  1. Forgot to add - As HSBC have now closed my account (Like I care!!), I cannot now access my account online, therefore cannot send any e-messages or get an accurate balance. Is it worthwhile to write another snot-a-gram expressing my unhappiness about the way things have been handled by them? And can I still complain to the FO about their behaviour after the court proceedings are done? Only asking as I always thought you COULD complain and was told as much by one of the people in the FOS. But have called again to be told they can't help me even after the court case, as I've gone 'Over their heads' and straight to court. Has anyone else done this, and how did it pan out?? TIA
  2. OK - Have now written to Metropolitan setting out the facts and sent the letter via Recorded Delivery, which I know they have received. At the same time, I've sent my first nudge to DG, asking that they consider my claim in full as I could not reasonably know all the facts before. In any case, all the entries WERE within the six year limit when I started. Still haven't heard anything from the court, so will leave it another week before I call again. Even though the debt is now with MCA, does that mean a default has been recorded against me? I have not actually received a notice, just a final demand... Any help or advice welcome -TIA

  5. Hi I live in a small street where there is permit parking for residents as well as meters. After 5pm, it's a bit of a bunfight to get parking as that's when the meters stop running, so lots of people then pile in to park for free. I returned from visiting friends last night. The usual story - can't find anywhere to park, legal or otherwise. So I had no alternative but to park on the double yellow lines with the intention of getting up early to move the car into a bay before the traffic warden came along. But I was too late -as I walked round the corner at 7.45am, I saw the warden looking a bit shifty. When I looked at my car, the ticket was already on!! So I asked the guy what the hell he was doing. He muttered 'You were on a double yellow line' and took off irunning in his van before I could comment. But I think the ticket is unreasonable given the above. Is there any way I can appeal this? Any help or advice would be welcome! TIA

  7. I would definitely add my vote. But only if she's happy to take it on, and won't feel pressured. She's helped me with advice from time to time and it's always good. It's thanks to people like her, we're empowered to take on the banks and financial institutions with confidence. I hope to be able to do the same.
  8. I too have been having trouble with the Funding Corpn. In a nutshell, I have a complaint outstanding with the Financial Ombudsman relating to late payment charges which I am refusing to pay as I believe they are unlawful. Anyway - Funding Corpn were harassing me via my home phone, mobile and text, plus sending me letters up to three times a day, despite my calling and writing to them via recorded delivery saying the matter was now with the Financial Ombudsman. After the last raft of letters last week, I called the FO again to complain. I was told they could do nothing about the harassment, but to seek legal advice which I did. As a result of the legal advice, I dropped into the local nick on my way back from the law centre armed with the paperwork from my complaint, and made a complaint of harassment against FC. Guess what? No more calls or texts, although I did get a nice letter from them today saying I had no grounds to complain to the Financial Ombudsman, as my complaint wasn't related to insurance and they fely quite sure the FO would agree with them. Funny that....
  9. Thanks Latty - will check out the FO's website as well. But thinking back, I'm sure they CAN investigate the bank's behaviour even after the court case is concluded. Remember Kevin (Lloyds)? And I'm sure they told me the same thing when my card was taken. I'll look back in the thread, and check my notes. Meanwhile - will write to Metropolitan setting out my position, so they have all the facts.
  10. Hi Lat - thanks for the response . Yes - I did know from reading previous posts that Metropolitan & DG are all subsidiaries of HSBC!! Spoke to HSBC this morning, and asked to speak to a manager whose name I have a record of. It's like speaking to a robot.... I explained that this should never have gone to Metropolitan, as the account was in dispute (i.e. is now in the court system, for the refund of charges). I told her I thought it would have been sensible to wait for the outcome of the court proceedings before taking further action. But then she got very stressy and said she did not choose to discuss the matter further. Honestly - it was like talking to a brick wall!! :evil: So I then called the Financial Ombudsman (They must be SO sick of me - I already have a complaint in hand with them!!). And I have been told now the matter's gone to court, even after the conclusion of proceedings, they cannot help! I know what I've read from Latty, and FO's office told me previously they would deal with the matter of the card as it could be viewed as retaliation. Now I am confused - What would be the best course of action now?:? HELP!!! TIA
  11. Now I really am ******* steaming mad:mad::mad:. Got a nice little letter yesterday from Metropolitan, saying the overdraft has been passed to them. In other words, I now have a default against me -GRRRRR. Had a nice talk to the lady on the phone, and told her in no uncertain terms that the matter had now gone to court, and HSBC were fully aware of this, as I had written to them on the 7th July via recorded delivery declining the ex-gratia offer as it had now gone to court. I was then told HSBC never told Metropolitan ANYTHING!! It wasn't even as if I had been ignoring them - quite the opposite! Anyway honey, I says - not my problem. All this will be going into my court bundle.... I'm going to talk to the lovely people at HSBC tomorrow and ask them what the hell they're playing at. Clearly, my letters are having no effect at all. Nobody talks to each other, and this is creating an even bigger mess now -GRRRRRR. Once this is resolved, can I complain to the Financial Ombudsman? They've already advised they will look at the issue of the card once this is over...
  12. Hi - have notice of transfer to my local court. Now need to send a nudge to bank's solicitors DG. How do I work in the fact that the WHOLE of my claim is to be considered? When I started the claim, all entries were within the six year limit. But when the bank made me an ex-gratia offer, they struck out a couple of the entries, as they were 'outside' the six years.... HELP!! TIA

  17. OK - A quick update. Got letter from Northampton this morning transferring the case to Croydon, and apparently dispensing with the AQ. Read the defence, usual the charges are fair, I was aware of them as they were published, etc. I take it this is normal? Anyway - called the court to ask if the fee should still be paid. I've been advised to wait until the paperwork is received from Croydon, then they will advise what's to be done next. Should I start sending the nudges now? And at what point do I stipulate how the money should be paid? TIA

  19. Just came across this forum. I'm in the process of claiming back bank charges. I've already had an offer of £3.5k from HSBC, but they've struck out a couple of the entries as they claim they're over 6 years old. They weren't when I started the claim though! I've written back to decline the offer as it's now in the court system anyway, but have a question: How do I get these entries kept within my original claim? Any help or advice welcome.... TIA
