  1. I am currently trying to reclaim unauthorised overdraft fees from my bank, what happens to my claim? The banks and building societies have been given permission by the Financial Services Authority (FSA) to put your claim and those of thousands of other consumers on ice. In short, you will have to wait for the outcome of the case between the OFT and the banks. If the OFT wins you are likely to get your money back, if they do not you probably won't.
  2. Through the FOS? From what there fact sheet says, if an offer was made/accepted then it still stands.
  3. I was in the same position as you. I called them this morning to see if my claim was frozen and they said they had written to me 2-3 days ago with an offer from Lloyds. So give them a call as you might be lucky and have an offer on the way, if not you'll unfortunately have to wait.

But the banks have been given permission from the FOS to freeze ALL complaints about charges until the test case is over, but they need to keep us informed along the way. If you've had an offer that should still stand but apart from that its going to get frozen. Luckily i've just had a full offer from Lloyds via the FOS about 2-3 days ago, so would appear i'm one lucky SOB. MadMaxCTR
  6. If the case is litigated, i.e goes to court then you can claim 8% interest from the date the individual charges were applied. Pre-litigation you aren't entitled to claim any interest.   7. How lucky am i. Heard about the OFT test case and that the FOS had stopped all there complaints on bank charges. Anyway just called the FOS to talk it through and amazingly Lloyds have offered to pay my claim in full and this was sent to me on the 25/07/07. The FOS state the offer will still stand despite the test case so looks like i've just received my offer just in time as otherwise i would have had the case frozen until the test case was finished which will be months. One happy MadMax ;-)

  17. Just noticed that CapOne have offered £112 (14 X £8) but on the acceptance sheet that they want me to sign it’s for £122, hehehe. Anyway I’ve sent the CAG partial rejection letter and requested the payment on an INTERIM basis and signed the form after I crossed out the full and final settlement spiel. Just curious. Does CapOne normally increase their offer after I threatening court action, or do you have to litigate to get full settlement????? MadMaxCTR
  18. Got a low offer of £112 yesterday. Thats the difference between the original £20 charge and the OFT's £12.

  20. Muggyno1 - thats reassuring to know you got your claim settled in full with interest through the FOS, espcially as it was in the £9K region :o. Titch - you should get the normal GOGW will offer from Lloyds. Take it as an interim them comaplin to the FOS (as you've got nothing to lose) and then if need be, go through the courts, buit you shouldn't need to.
  21. No i haven't issued proceedings via MCOL, i was planning to do it possibly this weekend. But i'll hold fire now as i probably won't have to. Yeah i know you can't do both at the same time and the FOS won't help if you've issued and failed. I made the complaint to the FOS after i had the £750 GOGW as Lloyds said they won't improve on the offer unless i go through the courts or FOS. We haven't got anything to lose with the FOS as you can still file a claim if the FOS aren't able to help. No, the £750 is still in the bank, well some of it. That was a few weeks ago now so there's no chance they'll want it back.

It does not appear to have made an offer that fully meets what you have asked for. I have therefore written to the bank to invite it to: make an offer which meets (your) claim in full; or provide me with the information I believe I shall need to reach a conclusion on the merits of (your) claim. "As you may know, in almost all the charges complaints we have considered, banks have made offers to meet the claim ... I will let you know as soon as Lloyds TSB Bank Plc tells me whether it is prepared to settle (your) claim ..." Made the complaint to them only about 2 weeks ago so seems to be moving quickly.   24. Ditto. Sticky1Nicky, Now send your letter before action to Lloyds and you should get a gesture of good will, normally for £750 if your claim is over £1K.
