a response! Well you never know its worth a try. Well I did get a reply! but not from him. here it is, "" Dear Mr Brown (name changed) Thank you for your email copied to Sir Terry Leahy, our Chief Executive. As Sir Terry is currently away from the office I am responding on his behalf. I can appreciate your concerns, however I would like to assure you that this matter will be dealt with appropriately. Civil Recovery Ltd are a wholly independent authority who fully investigate matters such as this. They are now in receipt of the CCTV footage of the incident and the paperwork, as well as the witness statements from all the staff who attended this interview. These included a security guard and a Duty Manager, as well as an interpreter. Ms Brown will be contacted by Civil Recovery in due course when these investigations are concluded. Thank you for bringing this matter to the attention of our Chief Executive. Kind Regards Helen Duke Customer Service Executive "" Well first I was just surprised that I had received a quick response, but disappointed that it was not from the person it was sent to! and from the reply I can only assume that Sir Terry has probably not even seen my email. Well having found a point of contact it seamed only right to use it. So here is my response. "" Dear Helen Duke, Thank you for your prompt reply. I feel that reading your reply I can only conclude that you must clearly not be fully informed about the way the Store in question is acting, as your response is at odds with the actual order of events. You stated in your reply that, "Civil Recovery Ltd are a wholly independent authority who fully investigate matters such as this. They are now in receipt of the CCTV footage of the incident and the paperwork, as well as the witness statements from all the staff who attended this interview. These included a security guard and a Duty Manager, as well as an interpreter." Now the alleged incident took place on the 11th February 2010. Without any independent assessment, my wife was given an instant 4 month ban from all Tesco stores! Then on 13th February 2010 she received a very threatening letter from Civil recovery Ltd demanding payment within 21 days and threatening further court action. This letter is dated the 11th February 2010 the same day the alleged incident took place! See attached copy. One has to ask what is the point of this investigation you claim CRL will conduct when they have already issued a letter on the same date as the alleged incident demanding payment and making threats of further court action. You also state that "Civil Recovery Ltd are a wholly independent authority" which is simply not true. A quick check with company's house reveals that Civil Recovery Ltd are linked to and part of TSS (Total Security Services) Ltd which is the company that provides the security guards to the Tesco store in question. This connection clearly shows that they are NOT independent as you claim. As for the claim of "authority" they have none! They are simply a private limited company which has been trading for less than one year! Their Date of Incorporation as shown on company’s house is 31/03/2009. Having looked into this matter a little further, it's now clear as to why the security guard refused the store staffs requests to let the matter be settled by them by accepting my wife's offer to buy the 2 items as it was a genuine mistake. The security guard was only interested in one thing, getting my wife's details to allow CRL to issue their demand letters which they did immediately! I have also checked with the Citizens Advise Bureau who have advised that they are aware of CRL's and Tesco's involvement in this type of behaviour. Citizens Advice considers such claims letters, and their threat of escalating costs, to constitute ‘deceitful’, ‘unfair’ and ‘improper’ business practice, as defined by the Office of Fair Trading. As a long standing Tesco customer I am shocked to find Tesco involved in such under hand behaviour. As for the statement that you are responding due to Sir Terry being away from the office, well I'm sure on his return he will be interested to learn what is being done in some of his Stores! I would therefore ask that he is forwarded all the relevant communications on his return. "" It will be interesting to see if Sir Terry Leahy, Tesco's Chief Executive will ever actually get to see any of the correspondence sent to him and respond.

It show that their is more than likely to be deliberate collusion between the security guards at Tesco who are provided by TSS (Total Security Services) Ltd and the high number of accusations made against the public by CRL ( civil recovery limited ). It has to be said that as CRL are part of TSS (Total Security Services) Ltd then The security guard have a vested interest in maximising the number of people accused and put forward to CRL to be threatened with demands for payment. Looks like they have a nice little [problem] going here! Now the reply I got from Tesco stated " Civil Recovery Ltd are a wholly independent authority who fully investigate matters such as this." Now this is clearly NOT true. How can they be "wholly independent" when they are part of, owned by or linked to TSS (Total Security Services) Ltd who provide the security guards that make the original accusations!!!!
