  1. Hi All, I just got this in the post this morning! I HAVE NEVER had a cheque account with this alleged debt! I first heard about it when I got this - I then have asked them for a CCA (via CAG Template) in December following the Statutory demand - They totally ignored me, took the postal order and sent this - I ignored their request for info (the cheek of them!) They obviously do not even know for sure if I am the person they think I am! I then sent them "Time Up" letter (via CAG Template) in January - They ignored me yet again! It appears that they take no notice of the CAG templates and are a law unto themselves! What the hell do I do to get these idiots to get lost? They have no CCA, no statements, no details NOTHING and yet they continue to process my data! TODAY I have now found out I have an account with them!!!! I think that they are absolutely mental! Should I sue them? Thanks, G
  2. I am resident in N. Ireland. I must have a gander at their offices next time I pass through their town. So, what should I do then? Thanks, Gary
  3. I got a few default letters from BOI, I wrote to them to try and sort out a repayment plan etc. Told them I was on benefits with a disabled child etc. and would pay what I could afford. They completely ignored me and started threatening me with "in house" debt collection. I then sent the CCA request template. (see above) What REALLY, really frightens me is that these companies can do what they want. They ignore CCA requests and threats of legal action and have no regard for the law whatsoever. I would dearly love to report them but I don't know how to!
  4. Did you send the CCA request to bank Of Ireland?Where do this cashflow company come into this? I sent the CCA request to BOI. I got nothing from BOI so I sent them the follow up template for no received CCA. Did BOI assign your debt to Cashflow and give you the neccessary information about it? They must have assigned it, I got nothing further from BOI. I got no information that it was assigned to them. In other words, BOI completely ignored my requests/letters and passed it on.
  5. OK! I had a credit card with Bank Of Ireland. They were threatening me with all sorts so I asked them for a CCA using the letter template. 6 weeks past and "nothing" so I sent them the follow up letter from the template. Another 2 weeks past and the I got this. I found this letter to be very threatening, "if contact is not made with us immediately then an area debt collection agent will call to me? I sent them the "Account In Dispute" template letter and I got this, this morning. I don't know how to answer it, or where to begin? Their "complaints" procedure forms use the terminology "DEBTOR" throughout and have to be signed by me etc. I reckon that this "complaints procedure" has very likely JUST been written for my benefit. Surely they should not even have an account for me as there is obviously no signed CCA? I think these people are "calling my bluff" but I need to be absolutely sure before I write to them of my situation. What should I do?
  6. Thanks fellas, The biggest worry I have at the moment is a letter I received from a DCA after I challenged them for trying to collect a debt that was in dispute. I would like to show you the letters so you can give me your advice. I know what I want to say to them but I cannot put it into words. If I showed you would you give me your advice? Gary
  7. Thank you! I understand everyone has "off days", I am currently having "off days" 7 days every week whilst I try and rebuild my shattered life after redundancy! I appreciate the help given me, really! Sometimes it would help if you understand that some of us are only starting our battles and are very apprehensive about it. For those of you who have been through it and came out the other side I have the greatest respect for. Please! please! try to be patient with us. We don't know nearly as much as you do. Some like me, cannot even begin to put this into perspective in our heads. I struggle to cope with it all, thats why I need help and advice from you. Dave, when I read through your posts I was amazed at some of your letters! I wish I could compose such masterpieces, but I can't. That's why I'm here, so someone can guide and help me. I am not avoiding debts I just cannot pay them anymore, I am sick of feeling like a criminal. Gary
  8. Er? JUST WHO IS TRYING TO GET OUT OF PAYING DEBTS HERE? Having read through Diskmandave's epic post (linked above). How on earth can he accuse anyone of trying to avoid repaying debts. His whole thread was about avoiding paying debts and yet he tries to moralise me? You both got some bloody nerve even suggesting that I am trying to get out of paying debts. BTW, "publicly" stating that you agree with "his" view IS moralising, cowardly but still, moralising! I cannot believe the double standards! I am absolutely stunned at both of you! I come here for help only to be confronted with insulting remarks and accusations!
  9. http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/68852-ltsb-no-agreement-game.html#post592192 Absolutely hilarious! POT CALLING KETTLE BLACK!
  10. I am confused as well mate! Maybe because I am Irish?
  11. Could you please elaborate AC? Are these "tick boxes" important in some way? Thanks, Gary
  12. Dave "chill out!". Who are you to judge me? Who said anything about avoiding debts? I just wanted to see if this was legit, thats all! IT'S PART OF THE PROCESS OF CHASTISING NAUGHTY DEBT COLLECTORS! This CCA doesn't belong to me. It belongs to a woman who is separated, totally broke, has 4 kids, has no computer and who is being hounded constantly by a very unscrupulous DCA. Phoning her at 8am and 9pm etc. and doing all the naughty stuff that "most" people on here help others to sort out, thankfully! Or have you forgotten? If I had of worded the post differently you probably would have been the FIRST to recommend getting a copy of the CCA, wouldn't you? Well, here it is! Now please, if you aren't going to help then don't bother me. I don't need morality lessons from someone who has 4,156 posts on a Debt help forum.
