    Thanks, this bit right... You should state here that you believe the case will last no longer than 1 hour. I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument. However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith. Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation.

    Still waiting... so will start part two General consensus seems to be, time is running out on bank charge reclaiming. I have a total of £805.50 charges from my parent's joint account but there are several sheets missing. But do I have 40 days to wait for the statements? It's six months from 2004, three from 2005 and one from 2006

    Now I'm totally confused, I have the notice of acknowledgment, it is dated the 8th February on the MCOL website. Since then I have had a letter from Colin Langdale which makes no mention of the court process and offers £690. So HSBCrusher said that I have to reply to this as an offer of part settlement - is that right? Then I send the schedule of charges to MCOL and a copy to the solicitors?

    *bump* Wanted to check this fully .... The Claimant has held account xxxxxxxxxx since 2004. From Jun 04 to Dec 06, HSBC has made 11 charges for: Overdraft Fees (when debit balance exceeded specified overdraft limit), plus interest charged on them. These charges represent a penalty and do not accurately reflect the Defendant's administration costs. Further, they are contrary to the Unfair (Contract) Terms Act 1977 s.4 and the Unfair Terms in Consumer Contracts Reg. 1999 para.8 and sch.2(1)(e). Further, they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Claimant claims from the Defendant a sum equivalent to the total amount unlawfully debited from the account, being 690.89. Also claimed is interest under section 69 of the County Courts Act 1984 at 8%APR from date of each charge to date of the claim, total 47.38. Total with interest and court costs is 738.27.
