Used Car fault... do i have a case?

Has it passed a MOT with the faulty brakes on the last 3 Months, if so was it MOT'ed at the car supermarket also....you may have a case but it is hard to prove these things -

Tom, I believe Natwest have just settled another big one, BBC NEWS | Business | Couple recover £25,000 from bank £25000 of charges...citing it was uneconimical to continue -
final update on this one, the person got there money back and the Sheriff Officers have since written their apoligies, they have asked her if she can come to some arrangement for payment and the person has made a reasonable offer (i think it is about £20 week) which they have accepted. The person who owes the council tax has been trying to pay the balance and was paying £50.00 a week out of her wages without a single missed payment and the Sheriff Officers still arrested her bank account, so i feel they did a great dis-service to themselves and got what they deserved. I hope this is some help to others out there who find themselves in a similar situation.

Very well put, Shoestring. I dont think i could have said it better, Most Consumer Action Groupies will agree. Monty Python did a lot of comedy but not as much as the "bankers", although i found Eric and his friends a lot funnier.....

Do you think a judge has ever needed to reclaim charges? i dont! it is normally the poorer people that get walloped with charges etc......and usually when they are skint...remember the old saying ROB THE POOR TO FEED THE RICH, it is changing slowly but it will change. Robin Hood tried a long time ago we have just picked up where he left off!

I am dealing with a complex not fit for purpose car, with capital bank, i was trying to deal with it myself but they are being so obstructive it is madness, so i had to employ a solicitor -
can i SAR a garage to get info on a car i bought from them, i need all the info i can get from them, any idea on wording etc would be great

I have a bigger surprise than that, i have instructed my solicitor to start court procedings against them for the return of all my money paid and interest, and i am trying to persuade him to apply for a wasted costs order also for all the time i spent writing letters etc, Capital Bank even had the ignorance to ignore the solicitor letters and will not return his calls, no matter what happens i am going to try and get them to court and then see if i can interest the newspapers....... -

I am also having some difficulty with Capital bank both myself and my solicitor find them difficult an dvery unhelpful, but i have surprise for them soon. -
BTW Lula i still have all the proof and case notes and the solicitor who looked through them told me "it was a open and shut case" no if's but's or maybes he was sure that the judgement should have been easy and the compensation the hard bit.....

I realise i may have said to much, but it appears to a friend who is also a solicitor that something was amiss as i had all the proof and also the witnesses but still i was not able to persuade a judge to pass a judgement against them and he also would not tell me why, which makes me think odd things were going on, of course at that time i did not have the experiance i have now and if that was to happen again i would know what to demand thanks to CAG

Is there really anyone in this country that believes that the british court system is unbiased! Fair! Impartial! I doubt it! Informed people know what goes on up and down the country, i had an example myself when i was in court when the judge reckoned i was not entiteled to a judgement against the company i was claiming against, only some compensation....EDITED JUST IN CASE

If the above is true then would that hold for say a used car bought on HP, if so who would be responsible the garage or the HP company, and if so then we need the written examples to show other people -
I hope Tom at least has a chance of appeal, as i do not think the judge was very informed this time, maybe an appeal judge will be better organised.

TideTurner you are dead right, they have to pay...and they will pay, even after all the strange press in the last few days i would like to see someone put a complaint to the FOS and see what happens, i think the bank will cave in and refund because no matter what the banks NO they are in the wrong they just dont want anyone to prove it.

I urge all claimants to not panic over the BBC story, if you are worried you can complain to the FOS first and see what the bank tells them Financial Ombudsman Service I think you will find it is business as usual, there is no way the banks want the FOS to investigate them so they continue to pay.

Take a look at this, BBC NEWS | Business | Banks 'exploit charges judgement' The banks have a new way to try and stop you claiming your charges back, but dont worry and dont panic, if you are at all worried about claiming then make a formal complaint to the Financial Ombudsman Financial Ombudsman Service And see if the banks tell them the same story, i think you will find that the FOS will recover your money without any trouble from the bank and it is free. Don't listen to all the hype about Kevin's case it has nothing to do with your claim at all, keep up the good work.

I totally agree with bookworm, 14 days minimum, then look at the avenues, Can i ask what you bought? i dont think it matters what you paid in postage, the seller has the responsibilty to provide at the very least signed on delivery if you pay with paypal, Paypal will side with you and return your money at the sellers expense otherwise. -
I am unsure but it seems to me the Goverment have forced us to rely on bank accounts, so if the banks start to charge you could in theory ask any employer to pay you by cash or uncrossed chq that can be cashed, and there is nothing they can do about it. If it is going to cost you money to have an account then you dont need to have one.... The gov will need to think about this carefully, the OFT in particular. If the banks go down thie charging road then then i for one will just move my money out and offer cash only. Burger all they can do about it
