  1. i rang today and they couldn,t discuss it cos of system trouble, i will keep trying but i think i best prepare just in case, they did say though they were settling a month before court date,i may not like ther offer though!! thanks tipsy you're gettng good at this!!! PAT

  4. Hi Banksworstnightmare i am not sure about the prelim hearing i am in blackpool and allocation questionaire was dispensed with i just got my date this week 20/07. If you don,t get any better advice i would ring the court asap ask whats gong on and what you will need to bring. court bundle?? i rang barclays today and they told me they were expanding the department in an effort to settle quicker they told me to ring again a month before court date PAT

  7. Hi Chorlton i am considering ringing barclays as you did, their defence has just arrived as case was transfered to my local court from mcol. The difference is that the court has directed that allocation is not necessary unless the judge asks for it. in your opinion should i wait till i get a date to ring or go fo it asap. Good luck with the hangover and congratulations!!

  9. Hi Peeps This is a letter i am sending to Barclays prior to getting a court Date it,s in answer to their defence, if you have any advice as to whether it is valid o.k etc letme know quick!! Prior to court proceedings involving penalty charges applied to the above account i would like to clarify my position also to draw your attention to some innacuracies within your defence. In point 1 of your defence you assert that no account details were provided to you prior to or incorporated in my above mentioned claim. I would repectfully draw your attention to the fact that the account number and name are present in all correspondence of which i have copies and are also present in the particulars of my claim and have been since the claim was first served. After recieving data from you listing all transactions, i returned the data highlighting all charges i deemed to be unfair therefore i have indeed provided you with details of all charges. This was made difficult by the fact that many charges were grouped together furthermore in order that i make a reasonable request i reduced the amount i requested by a sum estimated to reflect the fair charges. The amount i requested was ******** also i reservered the right to request interest at 8% per annum.The total of unfair charges i consider and interest now amounts to *****. This amount will of course change before the court date by the relevant amount of interest. Please be aware that i will not now consider settlement for any less than the full total of charges and interest and all court fees (currently £120) on the itemised schedule i have enclosed. Please note that all other points in your defence statements will be answered during the court process in my evidence and relevant case studies and offcial reports which i am currently preparing. All of this evidence will be provided to you as soon as a court date is arranged. I will be retaining my original statements until the court date but can if you wish provide you with facsimilie copies. Regards
  10. Hi Changeling i am chasing money back from barclays too, a bit further along than you though. The court thing is really easy when you get to that stage you just fill in a couple of forms online. I personally am not worried, the next stage for me is an actual court date but with the help and resources available on this site i will be well perepared, barclays battered me when i was self employed and i am gonna enjoy getting my own back i won,t settle for less than the full amount + interest.   11. Hello people this is my first post i read a lot of yours and thought it only proper that i join in. I have used info from some of you people to take barclays to task over charges to my old business account. I have asked for £**** and around £**** in interest, tomorrow is the last day they have to enter a defence and although nothing yet i have read other posts about barclays and it seems they always go to the wire, so i am resigned to the fact that at the very last minute tomorrow they will register a defence and i will have to wait ages for a court date, a little bit of me still holds a candle of hope that they will overlook my case just long enough for me to enter a default but realisticly i think they enjoy the sport too much to let me win that easy arrogant bankers. The good news is that i don,t care how long it takes cos i thought i,d never see that money again anyway. I do remember though how the minute my business cash flow went bad they took absolute advantage I new at the time the charges were imorral unjustified and unnecessary but i am over the moon to find they were also illegal. I would be interested in hearing forom anybody who has gone beyond six years as i have just asked for that data from two banks and four credit cards.
