  1. LOL! I guess I should spread that one round the forum. I still don't quite know how the bar stewards got hold on my mobile number. Prior to this I used to get text messages which I also ignored. I am registered with the UK and US Handango sites. I buy from either depending on the rate when I do conversions to see which site is cheaper. There's usually not a lot in it, but I have to watch my pennies so every little helps. Glad I could be of some help. deedee xx
  2. You are a star. You kept the essential things that I had written in any case . I am amending my N244 as we speak. I will try and submit it, during my lunch break. Do you think I should try and speak to the Court Manager in person too or just stick to the phone? deedee
  3. Hey Jo. Just thought I'd look in. Good luck for tomorrow. I am not looking forward to tomorrow at all, see CapQuest CCJ. Its retaliatory, as they had 4 months to try and enforce the judgement . Oh well - I knew I'd have a fight on my hands. I just hope I've worded my N244 well enough to get a judge on my side. Anyway I hope you have good news tomorrow.   4. Dave have you tried the professional recovery route though? Just because a HDD appears to have no data it doesn't mean that it doesn't. Usually data is recoverable even after a drive is wiped due to its failure, power surge etc. Do you need a recommendation? deedee xx
  5. It depends on what operating system your phone has, I have an SPV M700 which is PDA phone running Window Mobile 5. The utility in question is called Call Block and it only cost me around $10. I bought it from the Amercian website for Handango - Handango - Windows Mobile, Palm OS, BlackBerry and Symbian Smartphone Software Downloads. It allows me to create a blacklist of numbers which is stored on the phone. It gives the option to answer then hang up or to just hang up straight away! I set mine to hang up straight away, so they just got my voicemail each and every time. There is a similar software for phones running Symbian, Blackberry, Palm OS. I was driven to these lengths as my service provider Orange informed me that they couldn't block specific numbers to my phone. Being the geek I am, I knew that there had to be specific software that could deal with this. Depending on the software you purchase, you can go as far as blocking unwanted SMS messages, creating whitelists and blacklists for numbers etc. It's been a revelation for me I can tell you. deedee
  6. Hello Diskmandave. Your thread was one of the first that I read when I was still a newbie. I have just caught up with it today and it has had me ROFPMSL!! Good to hear that you're not leaving, I had a pit in my stomach when I read that particular post. CurlyBen, tomterm8, ODC and rory32 et al have all helped contribute to making this such a great thread too. I'll be keeping a closer eye on my inbox from now on, for post notifications. I too have commenced my battle with Robinson Way/Horwich Farrelly (depends on which hat they feel like wearing), too. I have promised Spiritgirl and Hopeful1 that I will start my own thread on it too which I will do soon. I have received some great gems from them too. Unlike you, I refuse to speak to them by phone. At one point they were calling my mobile 3 times a day, every day. In the end I purchased some inexpensive call blocking software which basically hangs the phone up on them, as soon as it detects their number! The beauty of this is that I now have a comprehensive call log of their stupid phone calls. Anyway, watch out for my post. You can see what I've been up to in my other threads (see my signature) too. Keep at them. I, like you intend to keep sticking to them until they get lost! deedee xx
  7. Hey Spirit. My - hasn't this thread moved along, so has Hopeful's too. I'm yet to start my thread with regards to my battles with the DCAs only because I have been sidetracked with my bank and credit card claims. I've also received some of the same "gems" from Crap One as you have. Did you get the "template" letter of your default notice and statement of default? I did it made me ROFPML! Anyway it's good to see your fighting spirit back. I had a blow yesterday, but I'm feeling better now CapQuest CCJ. I won't leave it so long before I check in again. deedee xx

  9. I wish to apply for a set aside as I did not receive the response pack at the time of application. If I had, I would have submitted a defence against the Claimant as I believe that no agreement exists between the Claimant and myself. I was unaware of the existence of this debt until I received a recent copy of my credit file held with Experian. I then requested a Consumer Credit Agreement from the Claimant on 15 June 2007 under s.77 (1) of the Consumer Credit Act 1974, to enable me to establish the ownership of this debt. I also made this request to assist me with establishing the identity of the original creditor, as I do not believe that this identity belongs to the Claimant. This request has been ignored by the Claimant and has now been in default since 2 July 2007. A copy of my request is attached to this Application. I believe that my name has also been spelt incorrectly on the original judgement as it is the incorrect version that is shown on my credit file. It is my understanding that the Credit Reference Agencies only hold information that is considered to be accurate, as given to them by the reporting creditor. In my case, this information is incorrect. It is my belief that as a result of this, the judgement has been improperly granted. Until ownership of the debt can be established. I respectfully request that the order be granted in order to facilitate this. Once again any comments are appreciated. deedee

  11. Can anyone also advise as to whether the mis-spelling of a name can invalidate a judgement? I remember when studying the Law of Contract a very long time ago, that the names of the parties had to be correctly spelt as this could invalidate the contract. CrapQuest have consistenly presented an incorretly spelt version of my name to both the CRA and the Court. I'm also trying to do my own research into this but would appreciate any answers.

My first name is missing a letter, so am I right in assuming that they have technically not served on the correct person? After re-examining my credit file, my name is spelt incorrectly on the entry showing the judgement, which means that they obtained a judgement against me with the incorrectly spelled version of my name. Any thoughts?
  16. Thank you Laiste. I was in the middle of writing another, more strongly worded CCA request to Capquest. They have been in default of my request since 2/7/2007 and I was awaiting for 28 days to elapse for them to have committed an offence under the Act. I just wanted your opinion on the following 1. Should I complete the AOE? (I am self employed although I have just started a new job for an employer as a PAYE employee) 2. Should I attach my CCA request letter to Capquest including proof of its receipt to my N244? 3. Should I still send the second CCA request to CapQuest so that I have added proof that I have pursued this as far as I can under the circumstances? I have a PDF version of the form so will type directly to it and continue on another sheet of paper if needed. Once again, your help is greatly appreciated. deedee
  17. HEEELLLLPPPP!!!! I've just got home and I have found a Notice Application for Attachement of Earnings order from Cr*pQuest. Should I now apply for the set-aside?!! Laiste told me that I should chase for the CCA but this is more pressing as they require the completed statement of means with in 8 days. The notice is dated 10 July 2007. Please advise. Thank you.