  13. Hi, Could someone please advise me if this agreement is enforcable? I have went through it and it seems very basic with a few things left out! Direct link! http://i220.photobucket.com/albums/dd225/hackingturd/Santander.jpg Thank you very much! Gary
  14. Hi All, THANK YOU for the advice! I just got this letter today! Can anyone please advise me of a way to sort this idiot out? I am useless at writing letter so I would really appreciate some guidance. Thanks, G
  15. Hi, I just got this crap from A E Locke at Hillesden Securities. Basically, he is saying that, even though he has absolutely NO paperwork or CCA for this non existant debt he can do what he wants? How can he do this? He even admits that he is in breach of the act in the letter! Where does he get off reporting this to Credit Reference Agencies even though there is no debt? Can someone advise me please on how to sort this idiot out! Thanks, Gary
  16. I wrote them a REALLY nasty letter threatening all sorts and they apologised and told me the debt had been passed back to crapquest! Result! I "should" really complain officially etc. etc. and contact Trading Standards etc. but they would probably close down and reopen, such is the quality of the company!
  17. ALL DD's are stopped, I've a good mind to still them to stick their account! I don't really use it now because of these charges. The account has no real activity going on. Paypal have passed the debt on to (drum roll) Iqon! So under no circumstances should they be trying to take money again. They have NO chance of me paying it but the phone calls are beginning to annoy me! What I wanted to know is "is the letter from Halifax legit?" I am on benefits and I thought banks were not allowed to "PENALTY" charge you if you are in receipt of benefits? They have done a really scummy thing to me, putting someone overdrawn by charging them like this is low. Can anyone suggest a way forward or should I tell them to stuff their account and chase me for the money which will be in dispute anyhow? I really despise banks and if I could I would never use one again! Thanks guys for the help! G
  18. Right, I send Halifax the "Reclaiming Bank Charges" letter if you are "on benefits" and this is their response. I REALLY need guidance with this one. It seems as if they have flipped the law around against me! From the contents of this letter I gather that they are trying to tell me that this law isn't valid and they can do what they want? Can someone please advise me what the hell they mean by this? I am still getting charged £15.00 EVERY time a DD fails. The most recent was the internet which I had forgotten to change over to another payment method. The original £28.00 from Paypal has been passed to Iqon to collect (mind boggling!). Your thoughts please? G
  19. Thanks for the help guys! I really appreciate it! G
  20. Hi, Just had a letter from Belfast Collection Services Ltd. threatening me with a "Doorstep Call". This is regarding a debt that Capquest were chasing me for. I thought companies were NOT allowed to pass/sell on debts that were in "dispute". I sent Capquest a request about 3 months ago for a CCA (via template here) and never heard anything from them regarding this until now. I have also informed them that this debt was also statute barred. Can anyone advice me what to do regarding this new parasite? Thanks, G
  21. Hi All, I had a dispute with Paypal sending money to Disney for Toontown which I did NOT want and they KEEP on trying to call the money from my bank account. The amount is £28.00 for a subscription that I thought was a ONCE ONLY payment. I have told them umpteen times I did not authorise a subscription ONLY a once only payment. The same thing is happening from EBay for sellers charges for £5.56 for an Item that I didn't sell. I cannot change my details on Paypal and have even tried to close the account. They seem to be deliberately forcing me to pay for something I didn't want by making it impossible to stop ONLY by paying out! Anyhow, as my Easycash Account is now overdrawn everytime Paypal try and claim this money I am being charged £15.00, this is happening twice a month! I am on income support as I am a carer for my disabled child. Money is very tight at the moment. Paypal and EBay make it extremely difficult for you to resolve any problems. The admin stuff you have to undergo is horrendous. I have tried accessing the letter templates but I can't seem to get to them (see my previous post). Can someone PLEASE guide me to stop my bank charging me £30.00 a month even though they know I am skint? How do I go about getting the charges written off, it is totally unfair. How can they justify charging someone £15.00 for a £5.56 return that they didn't pay? Thanks! Gary
  22. I am sooo very frustrated at the moment! The site has become so damn complicated! All I want to do is get a look at some of the letter templates for bank charges and the like! WHY O WHY won't it let me see them! "Register to read more...." I AM Registered, I AM logged in! What is going on?
