  1. I fell behind with payments. I then decided to CCA them, i was not paying them anything while i was awaiting there response. When they decided the debt was unenforceable they stated they would not be requesting further payment for my account. I have however received a default notice from them, which in relation to the unenforceable agreement is not allowed, so i will be requesting they remove this default when i get the chance.

     

    I would defo CCA Additions ASAP!

     

    Anyone got a CCA request letter template link for tryintogetby???

  2. we have extractors in bathroom and kitchen. The landlords house has centreal heating, we have a radiator in bedroom, which is only on when they have the heating on for themselves.

     

    We have a extra electric fire in lounge.

     

    The landlord says they have done everything and spent alot of money. The response is generally well move out if you arent happy.

     

    Which we will do next year when we can afford to.

  3. Yes cccs would not mind, payplan were fine with me. You are entitled to make this request.

     

    Starting with who you owe least to may be a good way to start, entirely up to you.

     

    I knew Great universal did not have an agreement for me as i applied for catalogue online and they sent me the catalogue with a spending limit and asked me to return my signed credit agreement, i didn't it's still in my diary.

     

    Search credit agreements on here you will find letter templates in the templates section i think its under section N. The creditors have a certain amount of time to respond to your request if they do not or cannot provide you with this document then the debt becomes unenforceable.

  4. Have you attempted to apply for a credit card? Even if its one to rebuild your credit history. Capital one do one, as do aqua and vanquis. They do generally tend to come with a higher interest rate than your usual credit cards. Maybe if you use this a little and pay bills etc on time your credit would increase.

     

    It is so silly and makes you think whats the point. Sometimes someone with no credit history is as bad for creditors as someone with default notices left right and centre.

     

    Regarding the phone, in the mean time have you looked around at some of the payasyougo type deals that are around? O2 do a month by month type contract, and a lot of them do various unlimited bundles.

    Asda does a great payasyougo package 4p calls, 8 p texts, (i ordered the sim card it cost 50p) and you can top up by as little as £5 to get those costs.

  5. I know what you mean about CCA'ing your creditors, i am in a similar situation, i have various creditors, i'm on a dmp and the majority of them are happy. However i have slowly started to CCA them, one was with Great Universal who have cleared the £800 i owe due to not having an enforceable agreement, the next was a silly samedaycash loan for £150 i took out which was transfered to a DCA called Credit Resource Solutions, now owing £300+, once i told them the debt was in dispute with the original company regarding my credit agreement, all went quiet, no texts etc.

     

    So i suppose what i am saying is go for it, maybe just do one at a time, so if for some reason they did get funny (even though they really have no reason to this is a legal obligation they have to carry out) you will be able to deal with it far easier. Can be pretty time consuming if you are working and having to write to separate creditors. Just take your time and try not to worry!

     

    In relation to your business account, i'm not sure, so i will leave that for someone who perhaps knows a little more......

  6. Ok, do you know where your ex has gone?

     

    As the debt is joint he is responsible for the debt too. If you have an address give this to the creditors.

     

    Do not ignore the problem, i know too well how easy it is to do this.

     

    I would suggest you call an organisation such as Payplan (i have a debt management plan with them, and they are great), 08009177823.

    Tell them everything, they will help you with the best cause of action.

     

    Perhaps think about requesting your original credit agreements with each creditor, forward £1 to each. They have X amount of time to respond to your request. If they don't or cannot locate your original agreement the debt in unenforceable. There is advice on here and letter templates available.

     

    Also do some research on the forums on here, so much advice.

  7. We live in part of a converted garage, which is then extended.

     

    The damp is worst it bedroom (the garage part), however it is also damp in bathroom, kitchen and occassionally in the lounge.

    The bathroom tiles are always wet, moisture drips down.

     

    There are no chimneys, the property is not that old, i'd says 80's/90's? It looks modern.

     

    We are on one floor, ground.

     

    We moved in begin of April this year, we pay rent via cash (we get a receipt), the ad was in a shop window, we have not paid a deposit.

     

    when we moved in they just said they do not provide a contract, as long as we pay our rent and we all get on everything is fine.

  8. mM partner has a halifax current account, he went over his overdraft by £1.00 and now the bank have added nearly £100 in further charges and issued a default notice.

     

    He has told them he cannot pay this amount at the moment.

     

    What is the latest on bank charges? I know everything has been on hold.

    He is going to threaten to take them to court if they continue to add these ridiculous charges. He intends to pay what he owes but not these fees.

     

    Any advice and thoughts on halifax would be great, thank you.:D

    I do not have a written tenancy contract. What rights do i have as a tennant?

     

    Also can you advise what happens in relation to damp in a property.

    We have told our landlord, who says they have had the place done properly. However something must be a miss as i have to keep wipping damp off the walls. Once it got so bad, we had to wash our clothes from the wardrobe as they were damp and mouldy.

    We use a dehumidifier regularly but this eats our electric! Too cold to have windows open.

     

    Ay suggestions and advice would be good.... but please don't say move out, can't afford to at the moment.:(

    Does anyone have any thoughts on the following:

     

    I have a law degree/secretarial qualifications and experience in various consumer areas.

     

    I have thought about advertising in my local paper and shop as offering free advice and if needed send correspondance to organisations on behalf of individuals. However i would impose a small charge on the letter side etc.

     

    I want to advertise, as a lot of people do not have enough time to chase up issues such as write letters, due to their own life commitments. Obviously i would have to state i am only here as a guide and a stepping stone but cannot guarantee outcomes.

     

    I have thought of this idea via my friends, who i have helped sort out various consumer issues. They have suggessted i advertise my services.

     

    Does anyone have any idea on this and if it's possible how i would go about arranging this?

    I thought i would attach an email address and use an alternative phone number in order to run things through.

     

    All thoughts would be greatly appreciated.....
