1. Will get my father too tomorrow, as it's his account. 2. Yes, they are missing his first initial but have his second. E.g. If he was A B Smith, it says B Smith 3 and 4. Good. 5. On it now. The date given to remedy the breach is 15th February 2007. It is dated the 1st February so I guess that's the day of issue. The amount overdue is £395, it is a missed payment plus charges. I have filed acknowledgement. Others have mentioned embaressed defence. Sorry first time dealing with this stage. Much appreciated on the help

Hope I've got them all below.... No, how do I do that? I did not send CPR 18 request, only the CPR 31.14 request. I do not have the ED ready, the whole thing is beyond me to be honest. 1: Yes, this was sent in February before we'd stopped payments. 2: (a) They have the same date (b) They were sent seperately. © Not that we remember (d) It's from their Recovery Services, thers a serial number above my father's name (which is actually wrong on both letters - they have his first initial missing) 3: 2005 we think We don't have a scanner, I can take a photo of it if someone can edit it from there.

Just want to clarify on dates. Submitted Acknowledgement of Service on the 23rd December. Sent CPR 31.14 Request on the 29th December. So CL Finances two weeks is up on the 12th? (14 days later) Shall I enter defence after that or is that too late?

As blind-as-a-bat said, the acknowledgment was filed on the 23rd December Letter has gone off First Class Recorded today (was the next available posting day). Next move?

Actually the court letter is from CL Finance Ltd, sorry should have made that clearer, but yes no CCA admitted.

This is the paperwork trail we have so far: 02/12/06: Experian report: HSBC - Card Service 26/12/06: HSBC Statement: Balance showing 17/12/07: HSBC Letter: confirming new standing order (no further details) - started DMP 01/02/07: HSBC Letter: Default notice 08/03/07: Payment Services Bureau: confirms 170 payments at £50 a month and 1 payment at £45.25 08/03/07: CCA'd HSBC (letter missing - we have a signed for slip) 28/04/08: CL Finance Letter re. CCA: "We have been in contact with our predecessors, HSBC Bank PLC, who have advised us that this document is unavailable." They returned the £1 cheque 12/01/09: HSBC Letter: "account assigned to CL Finance as of 15th December 2008. The total balance sold was £xxxx, as at the date of sale." 12/01/09: CL Finance Letter: confirms that they have debt and we should continue to pay £50 a month. 20/02/09: CCA'd CL Finance (we have a letter from Post Office confirming postal order was crossed and receipt from Post Office) March 2009: Stopped payments 09/06/09: CL Finance Letter: formal notification we have failed to make payments 06/07/09: Lewis Debt Recovery Final Demand: issued on behalf of CL Finance Ltd 13/07/09: Letter send to Lewis Debt Recovery stating account is in Serious Dispute (certificate of posting) 14/12/09: County Court Claim Form: on behalf of CL Finance Ltd What do we do next?

Thanks Crusher Have had a letter from DG today, with a pitiful offer (less than old Langdale offered). They are still disputing the charges, saying some of them don't exist and they've disappeared from online banking but we have paper statements with them on. Someone isn't playing fair... They've also said: "We are at a loss to understand why you have sought to recover, what appears to be overdraft interest from our client, and in addition 8% interest per annum upon the interest. Please confirm the basis of your claim from our client of what would seem to be overdraft interest applied to your account." Blah blah, interest rates are advertised. So they won't refund it Now what do I reply?

Got a letter from the court Tuesday and the final deadline is today. Problem is my father is away for the weekend, so is it okay to leave it and phone them on Monday to see what has happened?

Well still waiting on my parent's account - deadline is Tuesday. But I got an offer today for my account (nearly two months later) for £66 (originally £78) so I'm going to accept that. The problem is they haven't given any contact details - only a form to fill in so that they will pay it into my account. Thing is, it's closed. Who shall I write to to say, yes but cheque please?
