I am still at a quandry as to what now tho as I have so clearly been disregarded as this DJ has not kept to the relevant FACTS that should have been followed. To appeal & let this DJ know HOW???? Where now...? I need some postings on here now with that information. Or can somebody from the site change my title to D JUDGE MADE WRONG DECISON WHAT NOW?? Have to disagree Pedross as Citizen B has posted already even 6.26 makes it 2 business days - DN posted the Friday 9th Jan2009 ....6.2b ‘business day’ means any day except Saturday, Sunday, a bank holiday, Good Friday or Christmas Day so it would still be the Tuesday not the MONDAY so the judge messed up big time & is WRONG as he couldnt be bothered to adhere to the laws of the land. So I can't help but panic, I just need to know from my postings #294 what I can do about it though and understandably with only 5/6 business days myself to do it in.......

Yes it is a lot of codswallop I'm afraid but a judges decision is a judges decision - or is it??? This is my question.....what to do now as the days are looming..... Why dated Sept but not till now do I get it when I called the court every month to see if there had been anything sent out yet (just incase of lost post?) What interest charges could be applied by them? Can I appeal regarding whats been served not complying with the law regulations, do I do it before judgement next week or after??? Here is a copy of judgement (have noticed it was signed by DJudge Sept 2009 yet I only rec'd it yesterday from the court dated 18th Jan with the handing down notice of hearing set for 28th Jan!!!) I also said it contained no prescribed terms either. He hasnt dismissed or done as I thought he was going to do tho (order disclosure etc) but done a complete U turn on what was implied. I feel disheartened now with it all that he has just decided to discard this now instead as he's had hold of it for too long now. Whats going to happen next wk when I turn up now...is there anything I have to prepare for it???

I am in a similar position as today I rec'd my DJ decision with a JUDGEMENT against me :shock:from my SJ hearing last July. I have to appear at a Notice of handing down of Judgement hearing??? 28th Jan....9 days away. Been waiting on directions all this time so gutted to say the least as in court the DJ told me he was dismissing there summary judgement until the next hearing so dont know whats gone wrong between then & now as hoped something along the lines of them having to do disclosure etc I had such high hopes:- My CCA has never been produced (Priority Request form no prescribed terms etc so should be unenforceable) No T & C only recent 2008 ones sent. (Judge is satisfied me having been served with a COPY of Priority Req Form & CURRENT T & C & says it complied with requirements of S.78.) WHAT EVER HAPPENED TO MY RIGHTS TO SEE ORIG & ALSO THE FORM HAVING NOne OF THERE SIGNATURES ON IT??? DN is defective........ 9th Jan remedy date 26th Jan2009 (14 clear days it was not) Judge has disregarded the practice directions given in my defence as deemed it to be served to me on the 12th Jan so exactly 14days . Trying to stay positive MJ but with time not on my side am beginning to feel like a rabbit caught in the headlights just now & feel so let down by the justice system whilst the other side no doubt will be rejoicing!! Hi Chesterpants I am with Payplan as per the poster above...they are great & got all the interest frozen on my debts which I tried to do myself with the creditors but they were having none of it. I have been with Payplan a couple of years now & my husband since 2004. What I would say different in my experience to loobyloo85 tho is not let the debt management people deal with your legal stuff should you ever get served a county court form as when they deal with it on your behalf they end up admitting the debt & thats when a CCJ/Charging order if you have a property could occur?? Definitely check to see if your CCA are unenforceable first as squidward has mention using the relevant template letters on this site & when the default notices start arriving post them up (via photobucket) on here so the caggers can give you all the advice you will need .

Letter it is! They can't have what we haven't got as our circumstances went the opposite way to be honest...income drop last yr/redundancies etc but they still all got payments divvied out from Payplan as we dont like to upset the cart as they say so had better be grateful they are getting approx £20mth!! But I will stop this as I did to MBNA/Restons payments if they carry out any funny buisiness... Just want to be on my guard if you know my meaning
