I have recently fell behind on payments to NDR so I started paying them £1.00 which they have taken but on every occasion they charge me £12 service charge for not paying the correct amount they are a DMC for littlewoods. I asked NDR for my CREDIT AGREEMENT which they sent and as I had signed in in 2007 I have not questioned the debt, I wrote to them offering a token payment as I am struggling at present and sent an expenses sheet and they have issued a notice of default and will now start charging me £12 per month and will not accept the token payment, this is NDR who I gusess is the DMC. What corresspondence can I send back to them to dispute their actions. Thanks Mashmallow:|

Just received a letter from Moorcroft chasing the debt passed on from Argos. They have not sent my original or a proper credit agreement just the same old jargon that they send everyone on this site. Morrcroft have also added a £12.00 charge. Can they do this? and what shall i send them. Please can someone advise. Thanks Mashmallow xxx

Sent my CCA request off to Westminsters and got a letter back today from Allied International Credit saying that the account has been referred to them by AMEX and payment must be made to them. Who do I send the account in dispute letter to West or Allied. Please help. Mashmallow:cool:

Hello Members, After receiving a letter from Freds, got another letter from Cap 1 today. I don't know what is going on but after sending a complain to the TS which I done today and after sending the CPR 31.16 I get this:- As I've already explained in accordance with section 78 1983 we have provided you with with a copy of your original agreement bla bla bla. Your account status remains in default. We do not accept that your request satisfies the criteria at CPR 31.16, we do not believe that a copy of your original agreement would have to be disclosed under CPR31.6 as part of our standard disclosure obligations. In essence it is your case that you are entiled to a copy of the org agreement it is in our case that you are not. This is for the court to decide. The disclosure will not help the court to decide. We shall refer this letter to the court if regardless of the above you decide to make an application under CPr etc., You now have the option of contaction the FO. What on earth does this mean and what do i do now. Please help. Regards, Mashmallow XX

I received a parking ticket having parked in Icelands car park and did not get a ticket, I waqs going to pay the £60.00 fine but after reading somewhere on this forum, the DVLA has supplied by personal data as registered keeper to Excell which is a private car management company unlawfully and got paid £2.50 for it. Can I protest this fine on these grounds i have 3 letter templates to send off one to the company, DVLA and Commissioners office (i think it is called that). Any advise please Mashmallow:eek:

I sent letter 1 to Cap one and got another letter basically telling me they have sent my CA which I know it is not the original agreement and the final paragraph they state they will not enter into any further correspondence with me and mention contacting the FO. Shall I send letter 2 !Formal request for information CPR part 31.161? or refer it to the FO? Any help would be appreciated. Mashmallow

I have sent letter one to cap one and i got a reply today stating that they have sent me the original agreement and if any terms have been varied then the copy agreement will include the updated terms. They go on to say that any request for pre-action disclosure under this rule must satisfy the criteria set out at CPR 31.16 and they will not enter into any further corresspondence. I am now going to send letter 2 as above in the thread. They have stated any application made to the court will be need to be accompanied by evidence explaining why the criteria are satisfied.
