  1. Thank you for the reply.....it just reinforces my intention to goto the FOS on Monday and then the OFT. I know the ruling on historical T&C's is next week and being as they latest ones were written specifaically for the test case I am sure the result will be very different.
  2. well i sent them a letter saying that the account is in disupte and that i also dispute the £400 they say i still owe them. I also threatened them with the OFT as their guidance stipulates that if the account is in dispute and they ignore it then it is considered to be oppressive behaviour. This was all put in the letter. Well I got another letter from the idiots at Abbey this morning. They mentioned that they will continue to charge interest at 28.7%apr. They stated that my letter was pushed straight to the complaints department (despite the fact that it was sent to collections). They said i need to get my account up to date and they are sending it on to a DCA for action. HOW THICK ARE THESE PEOPLE. I have contacted consumer direct as they are the only people open on a saturday and they have advised me to contact the FOS which aren't open until Monday. I am going to push this all the way because that £400 is largely made up of charges and they owe me over £7000 in charges. Also they are charging me 28.7%apr. Should I ammend my bank charges letter and charge 28.7% on account that they shouldn't be unjustly enriched by my money and that is what they are earning from it? Woodwa5:-x
  3. received a letter from the court today saying that goldfish will defend. got a letter from goldfish saying they will respond to my complaint within 4 weeks. i guess i just wait now for their defence:confused:
  4. I know what you mean mate. I was incurring charges up to £850 per month and lost my house as i couldn't pay the mortgage......that's caused me real hardship
  5. well i sent the £4.58 cheque back and told them that i would be filing in court today 25/6. Well blow me down if i don't get a cheque in the post this morning for the remainder of the money + interest. The interest was only at 8% but as i never needed to go to court i don't mind *************I WON************
  6. well they did get back to me and i went through security AGAIN but they are still going on about logging the complaint today and replying within 7 days. They do realise that i have served papers on them don't they? They do realise that they only have 12 days left or i will file for judgement. How on earth can an organisation like this have such bad admin:)
  7. received a letter this morning from goldfish stating that they can't talk to me about this issue until i've gome through security questions. THESE WOULD BE THE SECURITY QUESTIONS I WENT THROUGH AT THE END OF MARCH!!!!!! I decided to phone them anyway and they didn't have a clue what i was talking about and somebody from another department will apparantly call me back within the next couple of hours. I'll believe that when I see it. I'm not that bothered either way now anyway as we are on my timescales TICK TOCK TICK TOCK;)

  9. it's a rediculous situation where the customer has no idea as to who to sue. I did phone goldfish and they stated it would still be them. I suppose I started process when it wasn't even owned by barclays anyway and my papers are now in court and were deemed to have been served yesterday. If there is a problem I think I would a legitimate complaint to make buti'll let you know how it goes, Woodwa5:confused:
  10. kensington nearly ruined me and they should be stopped. By the end of my mortgage they were trying to charge me nearly £2000 per month on a 140k mortgage so would have got 600k back if i had continued
  11. i'm still waiting for some advice as i need to send this letter ASAP. Is it just a case of sending another LBA with all the new charges on them together with a section 10 dpa letter?
  12. Well I phoned morgan stanley today and it goes straight through to goldfish. They state that it would be 'goldfish card services ltd' despite the fact they are owned by barclays. That goes in the post tomorrow the. Can I just clarify that I put three copies of everything in the envelope? Woodwa5
  13. Just spoke to the Abbey and asked whether they have popped default notice on my file and they said I have 28 days from 29/5 before this will happen. This now makes it doubly imporatnt that I pen a reply.......PLEASE HELP
  14. another day another letter from the shabbey. This time they are threatening to put a default notice on my account if i don't pay up within 28 days. i thought they had already done this!? i need to reply asap. shall i issue them with a section 10 letter? woodwa5:mad:

  17. btw i am having major issues figuring out who on earth i sue for my morgan stanley card. I have decided on goldfish as it was them that replied to my S.A.R (although they have chosen to ignore all further correspondance). What happens if i'm wrong and they say it should be barclays?
  18. last i saw my claim would have been £80 (for a £700 claim) now they are £65
  19. I have done the paperwork and was checking hmcs web site and it appears that the court fees have changed and reduced?! have i read it wrong?

I have not been able to afford to pay the over £200 required to file against the abbey at court yet and in the mean-time have had poads more problems with them which resulted in me leaving them in January. Since then they have continued to lump more charges onto my account and also paid a couple of debit card items despite the fact there was no money going into the account. These were automatic debit card items which i had forgoten about. I do not and can't have an overdraft facility so how the hell can they pay them? We may take legal proceedings for recovery etc etc You should contact CAB etc etc XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX I am fuming and worried. I can't afford to take them to court at the moment (and would not qualify for help financialy). They have my claim logged (which is well over £7k). I have a couple of credit card claims which i am about to file in court over the next few days and will use some of the money from that to file against the Abbey and Nat West for bank charges. I can't believe they have the gall to issue me with a default notice. How should i word a reply? Also they are now saying they are going to charge me interest at the higher rate. Should I now look at counterclaiming all charges against them at the higher rate? Please help! Woodwa5:mad:

My credit card was with morgan stanley. on the POC would i put morgan stanley or goldfish. all the responses have been from goldfish and i don't even think morgan stanley issue credit cards any more. I'm going to file in court over the next couple of days so a swift response would be great, kindly woodwa5;)
  22. I have 000's of pounds worth of debt which i am struggling to repay. Would this count as financial hardship for the purposes of getting a stay removed
  23. well no great shocks in that they failed to reply to the prelim' and so far have failed to reply to the LBA. I am going to file at court next Friday but I don't expect them to reply, Woodwa5:confused:
  24. Well at least they replied (which is more than goldfish have done). First they sent me a cheque for the difference between £12 and £20. I accepted as part payment and sent an LBA. They have now sent me a cheque for £4.58 which represents 8% of the £56 they have already sent me. They are clearly taking the p**s and i am wondering if i should even bother replying or just file at court next friday when the 14 days are up, Woodwa5:mad:
  25. I too have been Kensingtoned, Got a mortgage for 140000, house repossessed 3 years later and sold for 150000. Two years ago they stated we still owed them 28000 so started trying to pay that back at 250 per month and two years later (ie now) we owe them 28300, Good luck to anyone, Woodwa5:mad:
