  4. Also received unsigned T&C's from BarclayCard stating they have fullfilled their obligation under CCA 1974. I think they have had some hot-shot lawyers look into this. Not meaning to be silly here , but has anyone written in and simply asked for a copy of the original signed agreement without any legal motivation. Eg. Dear Sirs, I would like to assess my financial situation and my Credit Agreement with you plays an important part in the assessment. Please kindly supply me with a copy of my original signed Agreement with you. All the best, Ouch123. Naive???

  6. Jimmy42, Why on earth did you pay these guys?? Try and look at your situation from an outsiders point-of-veiw. Say I called you up and said you owed me money, would you pay me??? I doubt it. Surely, you'd tell me to bugger off and proove my claim in writing FIRST.
  7. Hi - I am a total novice and was just wondering about the following: The doc has "Application Form" as its main title, and then "Credit Agreement......" as a secondary subtitle. Which is it? An "application" is usually a precurser to an agreement, not an agreement itself. From a legal perspective, can it be both? Doesn't the ambiguity confuse the consumer? Is there any merit in the arguement that the consumer thought the were signing an Application Form - not an Agreement? If anyone has the answer to this please let us know. It could be relevant in MW's situation.

  10. Hey Almond - chin up. Debt collectors play on your fears and they know that you don't know what to do. Keep coming back to CAG and people will guide you every step of the way. Most importantly, you will be OK.
  11. Hi Filt From what I have read in this forum, I have my serious doubts that MBNA will be as reasonable as that. Can I suggest you CCA them at the same time. If you find that their Agreement with you is unenforceable it will give you extra clout and put you in a better position to bargain with them. Also, once the deadline for them to respond to your CCA request is near due (11th day say), send them a S.A.R. request and include a request for a copy of the Agreement again. Don't mention that you sent out an earlier CCA. The reason for this is that they are known to falsify Agreements, and some people on this forum have received 2 different versions of the Agreement. A judge is unlikey to be impressed if you end up in court. I am still picking this up as I go along, so if anyone else reads this, please correct any errors I may have made. Watching with interest.

    Thanks Filtered... They are out for a quick buck without much (edited: should read ANY) care for the hurt and angst they inflict on people. Fortunately websites like this (and the web in general) will help a lot of people discover their dirty tricks. Cheers and good luck.

    Hi again, I haven't sent off CCA yet as there are a few things bothering me and I need some advice. 1) My wife and I are living in a rented property but we own a small one bed flat that we are letting out. The equity in the flat is minimal if any, and the rent earned pays the mortgage. Could they put a charge on it? Is there anything else I should be wary of? 2) Also, the debt with MBNA is around £5500. Should I try bring the debt down to under £5000 so that it is contested in small claims court, or leave it above £5000 so that it is more expensive for MBNA to take legal action? Or is this irrelevant? 3) I have worked at that over the last 8 years I have paid MBNA £6300 in interest! Clearly more than I have ever borrowed from them. So they have already profitted from me. From a purely business/number crunching perspective, are MBNA less likely to chase accounts they have already profitted from vs. accounts where they are still at a loss? Quick rant: What really p%&$sses me off about all this is that when I took the card out they where only charging 7% interest so I could slowly pay off the debt. But then they ramped the interest up to almost 20% which made it impossible to pay back. Thats why I don't give a damn about not paying MBNA! Frankly, they created the scenario and have left me no other option but to fight them! Rant over.

    Hello everyone - First off, let me just say that you are all fantastic on this website. I have spent the last 3 days reading the posts and I am staggard at the quality of the advice. Absolutley brilliant. Thank-you to all who spend time helping others. Starting out with MBNA CC debt. Will be sending off CCA tomorrow.
