  1. Hi Hellhasnofury. Thanks again for your help with this one, you helped me greatly with my FirstPlus claim which is now with the FOS. The Copy of the Credit Agreement they have sent me shows absoulutely nothing to do with the PPI, there isn't any reference to it at all on the whole form. Does it mean that even if I agreed to it over the phone that because i havent signed something, they aren't allowed to just add it ? I am going to write back thanking them for sending my copy statements but asking why there is nothing in there at all with regard to the PPI. KaneCole
  2. Hi I have written to Sygma stating that I was never told that I had taken this insurance and that it was optional and the insurance was never explained to me. I requested a copy of the Credit Agreement and there is nothing on it at all with regard to the insurance. I then received a letter from them stating that they are unable to uphold my allegation of mis selling at this stage as they are currently waiting for a copy of the call recording in which the insurance was sold. I then sent off an SAR because I have no recollection at all of a telephone conversation at all because this card was sold to me in the JJB store and the credit agreement was completed there. I have now received their information following the SAR, but all they have sent me is copies of my monthly statements which I already have. Should I go back and say that if there is such a recording they should have sent me a copy of it or just wait to see how they respond. Thanks Kanecole

  4. im thinking i maybe just got lucky on this one. The one I have with First plus is with the FOS now and like you i turned down an offer of £4k but the difference is that they owe me more in the region of £14k whereas the Halifax have given a full refund. Kanecole
  5. Hi Olives. I started the process in February this year and they agreed to refund last week. We argued that it was never made clear we didnt require the protection and were never told it was optional or given figures without the protection. Also it was never made clear that the insurance was added as a lump sum and we would not receive a fair and proportionate rebate if we settled early. In addition to this a demands and needs statement was not completed to ascertain its suitability for us and we never required it. We had about three refusal letters before the one where they agreed to refund. This last letter was sent after i was sent all my info following an SAR and I argued with them that there was nothing in there that would support any of their arguments. Hope that helps. Kanecole
  6. Hi All JJB are still saying box was ticked for protection on the application form and we would have been sent paperwork etc.. But I am saying that because I did not complete the form just signed it and did not tick the box I did not agree to it and it wasnt explained to me either. Because this card was taken out in 2001 can I send the complaint to the FOS ? If not who can I complain to ? Thanks Kanecole
  7. Hi No we never signed anything, and cheque has already come today. It looks very much like it is nearly all of it bar some admin charges for settling early so we havent lost out at all. Kanecole
  8. To Alanalana The wording in their letter is this exactly does not say "gesture of goodwill" at all. "From our review we have found no reason to believe you were not provided with the relevant information at the point of sale to make an informed choice, However, as valued customers we are prepared to put you back in the position you would have been in had you not taken the insurance. This is done without admission of liability and in full and final settlement of your complaint" To adamski I already have an SAR and I have looked through the figures and it shows we received a rebate at the time of settlement of the loan of £685.92 for the insurance Kanecole
  9. Hi Had claim with Halifax for misselling PPI on a loan from 2003. Received letter today advising that although they still believe we were not missold they are prepared to put us back in the poisition we would have been in had we not taken the insurance as we are valued customers. I am really thick when it comes to working out what we are owed with this and hoping someone could take a quick look to see if what they are offering is correct. These are the details :- Cash loan £4000 credit for loan £2270.60 total loan £6270.60 Insurance loan £1252.31 credit for insurance £668.77 total insurance £1921.08 84 monthly payments £97.52 Annual percentage 13.9% monthly rate 1.094% They have offered the following : refund of premiums £566.39 refund of 13.9% £333.41 interest at 8% £273.37 total £1173.17 we had this loan for 2 years from april 03 to april 05 and when we settled we had to pay £3848.95. I appreciate any help in advance. Still have 2 claims against first plus that have been with the ombudsman since may and received a letter yesterday to say still awaiting an adjudicator. thanks Kanecole
  10. We claimed back the difference between the highest rate and the £12 that was agreed fair going back to when we took the card out in 2006 but havent tried to reclaim anything while we havent paid this year.
