  1. Hi John, thanks for posting. I'm still waiting a response from my SAR, posted on 10 January (unfortunately, not signed for) so being the generous person I am, I'm only counting the 40 days from the date the cheque was shown as cashed on my bank statement, which was 2nd February, although they must have had the cheque many days/weeks before that. Therefore, I've still a little more time before they are 'out of time'. They wasted some, requesting a further signature, as the one on the letter didn't match they one they had 'on file' (I am simply not happy sending something without a signature), hindsight is a wonderful thing though . No doubt there's a possibility they could say they 'never received the 2nd letter' - the one explaining why they don't need a signature. But we'll see.

  3. Have retrieved envelope from bin ;-) - no date on it though. At this point (I hope you all agree) I see no point in responding to the letter, as I'm still awaiting response to the SAR. I'm counting the 40 days from when the cheque was cashed (which I feel is very generous, as they must have had the letter several days prior to that). They have approximately 7-8 working days left...... I shall endeavour to research further over the weekend, as long as I'm blessed with some spare time. You have no idea how much encouragement you lot are giving me.
  4. Thanks everyone. This is their latest letter, I'm reasonably sure it's a standard letter. Although they didn't enclose the OFT leaflet they refer to. I don't plan to respond to it at this stage, as I'm still awaiting the response to the SAR and I'd prefer there not to be two lots of correspondence going. Any comments anyone?

  6. Received a letter today, which I shall endeavour to scan and post later on, but I do have a question. Where do you guys do all your research? I'm very grateful for all the assistance I receive, but sometimes I'd like to find stuff myself, then run it by CAGs for opinions. I know there's a lot of info on the various threads but there's simply too many to go through in detail, and it must be tiresome for you guys to keep repeating the same advice to various people like myself. Is there somewhere in particular that's good for researching everything? Many thanks

  8. Thank you both. I didn't send signed for (OH posted it thinking he was being helpful) but they have cashed the cheque sent. I guess it would be prudent to count the 40 days from when the cheque was cashed, as that was a date that can be proved? Do you agree? Also, with the 40 working days, do we work on a 5 or 6 day working week?

  10. 'Tis ok, I've just found the link that tells me all about truecall. I'll have to find out more and give it some consideration. I've got two major thoughts about it at the moment (1) we're a business so do get lots of calls relating to that and (2) we're not BT - the only part of the country where BT do not operate, and i'm not sure of the implications of that.
  11. Thanks DD. Can you tell me how this truecall system works? I'm afraid it's not something I've come across. Also, I do believe that Cap1 are now out of time for their response to my SAR, what are the implications of this? Thanks for your assistance, it's greatly appreciated.

I don't disagree that they have a right to chase, but we have specifically and repeatedly requested they put everything in writing, perhaps they struggle with basic letter writing - as I'm still waiting for a response to my SAR ;-) Gez, we ignore the calls as best as possible, but it's the phone ringing several times a day, at all sorts of times, which is quite intrusive. I know Cap1 have a job to do, so to speak, but it really bugs/annoys me when they resort to tactics like this, treating people like something scrapped off their shoe, without knowing any of the background, etc.
  16. we're getting anything up to 6 a day now Dotty, and they've also started using various numbers (guess they're just trying to catch us out).
  17. I agree with John and Laura - rant all you like, and keep your chin up. By the way, has anyone done a letter to Ofcom etc complaining about the phone calls? I haven't found a template, and wondered if there was a particular format to follow? Oh, and they've obviously realise we recognise their numbe so don't answer the calls ..... they've started with another number, together with lots of sarcasm about how they will continue to keep phoning and not write.....

  20. Not yet Gez, it's still a final option at the moment, but to be honest, the mere word terrifies me. I've never had a situation like this in my life!! At the moment, I'm still hoping that of the 3 creditors, one (Natwest) hasn't a hope in hell's chance, they've admitted no agreement, and despite no payments for 4 months now, I've not heard anything. The second is this one (Cap1) and the third is more difficult, full CA provided, only thing missing is the cancellation option. Haven't done anything about that yet, and may or may not do so. It be my preference to have them all settled at a reduced amount in the not too distant future. But we'll see.
  21. Ah, I should've worked that out, lol. That's serious isn't it? Anything you can do about that? We're possibly on the verge of bankruptcy anyway, so if Carp1 have any sense, they'll try and do a deal with us ;-) But then again, do they have any sense??? ;-)
  22. forgive my ignorance Gez, but what is SD? (I may be just a little dense this morning) ;-) It has also just dawned on me that Cap1 have absolutely no genuine reason to query the signature on my recent letter, indeed the cheque enclosed with it (which has been cashed) quite clearly had the signature on it that they are familiar with. So I have adjusted my letter to reflect this ;-)
  23. LOL Dotty, at the moment, they're only using the one number to phone us, no doubt that will change sooner or later. I must've read on someone elses thread that they had given up. I know I read it somewhere. There's too many threads on here to keep up with, lol. I shall be sending my letter this week. Let's see what they come up with this time. No doubt I shall be provided with yet another copy of the application form. I do think that acceptance of the cheque indicates they should be accepting the letter, and believe a Court would too. But then again, I've been known to be wrong. ;-)
  24. we know the number now Dotty, so don't answer it. Did I remember on your thread that they did eventually give up? If I'm right, approximately how long did the calls continue before they got the message? Thanks for the link Gez, I'll have a peruse later on.
