Hi, Thank you for all the great advice, just to give you an update the seller is registered as a business seller on ebay, he has sold over £200,000.00 of cars in the last 16 months, he is registered as a director of a used car sales through companies house. What i see as reasonable, is that if i buy a car (regardless of price) that says it has no faults and is a good sound runner then i expect it to last longer than 4 weeks, it is not just the clutch that is wrong there is over 20 faults with this car, now i do not expect the seller to repair all these, i just expect him to repair the car so it is roadworthy again. The car had only done over 100 miles by my 65year old diabetic father in law, so i know he has not been thrashing the clutch or going street racing in it. Thank you for all the great advice
  3. Hi Conniff, I would like to keep the car, but am worried that if i let him carry out the repairs they will not be done to a sufficent standard. The full description from the auction is as in the 1st post, it never said anything about "sold as seen" Regards

  5. the car was bought for my 64 year old diabetic father in law, who lives on a perfectly tarmacced road and only done 136 miles since buying this car, and why would the seller liar about the mileage ? Im quite sure he does not go to rally meets lol so do you think that the seller was fair in telling me to go away ? Regards

  7. hi, i would expect at least 6 months fault free driving. do you not think this is fair ? As you can see in the auction details, he says there are no major faults with the car, do you not think worn shocks , failed clutch and various other faults are a fair point for me to argue. If he would have said that he was not sure of the faults and i could buy sold as seen, then fair enough, but i have just noticed that on the ebay auction he has listed the mileage as 73000 miles but on the mot certificate issued 1 month before me buying it states that it has done 84000 miles, surely this is illegal ??? also he had this car for 7 months but did not register it in his name or company name as it states the last registered keeper as apolish man in scotland ??? Is this legal ?
  8. hi, Doesnt matter what i paid for the car, it was sold to me with defects. so was not fit for the purpose it was sold for ? £500.00 might not be much money to you but it is a lot for me, it is not so much the money it is the point that he refuses to do anything about it. Please tell me if you think i am asking to much, i bought a car for £500.00 and it broke down 4 weeks later, should a car not last for longer than that ?
  9. Hi, im very new to this and this is the first thread i have started. I purchased a used car from a trader on ebay selling cars from his house. i paid £500.00 for a used rover and the description is as below: We are currently having a clearance sale of p/ex's, which are good used cars, with long mot's and many have service history, (see others on this web) This Rover 416 has had the head gasket/water-pump/timimg-belt replaced recently and drives extreemly well. It come with a good MOT, and has the added luxury of air-con There are a few dings and dats around the body, but generally, this car is in a good sound condition ! IT'S HERE TO BE SOLD ! ! NO RESERVE !! CAN BE VIEWED/DRIVEN ANYTIME, SUBJECT TO A PHONE CALL i drove the car home from his house and all was fine, but then 4 weeks later the clutch went and the car was bunny hopping and also the front shocks were making a strange noise. i tried to contact the seller through ebay, he did not answer, i then tried to email, and he did not answer, i then tried to text him, and he did not answer, i then tried to call him, and he did not answer. after about 8 days he then answered with the following comment: Hi, take a long hard look t the feedback you left me on this 500 pound motor car, and decide jut how a court of law will see it, however, I am prepared to send you a new a cutch kit as a gesture of goodwill this will be a FINAL OFFER, rgds john. I then explained to him that i am not a mechanic and do not know how to fit a clutch and a local garage would charge me £200.00 to fit it, and i also explained that there was other faults with the car. i said that i could have the car towed back to his house which is about 25 miles away, and he replied with the following comment: It will be here for an awful long time if you do. i then asked him if he was refusing to fix the car, and he replied with the following comment : Go away, I gave you a a more than generous compromise, there is little more now I can do, or more to the point, prepared to do can anyone help with what i can do now, not sure what rights i have. even though he sold it from his private house it was sold through a business account and his trading name through ebay.   11. post #81 They do get the chance to cross examing you, and any witnesses you supply, so you must make sure you are ready for any questions. Post #84 It is not that i am not keen, it is just you have to realise how serious an ET is. You have to make sure that you have all the facts and allways tell the truth. Any slight wrong doing or if your company have anything on you. it will come to light in the meeting. and believe me the employer has allways done there homework and has a mass of evidence and signed documents , and a signed employee handbook. You have to make sure that you have everything in writing and make sure that you have done nothing wrong, for example the alleged threatning behaviour towards the staff by your other half, they may bring the member of staff as a witness and they will tell the judge how they felt threatned and had to press the panic alarm and involve the police etc. Post #90 the disciplinary and appeal are about you, the ET judge may look down on this. your ex employer should not be dsclosing anything to your other half about your case ? I could go on, but i have advised you on many occassions, but not sure there is anything i can do till you get the evidence pack and then you can work out what your defence is, if you wish to private message me so your company cant see what you are writing, i am more than happy to advise you. I will happily give you advice on the et, as i have done many times in my previous blogs. but i think you should wait till you have there evidence , then you will see exactly what they have and vice versa.   13. Hi, I am purely basing the dates on your blogs and you state that you was only out of work for appx 2 - 3 weeks at the most not 9,10 or 11 weeks ? What was stated in the county court papers ? how did they find out you was using this site ? they must have some really good and thorough managers /spys, lol Regards

  15. Hi, Im very confused about this 10 weeks out of work ? in your earlier posts you state that you was sacked some time in october and that you then started your new job on 21st oct 2010 ???? Your old company and et will be very thorough in checking this out. Regards

Hi, I am just going on my past experiences, that the more aggresive i got the more aggresive my od company got, i put a claim in for costs and loss of earnings, so they then put in for expenses etc, even though i won it still took up a lot of my time, and the money i got certainly did not make up for it. Why was you out of work for 10 weeks unpaid ? i thought you got a job straight away and they would have had to pay you whilst on suspension ??? Regards

  18. Hi, It sounds like they are trying to back out of it, why would they need to clarify a few issues before the et, if they was so sure they was in the right ? Sounds like you may be looking at an out of court settlement. Have they agreed on a settlement figure ? have you requested a figure ? Regards

Hi, Why have you done a sar for the et evidence ? they will surely supply you a copy of everything before you go to the et ? did the company or there solicitors suggest settling out of court,? what was there reason for this ? This will help in the et as it shows they have failed to follow correct procedures. Regards

  24. Hi, I have made no other posts as i only joined this website a few months ago and can only handle one post at a time. I would recommend waiting till you see all there evidence then decide what to do then, as all this is guess work as you have no idea what evidence they have Regards
