Hi all I have now received a court claim from Robinson Way they have sent this application form as the CCA, a statement of account, copy of default and copy notice of assignment. They have asked that I accept liability and withdraw my (holding) defence. Help appreicated as not sure it is a valid CCA or not - also they have not sent copies of the statements just like a monthly breakdown from 1999 to 2007 Thanks

Hi all I am claiming CREDIT CARD charges and this was stayed pending the OFT outcome I tried all ends to say it is not bank charges etc to no avail. YB then send an offer for less than half which I declined and now I have received a letter saying as they have won they will not be paying and if I sign the notice of discontinuance they will not claim charges from me! Help penning a very strong letter please

Thank MB - i do agree it was just in the hearing the guy representing the other side wanted to enforce it there and then and get bailiffs (really nasty piece of work) and I thought if I could cause a bit of upheaval I would. If they judge orders it paid in instalments can they refuse it and enforce it?

Hi all an update on this - managed to get this set aside, hearing was held and Link turned up - Judge tore him apart as his documentation was not satisfactory. Quite an amusing part they had provided several copies of statements where interest/fees were showing but on the T&C's it stated if the payment is late or overlimit a charge of £0 would be applied tut tut - Judge was not happy she gave him two weeks to provide the original agreement and a full statement of account or struck out this was over a month ago - spoke to court for an update and they have not filed any documents with the court. Looks like this is going to be struck out

Hi I attended court last week - in a nutshell I went into a store and purchased a sofa paid a deposit and took the remainder out on interest free credit. The sofa was delivered and then I was told the application for finance had declined and I had to pay the balance in full which I could not do, after much tooing and froing the company agreed I could pay in instalments which I did but then fell on hard times and wrote them a letter saying so and they issued a court claim. The judge ruled in their favour and the otherside refused to accept instalments and wants balance in full or enforcement of the order - judge was not happy with this and asked me to send in a means assessment and a figure would be set on affordability. However, whilst all this was in my name the court claim came in my husbands name - can he apply to have it set aside on this basis - also he came with a copy of the agreement which was declined even though I was informed it would be destroyed? Any thoughts - thanks

I think this is a case of identity theft - too coincidental for it to be same name, date of birth and address - have you contacted the police? I wish you all the luck in the world with this but the truth will out

Hi all I have today received a letter form NCI saying they are going to serve an SD on 23rd Feb @ 3:00 and if I am not in to accept it they will post through letter box or put in daily press. This account is an A&L credit card being in dispute since 2007 - the response to the CCA request was a black photocopy and you can see signature on form but it is illegible a couple of statements and terms and conditions - one thing on the T&C's is that it states £0 will be charged for overlimit and late payments (I think this may be a good thing in my favour) It is inevitable that they will serve this personally so I am trying to prepare everything for the set aside. Any help appreciated as ever

Hi It is Arrow they have sent a process server twice but he has not left anything because hubby said I was out - I sent the request in 2007 and received an illegible agreement completely black could just read the signature, standard T&C's and then it was passed to Arrow so I sent a copy of the letter and advised it was in dispute, they said they would look into it and forwarded the same as I had received previously - I sent them a challenging letter (by recorded delivery in August 2009) heard nothing then got a letter saying I had ignored their letter so they had passed to a process server to delivery stat demand - I then faxed the copy of the letter I sent by recorded delivery stating I had not ignored it (that was Friday) then Tuesday he came and went and he came again last night but again left nothing - so just preempting really Thanks for looking in
