  1. Hi Firstly as Alan said you need to start a new thread as you are still using mine. No i didnt make any claims and this 22% is just a standard amount they think they are entitiled to keep for admin. I got all my money back going via the Ombudsman, over £11,000. KaneCole
  2. Hi All Just a very general enquiry at the moment. If you are declared Bankrupt and are already in private rented accommodation then your existing Landlord serves notice for whatever reason, is it going to be difficult to rent another property with the credit checks ? Even if you had always kept up your previous rent payments and your previous landord would confirm this? Thanks Sally
  3. Hi I hope there is someone on this site who can help me. Have used the PPI section a few times but hope this is the right place for this type of query. We had an overdraft with Intelligent Finance and when we moved our mortgage the overdraft remained but there was no activity on the account at all because all regular payments were moved to our new bank account. Because I failed to make regular payments to pay off the overdraft IF called in their Debt Collectors Blair, Oliver and Scott. I then made regular payments to these collectors from March 2009 and on the 13th Novermber 2009 received a letter saying that our arrangement to make regular payments had come to an end and they took the final payment on the 13th November. Then on the 18th November 2009 we received another letter from them saying exactly the following "Please be advised that your account has now been paid in full and will be passed for closure, any Standing order mandate that has been set up in favour of this account should now be cancelled. We have arranged for the credit Reference Agencies to be updated accordingly" And that was the last I heard from them, then out of the blue this week i received a letter from the same debt collectors which was received on the 25th Jan saying this was a Notice of Intended Court Action and we still owe an outstanding amount of £236.43 that had to be paid by the 26th Jan (the next day !!). This is the first we have heard anything from them since the letter in November when we were told we had paid in full. We have telephoned the debt collectors and they say that Intelligent Finance have advised them that this amount is outstanding with no explanation or any advice as to why it has taken 2 months to tell us. Intelligent Finance just say we owe it and cannot explain why the Debt Collectors advised us we had paid in full. Can anyone advise me if i can refuse to pay this because we have letters advising us that we have made the final payment and the account has been paid in full. Thankyou Sally
  4. Hi All. Sorry dont know if this is the right forum to post but if anyone can help me would be greatly appreciated. We have just come back from a short break in Wales and stayed in a Hotel where our room was extremely damp with visible mold on the walls. I know I should have complained at the time but because they were the only rooms left when we booked I didnt think there was any point and didnt want to disappoint the children. When we arrived the windows were wide open and there was a number of air freshners so the smell wasnt as obvious as it was when we went out for the day and the room was sealed. The smell the first night was so bad i couldnt sleep for the taste in my throat. Also our 3 year old son was on a air bed on the floor which felt really cold and damp. Can i complain about it now ?   5. Hi All. Just to let you know we received our cheques this week refunding all our money and putting us back in the position as if we had taken out the loans but without the PPI plus interest. First Plus took 7 weeks to do this after agreeing but with a push from the FOS we got them. Another victory. Thanks to all of you for all your help. KaneCole
  6. HI Varda. Have you had your money from firstplus yet ? We also managed to get them to agree to give ours back on the same terms as you and was trying to get a feel for how long they are taking to return the money. Kanecole
  7. Hi. Quick update. The fos have replied to advise me that although firstplus disagrees with their findings it is going to make us an offer in line with the fos findings and refund the ppi plus interest and the contractual 8%. Apparantly they are making as an offer of goodwill etc ... They would not agree to pay the £250 compensation for distress and after checking with the fos, it would take about 6 to 9 months for the ombudsman to look at our claim we have decided to accept the offer without the compensation which will put us back in the position had we not taken either policy. It has taken a long time but at least we will get all our money back. Kanecole.
  8. Thanks Alanalana. I was just concerned that i didnt know what I should be claiming. Do you know with regard to the interest that I will get back the interest charged for the PPI plus contractual interest on top ? Or will it just be the interest charged ? Thanks Kanecole .