  11. Hi All Hope some one here can help never posted in this forum before. I have a JJB Mastercard which I couldn't afford to pay and stupidly ignored (mortgage and bills were main priority) Today have received a letter from a Solicitors which is a Termination Notice and they say Court Proceedings will now be issued for recovery of the full balance. Can I go back and try to reach an agreement to pay money off the amount owed but ask that the interest is stopped or do I just go to court ? I have also notice that I had protection Insurance which I didn't request so I am asking for a copy of the Credit Agreement and a full refund of this. Should I send two separate letters ? Please help what is the best way to attack this (if I could get hold of them i would do it literally). Thanks KaneCole
  12. Hi alanalana Thanks for your help with the CCA request. JJB very quick to respond and I received a copy within 4 days. Can anybody now help with how I word my response. The agreement sent is dated 21/8/01 my signature is on it but I didn't complete the form, it must have been done by the sales person as it is not my writing. The section for the 3D protection is just a ticked box which again i did not complete and neither was it ever explained to me. All I did was sign for the store card. How do I word this when I go back to push the miss selling ? Also I was never given a copy of the agreement originally. Thanks KaneCole
  13. Can anyone point me in the right direction for a standard letter to request a copy of the agreement i signed for this card back in 2001. I have noticed now that I am paying protection insurance on it because I owe more and therefore the amount is much larger, didnt notice before because only owed under £100. I dont recall asking for it and dont have a copy of the orignal agreement. Dear All I havent posted on my thread re first plus for a while but just to let you all know we had the same response re the 78% refund and I went back and told them politely no but we would accept it as partial settlement. They basically told me to go away, that it was their final offer so we have sent complaints in respect of both of our first plus PPIs to the ombudsman about 10 days ago and are awaiting a response from them. Will update my thread as soon as I hear anything. KaneCole
  15. Hi Chickpea. We have a very similar situation going on with First Plus and have just forwarded everything to the Ombudsman. Can you tell me the timescales, ie when did you first hear from the Ombudsman ? Did it take months ? I have a separate thread running for my claim and am interested in how long I might have to wait.   16. Hi Can anyone tell me where I find a template letter for when the company doesnt provide the SAR within the 40 day time limit ? I have a separate smaller complaint with the Halifax for PPI and i sent the SAR to them on the 27th March and haven't received anything. Thanks KC
  17. Hi alanalana Thanks for your message it was really helpful. There is definately phone conversations missing from the tape so I have sent a non compliance letter. FirstPlus again have confirmed that there offers on both PPI is their final so i am now going to go tothe Ombudsman, FSA and OFT. I have found the form I need to complete for the FOS, do you know where I write to for the FSA and OFT. Or should I wait until the FOS investigate ? Thanks Sally
  18. Hi Hellhasnofury. We have just come back from a lovely relaxing holiday and now ready to do battle again. The situation at present is that First Plus have come back with final offers of £2500 for the 2nd loan and £1400 for the first which i sent part settlement offer letters back and they basically told me no chance. I have now reviewed all the documents and the tape they sent me from the SAR and it is apparant that conversations are missing or cut short so I am going to send a non compliance letter. The conversations on the tape show i beleive that we were missold on both PPIs. Should I go back with my non compliance letter and also I wanted to spell out to them what I have found from the tape before I go to the ombudsman / FSA / OFT. Or should I send everything to them at the same time ? Thanks Sally
  19. Hi Hellhasnofury & Bog Just to let you know received a letter from FirstPlus this morning regarding the 2nd loan and my letter re part settlement. It says that they would like to confirm that is is their final response offering the £2500 as a gesture of goodwill, How do I now go about going to FOS FSA & OFT ? I have had my SAR today but we are going away for a week from tomorrow so wont have time to look through it before. Do I just check through what has been sent then send them copies of my complaint and any supporting documentation ? Should I copy FirstPlus what I send ? Thanks Sally
  20. Hi Hellhasnofury I have sent letters rejecting their offers saying I will accept the amounts offered as part settlement. Havent heard anything yet but generally would they pay out what they have offered first and then let me carry on to the ombudsman for the rest or is it likely that they would withdraw their first offer totally as I have rejected it as full and final settlement ?   21. Hi Hellhasnofury. I have received another letter today from FirstPlus, this time in respect of the 1st loan. Exactly the same vein as with the 2nd loan. They are offering me an enhanced rebate of £1404.47 and apparantly they say they gave me a £1078.81 rebate when the first loan was amalgamated into the 2nd loan. Although I still havent received the SAR but they have now cashed my cheque so it should be forthcoming. I am going to go back again and send a rejection letter but accepting this amount as part settlement. Can you help me with how to use the spreadsheet to work out the contractual interest. Is contractual interest 8% ? and what columns in the advance spreadsheet do i use ? You kindly worked out for me that I should ask for back the PPI of £3673.50 plus £2815.28 interest = £6488.78 less their rebate which equals £5409.97. What figures do I enter into the spreadsheet, and is it the date that payments were made, ie each monthly payment and then the final settlement figure ? I am stuck. Thanks Sally

I sent this amended letter today with no specific figures entered because as you pointed out, without knowing what the rebate was on the 1st loan and what the monthly interest rate was on the 2nd loan it is impossible to come up with reasonably accurate figures. I will now wait to see their response and if the action the SAR. Thanks so much for all your help so far. Sally. :grin: Response to settlement offer. Thank you for your letter dated 31st March 2008 We respectfully decline your offer as Full and Final settlement and request, once again, that you return to us a full refund of the policy and all interest made on these payments, minus the £1219.72 rebate that was included in the settlement figure of the loan. Also as we believe we have been deprived of our money we also expect 8% statutory interest, the amount a court would award, to be added to each payment. If you agree we would consider the matter closed. We will accept the sum offered of £2500.43 only as part settlement and on the clear understanding that we will pursue recovery of the remainder, with a County Court claim if necessary. Would you please comply with your obligations under the Data Protection Act 1998 and provide the information as requested in our letter dated 25th March 2008. For the avoidance of doubt, we wish to stress that we do not accept your offer under the terms stated in your letter. I trust this clarifies our position. If we have not heard from you within 14 days to say if you can offer a full rebate of all premiums paid and interest made on these payments, we shall be taking our complaint to the Financial Ombudsman.
  23. Bog. On the figures you calculated will you also be asking for 8% statutory interest on top ? or just the interest rate charged by First Plus. I notice a lot of the standard template letters say to claim it because you beleive you have been deprived of your money and that is what a court would award. But is that in addition to the interest already charged ? Is it better just to try to claim back what you have lost originally ? Or do you think we should add on this at the beginning and then see what they offer ? Sally
