  1. your oh so right LSP - they dont like questioning, before they could and have been able to make up whatever they like and tell us all to "lump it". its evolved now to an art form, im certain they have employed professional ex government spindoctors, because the arguments change so often. whats really bad news is that the establishment is fully behind the banks, CC card operators, so it becomes m,ore and more diffiucult for the guy in the street to get any help whatever. because of the constant barrage and change in terms and whatever can or cannot be given, the poor guy out there without any knowledge and help hasnt got a chance, and all of what we are reading and figting against, is by design, To limit collateral damage - we just got to keep strong and continue to dwemand what is right and rely on the law, not misinterpretation by smaller minds who are fiddling to find ways out- pb
  2. im with yu on that BD, your logic is irrefutable, the problem we all have, is not with the law, but with the CJ's who sometimes interprete it with rose tinted glasses on. and thats where the problem lies - pb
  3. well saying they will defend is normal par for any claim, so nothing new there. i would also expect them to actually file a defence - in the normal way, saying everything in your poc is basically a load of tosh, and asking to dismiss the claim. but that too is predictable, ill be keen to see what these beggars actually do do - await report and tks sg, very very helpful for all of us lining up to go the same way - pb
  4. just had my latest letter from next, they dont"want to talk anymore" shame init, because i do, but i can wait a little to see what they dish up to yu -cheers pb

My acct opened 2000 and letter says you opted in, by not saying NO, must send them an invoice every week and tell them they opted in. waiting to see what result yu get at court, but remember solicitors always get things set aside, for reasons you and i would be laughed out of court for, so until judgement day -dont hold your breath that its over. meantime good luck, and await update - pb

  8. dd-basa, can see what dd is doing basa, he is putting your theory to hard test, however, the other side to the argument about signing in ignorance of the law is, -eg, had £10 note - now misplaced money, you cannot go t the bank and give a copy of the one you had in the cupboard and now having lost it want the bank to pay on a copy. = yu got nowt. same in law, if yu got nowt - you get nowt - pb
  9. basa im with yu on the interest front- and the justification for this hike in interest is that they are "losing" money, most of the losses they are taking are created by the very problem you highlight in getting justice for the charges and interest compounded on them as for your other argument about, not paying - thats a hard one - but i can and do still agree with your basic contentions - keep up the good work - and very best of luck - pb

  20. well for my two pennyworth. this shows us all just how easy it is to move on bad debts that could possibly have no legal foundation. the toothless oft caN DO NOTHING, these operators can supply toilet paper as proof of agreements, sign themselves off as complied, then sell on the bad non existant debt. our credit cards are a small window to just what these jokers are and have been doing on a much grander scale. Still these are the professionals - ha:D
  21. These beggars know thaT fos HAVE NO TEETH and dont they show total and utter contempt, about our rights. - I am at a loss to know what can be done to escalate this continued abuse of rights. Ding DinG and ellie are now famous for this misinformation, but as long as the organisation who is supposed to do something has no bite, this will just go on im sure. with the certainty, that our debts will be moved on, "Terms fulfilled" - it really is no laughing matter - pb:mad:
  22. wish i could tell you lex, but iv been on at them forever, never got copy of agreement, but my claims have moved past the infamous ellie, iv now majored on to James (dingding) Bell. so maybe you still got long way to go- keep at them and formulate claim against them asap-meantime they will maintain that they have supplied whats required under the act, and continue to pass it onto dca's for action. as for trying to get agreements on lower payments - all these beggars are the same, they pay lip service to wanting to help, but always want it thro a third party. - im still trying to get agreements, all the card co's still keep adding interest and late fees, so as i said earlier, better get in a claim for what they have taken from you and then see whats left that you might owe them. could be even better if you had ppi on card, - pb