  9. Hi. Still waiting to hear from the FOS as to whether firstplus will raise any arguments, but was hoping while i am waiting if anyone can help me calculate what exactly I am owed. Have tried to use the spreadsheets but am struggling. The figures are as follows ;_ Loan details as follows :- 1st loan taken out 1st April 2005 Loan Amount £15000 PPI £3673.50 Total Loan £18673.50 Monthly interest rate 0.639% Apr 7.9% number of monthly repayments 120 Monthly payment £223.30 Made 8 payments of this totalling £1786.40 up to Dec 2005 2nd loan to increase borrowing taken out Dec 2005 Loan Amount £28500 (This shows first loan included at £16761.62) PPI £6979.65 Total Loan £35479.65 Apr 7.9% number of monthly repayments 120 Monthly payment £340.80 for cash loan £ 83.47 for PPI Total £424.27 Paid 4 payments of £424.27 totalling £1697.08 then had to increase term to 25years as could not afford it so monthly payment changed to £261.23 at same Aor of 7.9%. Made 8 monthly payments at this amount totalling £2089.84. Then in Jan 07 interest rate changed to 8.4% making monthly payment £271.76, made 2 payments at this amount then rate went up again to 8.7% making monthly amount £278.07. Again made 2 payments at this amount then rate went up again to 9.2% changing it to £288.34. Made two payments at this amount and then paid off the loan in Aug 2007 by remortgaging, the settlement figure was £33758.26. This is shown as Total amount payable under agreement £85523.23 Less our rebate on early settlement £51914.97 Plus admin charge £150 Total amount to settle £33758.26 PS. apparently they gave me a rebate of insurance of £1219.72 in the settlement figure of the 2nd loan for settling early If anyone can help it would be greatly appreciated. Just a quick update to let you know I heard from the FOS today and after reviewing my complaints for both loans and PPIs they are upholding my complaint (has taken a year but worth the wait). They are now writing to first plus to let them put up any arguments against their decision and are giving them 2 weeks to respond. will let you know the outcome. Kanecole.
  11. Yes i also had this resonse. Mine has been with the FOS since last May 08. I received an email last week and an adjudicator is now dealing with mine and reviewing all paperwork etc and will let me know the outcome in 2 to 3 weeks.   12. Hello All. Its been a long time since I posted as still waiting for something (anything really) from the FOS. I sent my forms etc to them last May 2008 and still waiting. Has anyone else had to wait this long ? Last time I heard from them was November saying they were still waiting to allocate my claim to a team and an adjudicator. Thanks KaneCole
  13. I know its a joke. Im worrying myself silly and they havent done a thing. Should I sit and wait to hear or should i now go to the information commissioners office about the missing call recording ? Is there anything I can do because the claim form wasnt acted upon ? Is there any time limitations ? KC
  14. Hi Car and HHNF Spoke to a man at the court today and he has advised me that nothing was done when I sent my part admission in August. He doesnt know why but they never carried out any action whatsoever. He says he is now going to send my part admission to Sygma to see how they want to proceed. I asked him if Sygma had chased them at all to get this thing moving so they can get their money and he said no which is why it seems to have been forgotten. He advised maybe I should seek legal advice from a solicitor about the PPI. What should I do next ? Why arent Sygma chasing their money ? KaneCole.
  15. Car, The agreement is signed by me. The credit limit is on the bottom and there is reference to the vact that it is reviewed. It says Monthly payments of £5 or 3% of outstanding balance from time to time, whichever is greater payable within 20 days of statement date. There is a table of interest rates. I completed part admission form N9A where I admitted to owing the amount stated minus the PPI and on this form you also enter your employment, income, expenses etc and I put in an offer of paying back £100 per month. I also completed from N9B which is the defence and counterclaim form where I just put as a defence that the PPI had increased the amount owed so I couldnt afford to pay it and that the PPI was in dispute etc.. and sent copies of all correspondence relating to the PPI issue. Because I have heard nothing from the Court about the money order you mention, should I call them. I am in a bit of a panic now, what sort or enforcement action would they be taking ? What should my next course of action be ? Thanks for all your help. Starting to lose sleep over this now. KC
