  2. Hi Fred, Thank you for your encouragement, today I've got all the P/O's for a few other DCA's, I have 12 or so to deal with over time. Have to start somewhere. Clock is ticking on 1st Credit. Just looking at getting a scanner so I can post their replys here less personal info. Slowly life returns to the undead, quite empowering!!!
  3. Hi there, I've seen other post's like this where if you have paid over one third of the total the only way they can take the car is if your son sign's a document to let them do this. Do you still have the original agreement as this may turn up in the Terms & Conditions (small print). Again sorry, but this will keep you near the top of the list. Good luck
  4. Hi Gaggers, What a shocking read, I often think what would have happened if your friend had had legal representation on the day at court, can't image that this would have happened like it did. Surely the whole point is they admitted to not having a CCA! these CC Judges are quite a worry and its a lottery to whether your get a proper one or not. Thoughts are with you.
  5. Hi noomill060, Ok OK what with Von Greenbach telling me to keep sending nominal payments and the wife wanting to put food on the table only the 1st Credit CCA's have gone off. Yes I promise the Barclaycard & BOS/Halifax will go within the next couple of days, promise! I know you mean good but my wife doesn't understand or believe in the power of the CCA, I blame the CAB for that. Thank you for your advice as I do need the occasion kick.
  6. Hi noomill060, This is a VERY interesting thread as I am just about to start the exact same path in the next few days, even my years and companies envolved match yours to! Just prey I have the same result. My only worry that due to advice of CAB I've been paying a nominal x to Goldfish for quite sometime but as you say Barclaycard have now taken over the Goldfish business and they promptly stuck me with the Mercer/Caulder route of inhouse DCA's. Still I really hope I can enjoy some of the moments like you obviously are! Thank you for supplying the light at the end of the tunnel.
  7. Hi Dollydoo, I read your thread with interest as I am just starting down this road. My only comment is that this situation has been rolling around for quite a long time, the shear fact that its been passed from DCA to DCA must mean something, why so far has no DCA sent court papers to you? Is it because they are not confident about Halifax's paperwork and hence don't have the bottle to start proceedings as they may lose and end up paying damages to you. I will follow with interest.   8. Hi there fellow gaggers. Well I've even received a sample letter from the CAB requesting a CCA from a DCA, very basic nothing like template N but it does state on it 'It is my understanding that if you cannot provide this information that you are then unable to enforce any debt'. So yes if you know about 'CCA' matters the CAB might give a little info but thats it, really they just want you to keep your head in the sand and keep paying what you can until your hit with a SD then they run away as its a civil matter and can't help with any representation. My whole experience of CAB I'm afraid to say on this matter is quite negative. I know where I belong and its here on CAG!!!
  9. Hi Kraken1, Understand now. I must admit I shouldn't have bothered with this thread, the judgement is unsound and as such has no baring. Just the CAB rattled my cage and for a while the brain was disconnected. What I know so far is that this site is great, the work people put into it I believe has and will continue to make peoples life's a lot happier even save life's, assuming people like me keep finding it!!!

  13. Hi havinastella, well I've just started finding this out very quickly, hopefully with the help of seasoned gaggers I can have a bit of a fight back! Have got another thread running with actions to date, but don't know how to insert it in this mesaage. Sorry with time comes more experience.
  14. Hi Godmother, Sorry for slow reply been reading other long threads where your very very helful. My visit to CAB today didn't do me any good and posted this up before I had time to sit down and work out what they were trying to do, i.e. keep on paying and don't rock the boat. If only DCA's played nice, since there not I have decided to start down a long road with the CCA request to quite a few credit card firms, could be very busy. Regards
  15. Hi Fred Thank you for your advice, yes I will probably do that as it looks like these threads can get very long! In reply to your question, sadly yes. Citizens advice stated that 1st crudit will go for CCJ, then Charging Order then Inforcement order. Nice people at CAB. Regards

  17. Hi All, Just a quick question, I see 'Von Greenbach' advises I keep making the nominal payments whilst I wait for the CCA requests to be processed. Will the DCA try to use this like 'as good as admitting the debt' or is this OK. I only ask as we are due to make a payment before Jan end. Thanks all!

Hi All, I've been told today by my local Citizens Advice Bureau of a recent case where the Judge ruled in favour of the DCA chasing a Credit Card debt without a valid CCA, they reckon it happened in November 2008. The CAB stated this has possibly set Precedent. Does anyone know of this and are we all fighting a lost cause?
  22. Hi cerberusalert, well my visit to the Citizens Advice Bureau didn't go well. They informed me there was a legal case in November 08 where the Judge ruled that the Credit Card Company didn't need a valid CCA and ruled in favour of the DCA. If this is the case it sets precedence and we are all done for, have you or anyone heard this??? or is it scary tactics from my local CAB???
