I was talking to a woman today and happened to mention the Dispatches Programme tonight on channel 4 Undercover Debt collectors. This poor woman is being driven to distraction by debt collectors phoning, and writing in connection with debts of her sons. Her son no longer lives with her and i believe if she did know where her son lived she would tell them. She has advised all callers that she doesnt know his whereabouts but they still insist on calling and writing . She has taken to opening the mail now because she is afraid that they will attempt to seize her possesions to pay her sons debts. They have threated this , and i told her that there are no Bailifs here in Northern Ireland i told her i would come on here to find out the best way of dealing with this shower of leeches . They wont take her word that he no longer abides at her address and are incessant in their demands for payment. Obviously the first thing is to get the phonecalls stopped and then get them to desist from trying to contact him at her address . Any templates about which would help me draft up letters to give her some peace of mind ?

I have rewritten to them again recently to beseech them not to send me anymore advertising literature as i am trying to save the planet. Seems like it is ok for them to send out tons of unsolicited mail for free , but they expect us to pay for a paper bill. -

Never got the chance to post the above letter, had a reply from capquest this afternoon . Thank you for your recent correspondence and we confirm your account is on hold . An investigation into your complaint will be carried out in line with our in-house procedure as soon as we have the results of our findings a Quality assurance officer will contact you . Please find attached a copy of our complaints procedure. I think they might of gone away you know. Whats the betting the alledged debt is on the market as i type. -

complain , kick up a stink , i got my bill reduced by £5 a month and my services upgraed for free , on the basis i wa entering s into an 18 month contract, i agreed and warned them that if they cange the contract i was within my rights to cancel. I have a few fights on my hands at the min , but once they are finished with i plan to take VM for all their unfair charges. -

How does this sound? Dear Ms Johnson, I do not acknowledge any debt to you or any company you claim to represent. Further to my recent letter dated July 2nd 2009 (copy enclosed) I am somewhat bemused by the fact that you have failed to reply to me within the 7 day schedule. Given that you have made no attempt to rectify any of the issues I raised previously, I must assume that you are taking this matter very lightly. Please be in no doubt that I am taking it very seriously and I have a scheduled appointment with my MP for next week where I will be seeking his assistance in taking your company to task over the various abuses of legislation which have arisen. If you have any queries as to why I have raised the issues enclosed feel free to speak to your company’s compliance manager. I rarely have to repeat myself but once again I request that you submit to me a copy of your complaints procedure to which I am legally entitled. Furthermore if I have to write to you again on this matter I feel that your company should bear the costs of doing so. Subsequently I will be applying a charge of £12.00 for each letter and further charges for research @ £9.00 ph. In light of these charges I also request the address of your accounts department for invoicing. Please note that ignoring my letters will not make these issues go away. Now where have i seen that bottom line before? -
What are we doing wrong ? we have tried everything to contact you. Emmmm Breathing !

In all honesty the guy didnt get the chance to say much , i was extremely polite , that polite that he even said thanks as he left LOL . He didnt get the chance to tell me who he was , ( my mistake for not letting him get that far ) he asked for me by name when i opened the door and i knew what he was , I told him that he had woken me up from my sleep and i would appreciate if he didnt call to my door again unless my house was on fire. I didnt verify my name so think he was left with little choice , i could kick myself for not stringing him along for a bit , but hey it was 9am and i had left my thinking cap beside the bed. -

I opened the door today to a guy , who said he was a door step collector, I eyed him up and quickly assessed that this guy might be hard to bluff. I knew he would be on the ball , I was going to tell him that i had no doorstep , but hardly a convincing argument , as i knew and im sure he knew he was standing on it. Now i usually do give to charities , but i thought it strange for someone to be calling collecting doorsteps. Look mate i says , i do feel sorry for anyone that doesnt have a doorstep , but i only have one , and i kinda need it to get in and out of the house. Oh im not collecting doorsteps he said im collecting money. Oh right i said , fumbling in my pocket for some change , and wondering how much a doorstep costs these days, mines came free with the house so i had no idea . Im sorry mate i only have 80p in change here is that ok ? Well we usually like more than that he said . Now like i said earlier i dont mind giving to charity , but this guy wasnt going to be happy with what i could afford , i actually thought it quite cheeky of him . I can accept credit or debit cards or even direct debit he said. At that point i realised that this guy wasnt collecting doorsteps or even money to buy doorsteps he was a con man and i had nearly fallen for it. I told him to leave which he did . So folks beware , there are some nasty people out there LOL -

Can anyone in Northern Ireland who has had a CCJ issued against them in English courts by Capquest or in fact any Debt Collection Agency , please get in touch , I am currently in dispute with Capquest, and i know that they will throw their hands up and cry admin error after reading my last letter. I want to gather sufficient evidence to prove that they do in fact realise that they are in breach of regulations but are prepared to take the risk against individuals , the more people to shout , the harder it is to stick the noise. Yeah i think i might contact my local councillor ( when i find out who he/she is ) and put the wheels in motion . Though i expect Capquest to come back with the old admin error , just thought it would be nice to collect some more admin errors from other people to back up the case. -

I am considering texting my local paper to see if there are many locals getting harrased by this shower , get a list of names and reference numbers together and make a big complaint to both capless and the oft . Would this be wise? -

This is what is going in the post thanks to scarletpimpernel . Should i await their response before sending my complaint to OFT Dear Ms doo lally I refer to your letter dated 30th June 2009, in which you state your designation as a 'Legal Support Associate'. No debt is acknowledged to you or any company you claim to represent. I confess to being somewhat puzzled by the content of your letter, and would be grateful if you could clarify the following points for me 1. You state that the alleged debt relates to a credit card account, which was opened on 19 Dec 2008, and that your claim was issued on 1st Oct 2008, and judgement was entered on 22 Oct 2008. I require you to explain how Capquest have apparently managed to gain a Judgement against me, two months prior to any account being allegedly opened? 2. You state that the claim was issued in the Northampton County Court. Since I am resident in Northern Ireland, the English Courts have no jurisdiction. I require you to explain why your action was brought in the wrong jurisdiction, contrary to the Practice Direction. I note that bringing or threatening to bring action in the wrong jurisdiction is considered an unfair practice under the Office of Fair Trading Guidance on Debt Collection, and require your explanation for this as well. Be in no doubt that your abuse of the legal system and failure to comply with regulatory rules is an extremely serious matter, and calls into question your fitness to hold a Consumer Credit Licence. Accordingly, I will be sending details of your non-compliance to the Office of Fair Trading and Trading Standards. I am also asking my Member of Parliament to look into the matter and raise the subject of your behaviour with the relevant minister You should treat this letter as a formal complaint, which I require you to deal with through your complaints procedure, a copy of which you should send to me without delay. By way of resolution, I require you to ensure that the judgment you obtained through abuse of process is set aside at once, and I will await your proposals to compensate me for the damage to my credit file and the stress and anxiety caused by you. Your response is required within 7 days. Yours sincerely -
