  2. Thanks guys! Love the pic BTW Pete - Did you draw it yourself? Just read DG's bit. Re: point 10 - couldn't stop the tears of laughter rolling down my cheeks! Think I'll have some of what they're smoking . No way have they kept me or anyone else for that matter informed....Unless of course they've done it by ESP:rolleyes:. I'll use the skeleton argument, but will take out the points regarding further charges. They no longer apply to me as the very nice people at HSBC have now closed my account! Will be raising a further complaint with the FOS, but that's another story... Does anyone have a list of settled cases since the announcement of the OFT case? I'd like to take that along too! TIA
  3. Hey Johnny! How are you? Thanks for the reply. I think I can prove hardship as well as the emigration card, so will use these and hope for the best. At least I won't have to ask that no more charges are applied to the account as HSBC have already closed it! What other arguments/papers should I bring to the hearing? Anyone able to advise or help? TIA
  4. No - the original loan was taken out about 1997!! It went to the original DCA in about late '99 I think....If memory serves, then I think the last payment to that DCA was in May '00, but need to check... Sorry if I wasn't making any sense....

  6. Hi Got a letter from the above people yesterday. It relates to a loan I had from Lloyds about 2000. It went to a DCA based locally (can't remember the name but think I still have the papers), and was paying this off at £50 per month. The DD I had set up with the first DCA suddenly stopped (they didn't take any more payments), and I heard nothing more until yesterday when I get a letter from 1st Credit. They are trying to tell me that they've obtained office entries from the Land Registry and are trying to obtain a CCJ against me and enforce a Final Charging order against my property. If they should succeed, they might consider asking for an 'Order of Sale' so that they can be paid.... Sorry for the long post, but in summary, I've got a few questions: 1. As the original loan was unsecured, can they get a charging order against me? 2. In any case, is this debt now statute-barred as this is over six years old? Any help or advice wold be much appreciated... TIA
  7. Hi guys Thanks for the replies. Haven't heard anything more, but then I've been in Portugal for the past couple of weeks sunning myself . Does anyone know how FL is? Seems he's not too well again..... Meanwhile - my case is due to be heard all being well 17/10. I'm not going to call the court beforehand just in case they have the bright idea of staying the case if I do. I'll just turn up and see...
  8. Just a teeny thought. My prelim hearing's on 17/10. Not too sure what I should bring to the hearing but DG have indicated they'll go for a stay. Wonder if I should print off these stories, bring them to the court, and respectfully 'invite' HSBC to settle? Don't want it to drag on, but am moving abroad next year. Think I'll throw that in the mix too! What do you guys think?

This might be a really stupid question but - What is the significance of adding this to the bundle? Surely as this applies to Australian law, this would not have a bearing here?? Anyone able to help?

  15. Another quick update. Got a letter from DG today, saying they were going to ask for a stay if the matter got to court. I cannot believe it took 2 pages just to tell me that! Is this the point I should submit the draft directions? Sorry - haven't been on much, so am getting a tad confused....

  18. Another little update. Got a nice long letter from the good folks at HSBC on Sat. Went on a bit, but basically said that they believed the charges are fair, and they will apply for a stay if the matter went to court. So that's all right then! I assume this is standard? But - am moving abroad next year. If I draft some directions, would it be OK to say I want the case settled quickly and don't want it stayed for that reason? TIA as always

  20. Hi Frog. Very disappointing news, especially as I got a date for a prelim date this week for 17th Oct in the same court (Croydon). Dropped in another copy of my schedule, asking it be attached to the claim today. I guess it's a case of wait and see....
