Got a letter on may 25th saying they are settling whole amount and would I inform court of this - I sent back a letter saying yes when I receive the cheque I will do this- today for some unknown reason I look at my mcol claims and i see this: ( wasnt there yesterday) Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. Have they made a mistake? I have the letter saying I will receive the cheque for the full amount within 14 days from last weeke? any ideas? surely they cant change their mind?

  3. Im in the process of sending in a wasted costs order - but I need a bit of help. I have my letter and my spreadsheet of costs,but im confused over the 'draft order' - not sure what to do with that and the list of settled cases for capital one - whereby they have settled before going into court - I can see the list on the litigation site of settled cases but how do I know whether or not they were all settled out of court? can someone give me little help with these two please:confused: what do i do with the draft order and which list do i print off , of the cases settled out of court. thank you.:)Also - what would I charge for an hourly rate for work done in my own time - the minimum wage? ( hourly rate) or is that too steep?
  4. I agree - you proabaly would get offered the full amount plus interest from capital one about 3 weeks after submitting to mcol. They say 'this is a final offer' 2-3 times before paying up.

I sent a letter off to capital one and £1 and asked for a copy of my credit card agreement as i didnt remember signing for PPI ,have paid PPI for about 5 years up to 2005 - then it stopped ,according to my 6 years of statements I recently received. (I paid credit card off in January this year.) I received this letter today: Thank you for writing to us about the payment protection insurance (ppi) we've added to your account.I understand you have no knowledge of signing any document about the insurance.I'm sorry for any upset caused and i'd like to explain. Ive checked your account and our records show that we offered the policy during a phone call in march 2001.Whenever we offer PPI, we always explain the criteria for having it .We also ask the customer to confirm they want it before we add it to the account. Because this was a verbal agreement you wouldnt have signed any documents . I'm afraid we no longer have a recording of your call because its from six years ago.To explain,we sent you documents detailing the policy,which confirmed you had 30 days to cancel if you werent happy.Because we didnt hear from you,the policy continued. Since we added the PPI to your account ,we sent you 51 statements.On your statement we told you how much PPI we were adding that month.Because you havent questioned these premiums before I'm afraid I wont be refunding any of them .I also wont be refunding any interest because we've added that correctly aswell. I hope I've explained things clearly.However,If you have any further questions,please write back to me within four weeks.My address is in the leaflet I've included,which also explains our complaints procedure.If I don't hear from you,I'll consider that your'e happy with my response and that your complaint is closed.   7. dead right! - without this site and a few others I would be non e the wiser infact I would have carried on thinking it was my fault i was behind with payments and the charges were lawful! - and youre right - once you start looking into things - youre worth a small fortune!! - I wouldnt have thought about people like'studio card's - I had paid them off months ago buit after seeing on here that you can claim administration charges from catalogues etc - I asked for my statements and it turns out theyve taken nearly £400.00 off me in admin charges and another £200.00 in PPI charges - so Im trying to get that back aswell. The moral seems to be - dont get disheartened - what have you to lose? go for it!

  9. Not sure who said it - but someone said Capital One seem to be sending letters out offering the full amount 21 days after the date it is put into court - this is also what happened to me so I think this is how they are doing it.
  10. Letter from capital one today - cheque will be in post in next 14 days!! now to concentrate on CITI-CARDS - feeling more confident now - so Bring it on !!!!!
  11. OK - Ive won!!!! I kept reading about others winning and was starting to think I would be the one who ended up going to court but this morning got 2 letters - first one said final offer was £440 - no way would they offer any more it was FINAL - also enclosed was ana cceptance form . 2nd letter I opened say they are correct in applying their charges - blah blah.... but as a goodwill gesture they were going to refund the total amount asked for - £1622.66p! They say I need to write and inform court that they are paying up and to stop the case going any further hmn...... think I'll wait until I have the check in my little mitts first . not that I dont trust them.......

Accounts become dormant when banks have reason to believe the accountholder address they hold is no longer current - perhaps because they have had returned post or there has been no activity on the account. 4.html However, dormancy does not mean accountholders - or their beneficiaries - lose their rights to the funds in those accounts. Rendering accounts dormant is part of the banks' move to prevent fraud and money laundering. And it basically states that, after 15 years of non-contact, where it seems unlikely the bank and customer will re-establish contact, any funds in the account should be re-allocated to some form of social fund for community projects. Even then, the banks are required to retain a proportion of these funds, in perpetuity, in case the legal accountholder or their heir seeks to reclaim those funds - because the customer's right to those funds remains protected. In order to trace your late father's account, complete the dormant account form on the British Bankers' Association website. Even if you are unsure of all the details of your father's account, the BBA should be able to help. ................ Now I'm off to draight a letter to capital one................

Sorry the reply ABOVE was in response to the letter below - (Since sending this letter I have also applied for a copy of my credit agreement - still waiting for a reply to that one.) - sorry got a bit mixed up there! On checking my 6 years of default charges on my statement, I notice that over the period 03/01 – 04/05 I have been charged £xxx.xx in -Payment Protection fees .These payments ceased after that date. I would like these charges explained please – I have no knowledge of signing any document regarding payment protection . I am therefore requesting ANY documented information regarding this agreement that I presume you will say I had agreed to pay, in the form of paperwork, filed claim form, or verbatim transcript or recording of any conversation regarding this application in line with the data protection act. I have no recollection what so ever of applying for payment protection therefore if you cannot provide any proof then I request my money back - £xxx.00 p , I also wish to claim interest of £xxx.00p making a total of £xxx.00p.This being the amount I require as a refund if proof that I consented to these charges being taken, cannot be found. I request that you reply to me with either the proof or a cheque within 7 days otherwise I will be taking the matter through the courts yours.........

Oh yes I have all the 6 years statements - Im already claiming over£1600.00p back in charges, and I have added up all the ppi payments it comes to nearly £500.00 - with interest its over £600.00. It was the fact that they say its over 6 years that worried me - should they still be able to prove it? any advice on this would be very much appreciated - never claimed ppi back before.

  23. Are these people for real??:o I cleared my CITI-CARDS account February2007. For some strange reason my account appeared to be £1.24p in credit on my May statement so I rang and asked them whyt he account was still open after I had paid it off. They said they cant close it whilst it is in credit so they said they would send me a cheque and close it. They did this last week. I also asked them last week about PPI charges on my account over the last 6 years as I couldnt remember signing anything for them. Today i came in from work to this letter: Further to your requestI am writing to confirm that your cardholder repayment protection insurance has now been cancelled - with immeditate effect. ( now heres the really funny part....) Please note a final charge will be applied to your account to pay for the cover you have received since your last statement. ( on a closed account?) After this charge , no further premiums will be taken ( gee thats real nice of you:) ) ................. So let me get this straight...... I pay the card off in early February, the balancie is nil. I ask them to close the account, they dont but they credit it £1.24p. Then when I ask again to close it they send me a cheque for the £1.24p then when I ask about previous PPI charges over the last few years ( even though there is non taken between february and may) they suddenly tell me they will applay a final charge and cancel the policy:o anyone understand this?
