  1. Hmm thats very bad Lady E its not good to do that to you especially so close to a court date the judge should have made a the bank turn up to argue the stay seeing as it was so close to the court date very bad!

Another 28 courts are deciding whether or not to stay claims case-by-case. But nearly 40 courts appear still to be hearing cases as normal and not applying any stays. In more than 100 other courts, the situation is unclear.

Hmmmm rung my court to see whether the order has been issued they said it can take up to ten days to come back from the judge:eek: Do they have a right to cash the £35 cheque in advance or should they only do that if the judge issues the order? Im gonna wait until Friday and if I have not heard from them I will call them again. Not feeling very hopefull at the moment
  6. Yep it sure would:) We havent asked we want the surprise, the baby is due 21st of October! Would like to have all the stress of this out the way by then.

Hello All, ok dont want to get carried away as I know I will only be disappointed, but it looks like the judge is going to issue my CPR 18 N244 request!:o I have checked my bank online and found the cheque for £35 has cleared today! I feel giddy with excitement actually a little bit sick, dare I dream that I could have won my case in 2 weeks??? Im going to call the court on Monday to give them time to do the necessary paper work and find out whats happening. Even if they send a N244 requesting a stay the judges order should stand meaning they must submit the requested information with the 14 day time limit! So watch this space, fingers, legs, toes etc crossed! Cheers Leecabs:)

  12. I would only listen to what is said to you directly by the court as there are lots of variations going on so best to confirm with the court yourself first.

  15. Hmmm in the current situation not sure if you should worry about wasted costs until after the case has been heard as it will distract you best to stay focused I would think on winning first then apply for the costs after. Does anyone have a link for Feater concerning the costs?

  18. Hi Feater goodness you claim is going along well compared to alot of others, I would read through arguments against Stay well. As Abbey may well argue for a stay on the court date, to which you will need to read off the points against them being able to stay. Good luck!
  19. This seems fine you should note that Abbey only have a maximum of 28 days from the note of issue to enter a defence and not 28 days from their acknowledment.   20. Hi All, just thought I would keep you updated, I have phoned the court to ask whether the order has been processed? They have told me it takes five working days to issue order so everything crossed it will be issued tomorrow. Think I may say a little prayer tonight that the judge does!   22. Hi yes submit it you could get in before abbey stays I would run it down to the court yourself, because if Abbey fail to submit before the deadline you can apply for a judgement against them! Their defence will be thrown out. If they havent stayed yet this may be a quick and easy result for you! Good luck Leecabs:)