  16. Hi. I am totally confused now and unfortunaltely I dont have a scanner so am unable to put copies of the documents up. The court form was for Cerkenwell & Shoreditch Count Court. The Claimant was Sygma Bank UK and I am shown as defendant. Brief details of claim say "claim for money due and owing, Value £3963.73.. Particulars of claim. 1. Under the terms of a credit card agreement between the claimant and defendant. the claimant made credit available to the defendant, and which the defendant was obliged to repay to the claimant together with interest calculated monthly. 2. The defendant failed to maintain the payments in accordance with the agreement and so on 9 April 2008 the claimant send the defendant a default notice pursuant to the consumer credit act 1974. 3. The defendant failed to comply with the notice and the claimant terminated the agreement on 22 July 2008 resulting in the full balance becoming payable. Full balance due £3713.73 pre- issue legal costs £250 4.The claimant also claims interest pursuant to the agreeement at the rate of 19.9% from the date of termination until the date of payment. I then completed the infomation about my incoming and outgoing monies and completed and signed the part admission. Form N9A and form N9B. I didnt know I could not admit the debt. I came back from holiday to this form and had about 2 days to complete it so in a panic I did. I admitted to what I had borrowed on the card minus the PPI which is about £1200. The copy of the agreement I have is really hard to read so even if I could scan it I dont think you would be able to read it. What part are you interested in ? I dont know if it is enforceable.   17. Hi HHNF I competed the form as a "part admission". I said that I agreed I owed the money i had spent on the card minus the payment protection insurance and any interest relevant to that. I completed a form showing all my expenditure etc.. and said i was able to pay £100 per month as a proposed payment plan. I have no idea what is happening now. Sygmas solcitors tell me they are waiting for Sygma to advise them with regard to the insurance complaint and because they keep say they are awaiting a copy of the call recording it is going no where. Would it take 4 months to locate a call recording ? Is there a standard letter that i need to send to the information commissioners office because they havent provided this info ? Thanks Kanecole
  18. Hi Hellhasnofury. I couldnt afford to pay it and with the PPI added situation just got worse. Last payment was made in March and then in July I had a letter from a solicitors which was a termination notice saying that court proceedings will now be issued for recovery . I then completed a full statement of my affairs to their solicitors with an offer of a payment plan of £100 per month and sent an cheque for this amount which was cashed and then got a claim form from the court. I have called their solicitors today and they advise me that they are waiting for Sygma Bank to sort out the insurance issue before they can proceed. So should I write to the information commissioners office as they havent provided any info and copy Sygma the letter ? Or do i not let them know ?
  19. Hi Hellhasnofury. I wonder if you could help me with this one again. Sygma Bank are still delaying this one. Since my SAR on the 27th August they have still not provided me with anything other than copies of my monthly statements in respect of this credit card. I have wrote to them saying that they have not complied by law under the data protection act but all i keep getting is their apology and say they are still awaiting a copy of the call recording where i was sold the insurance. (i have had 4 letters dated 7th Aug, 21st Aug, 18th Sep and 17th Nov saying this) Whats my next step ? I havent paid anything on this card since about April and am waiting for their solictor to come up with a payment plan or take me to court as I had to fill out a Court Claim form back at the beginning of August but i havent heard anything yet.   20. Hi All Just to update you. I spoke with the FOS this week and they advised me that although they are now looking at FirstPlus as a whole, individual claims will also still be investigated. They have been completely inundated with PPI claims which is why it is taking so long (if you look at their website they had something in the region of 1600 claims last year but it is now already up to nearly 11000 this year).   21. Hi All. We have received a letter from the FOS stating that they have still not allocated adjudicator beacuse of the large number of PPI complaints and will be in touch again within 2 months to update us on progress. This has now been with them since may and because we had to remortgage for a much higher amount last year as a result of this PPI complaing we are are now into an arrears situaition with our mortgage. It says in the FOS letter that if we are experiencing exceptional financial hardship because of cirumstances connected to our complaint we should tell them, We are only about £1500 in arrears and are slowly paying it back but should we tell FOS this and is it likely to push our complaint up the line ? Any advice from anyone who has a similar experience would be greatly appreciated. Still fighting Kanecole
  22. Hi RFC HHNF is right. These two PPI compaints with FirstPlus were sent to the Ombudsman in May 08 and there has been no further developments. I have received 2 letters from the FOS to say sorry but they are so snowed under with PPI complaints that it hasnt even been allocated an adjudicator yet. Telephoned them last week to get an update and was told they have now been allocated to a team but no adjudicator is still available and not likely to be for a least another couple of months. Just have to sit it out and wait. KaneCole
