Thanks Brigadier I'm going to write now to the debt collectors for the CCA for both of the debts. Do I write to the claimant or write to the address to send documents to on the claim form? As I have acknowledge service do I have to state a deadline in the letters I write? -

Hello. I never received any letters before action. I had letters saying doorstep collectors would call. I will aknowledge the claim. The overdraft spiraled out of control. Most of the cost is charges. The tmobile account only had a few month left. Forgot all about it until this weekend. -
Need a little help. Yesterday received a county court form regarding a £300 T mobile debt. Today received a county court form regarding a £2000 Halifax debt. forgot all about the Tmobile one as I defaulted with a few months of the contract ending due to losing my job. the Halifax one is for an overdraft. Both debts are at least 3 years old. Not heard anything from them for at least a year. I don't deny the debt, just not in a position to pay them. What do I do now? I'd be happy to settle them over time, but cant afford no more than £40 a month.

Asked for a CCA. Got a letter today saying my account is on hold while they obtain the relevant details. Does this mean the SD is on hold? -

Called them again today, they said if I can pay it in 6 months no action will be taken. Something mad like £300 a month. Still no Barry Davies today. Am I right in saying if I write to them with a monthly repayment offer, they have to accept it? I'm thinking of paying it off within 3 years. On a 5 year plan to repair my credit. -

It all seems really Scary to deal with the courts. I think my time is too short to do anything auto it now. I do want to pay my debts, but not to some team of cowboys who have only bought it for a fraction of the cost! I'm tempted to go down a DMP, but again the debt managers are just as unregulated! -

The letter is dated 28th March, I only got it on Saturday 2nd April. There is no date stamp on the envelope. So that has cut short my 18 days already!! I don't own a house, car, nor have any savings. I don't understand them bankrupting me would be any benefit to them. It would be for me as I could start a clean sheet. -
Making my own thread on this subject. Received over the weekend and SD signed by Barry Davies. £1300 Aqua credit card from around 3 years ago. Now taking the steps to set aside, it's a little confusing so taking my morning to digest the tons of information here on the forums! Any additional advice will be welcome 8)

Hello, I'm in arrears with a payday loan company . They keep calling me at work, it must be every, much to my and my colleges annoyance! I've tell them to contact me in writing only both on the phone and via email. But they still call! I went home ill the other day because of it. Anything I can do to stop this.

I'm about to log on to asked for more time for my defense, however it will not except the password supplied! No payment plan has been offered. I will only admit to the loan, plus intial interest, minus the money the have already taken. As I have had a few weeks off due to flu (making me 2 weeks wages short) , I will ask that to be taken in consideration.

Hello, I have a Court Summons for over £400 from these guys for a £100 loan. It looks like it was filed online through the money claim site. My wages got paid into another bank account, however they still took £50 that was remaining in my old account, with 2 separate debit card transactions. Just to set an example, I will fight this little battle, even if helps to get some government regulation, so any advice would be welcome.

We have a secured loan with Blemain Finace. It's in joint names, however the property is just in my partners name, according to our martgage broker, this should have never gone through? Is this loan enforcable?

I had an Advantage gold account. I was paying some cash in to my bog standard account, then I was pressganged (only word I can describe it!), by the cashier. "You account is eligble for upgrade ", I was told, I was then ushed into a room. A cheque gurantee card, overdraft and a £1000 worth of savings, I was told, just sign here. My cheque guaratee card never arrived, nor did I get an overdraft. In the mean time Halifax gave me an account with all those features. I thought I'd run the account for the amazing discounts I was promissed, however products were cheaper elsewhere. I missed the £12 fee a few times a was charged as well. So after not saving a penny, I went into the bank and said I don't want it no more. The assisant sat me down and said thats fine, you account is now a basic one. As the account was dormant, I've never checked it. I got a letter last week, saying I now owe over £400, as it turns out, although I downgraded, there was a fee for the handful of days, the account was still an Advantage gold! This over the months is now fees over £400! I know I can go down the route of claiming them back, my only question is can it be quciker by making a complaint of beiong mis sold the service?

Hello, I just logged into the money claim site and it doesn't say case closed. However does the letter mean it's over for now? I'll ring the court in the morning and find out.

But surely the courts can't allow them to open and shut cases all the time, this must be classed as a waste of thr courts time. I'll just wait and see what happens. I'll keep you upto date.

All I've done is a CCA request, and I filled out the online form for the extra 14 days to file a defence.
