  1. Iv'e been trying to lol! It took me ages to find, would you advise me to ring the courts and find out what is going on, or likely to happen? I didn't receive any additional paperwork, just a copy of what they issed to lloyds. caroline
  2. aghh!!! i am in the same position and I just don't know how to go about this situation, I agree that we should have a special thread dedicated to this problem as we can monitor each others progress and work out the right way to go forward! caroline
  3. Hello, just received a letter from the court saying that my judgement by default has been accepted and they have ordered lloyds to pay up. The problem is, I don't really know when Il get my money back?! Can anyone help me out? I started a new thread because no one has answered so far:o
  4. Just received a letter from my court ordering lloyds to pay the grand total of: 1,133.77!!! Im over the moon, but...............how do I get my money off them?! There doesn't seem to be any date on the letter telling lloyds when to pay by? caroline
  5. *:o BUMP:confused: *
  6. Hi all, spoke to my court last week who advised me that lloyds had not agknowledged my claim against them and advised me to enter judgement against them. I received a letter from lloyds at the weekend saying "we can see from our records that you have already issued a court claim for repayment of these fees and that our solicitors are dealing whis this". The letter was dated 19th of April, the bank had until 23rd april to respond. So now im confused as the court told me they had a backlog to get through and it is possible that lloyds did reply in time. I have heard nothing from the courts and i can't get through to the customer service recovery line at andover. What should I do?? caroline
  7. Update so far. LLOYDS-1139.00 Waiting for acknowledgement of court papers-deadline 23/04/07 HSBC sole account-501.00 no response to any letters so n1 being sent next week. HSBC joint account-499.00 LBA sent 18/04/07
  8. Oh I see.......won't be long now anyway, lloyds have one week to respond to the court papers tick tock......so a court date I hope will be set for some time in june with a bit of luck!!
  9. Has anyone ever won by default? i don't think iv'e ever heard about anyone winning like that on here? Hope papers get "lost" under a stack of new claims so they miss the deadline he he he:p
  10. I have just rang my local court and they issued the papers on lloyds 7th of april giving lloyds 14 days to respond, I don't want to bring my case to their attention by contacting them just incase they don't aknowledge the claim in time, however they my realise the are fighting a losing battle and decide to pay up! In my dreams lol!!!!
  11. Its been 2 weeks since N1 forms were sent to the courts and yet still no corrospondance from the court. Is it worth me emailing lloyds to let them know what stage we are at and ask if they intend on settling before we get a court date? It's likely they will say sod off but maybe it's worth a try?? Any advice on this???
  12. Update: N1 forms sent to court on friday- no letters received from them as of yet and of course no correspodance from lloyds or sc&m. Hsbc failed to send all of my statements to us so they have been reported to the information commissionnaire. Also no reply whatsoever from HSBC regarding the claim for my current account so N1 forms will be sent out next week. Im starting to see the tiniest light at the end of the tunnel!!!!!! caroline
  13. THANKYOU!!!! All of your support and advice has been wonderful and im trully grateful!! I'l let you know how i get on.
  14. The thing is, that the lady that has been dealing with my claim has been really nice, she has answered every question and query- and I have been emailing her daily for the last 6 weeks!!! She has always informed me of any progress and when I requested she add an additional charge to the total amount, she did it without straightaway without question. So I don't really have any problem with the company apart from the fact that there are other companies doing the same for 10% cheaper! The only thing that gave me reason to complain was the fact that they didn't bundle the three HSBC claims together, but really thats better for me because i have to share the joint account money with my ex and it avoids confusion if it is a seperate claim to my others and the 27.50 charge they missed was amended before I told them about it. caroline
  15. Unbelievable!!!!!! What a nerve......surely the court system are going to come down on the banks soon for wasting their time?
  16. I suppose at the moment it feels like nothing is progressing and you wait for days and days and then receive a standard s** off letter. I know this is a long and lengthy process and now the n1 form is being processed I know my success is iniment, but it really really frustrates me that lloyds fight so hard when they KNOW they are in the wrong!!!!! I was hoping that the whistleblower program would give all those robbing banks a kick up the backside!
  17. Hello, thought i'd let you know how my claims are progressing. ok....... LLOYDS- N1 form on it's way to the courts HSBC current ac- deadline for the response to prelim letter 30/03/07 (tomorrow) HSBC Ccard and joint account statements not received-deadline 03/04/07 I'm reading through all the new posts and getting really upset because it feels like im the only one who has not received a goodwill gesture from lloyds at this stage!! It's not fair Anyone else feeling really fed up with it all??? (stupid question!) caroline
  18. Thumbs up to whistleblower last night on getting Barkleys on camera admitting they profit from charges!! Fingers crossed the courts will take a very dim view of the way the banks are clogging up the system with claims when they have admitted they are wrong and just order immediate payment to everyone!! We can just dream..............
  19. Unfortunately, he had to sign inorder to claim the charges back as it's a joint account. Plus- just had an email to say that they can't just pay the money to me cus they are acting on his behalf too So I can kiss goodbye to that little bundle:mad: There is no way on this earth that he'd be prepard to give me any sort of back payment-what a git!
  20. You are right on that front! He was out of a job for 2 months, so he said I can't give you anything. He was working for an agency but claimed that he wasn't earning enough to give me anything- im sure he could have given me 10 per week or something1 All in all he must owe me about 400. I think il ask the company to pay out to just me as previously they said that they would have to pay him by cheque too as it is a joint claim and he has signed the papers!
  21. Thankyou so much for all your advice,it is really appreciated. Yesterday after some sound advice from you, I emailed the company and requested that the charges are added to the claim before the N1 forms are completed- they did this immediately But they sent a letter to HSBC on friday asking for all the charges back on my current account so my Hsbc accounts will not be bundled into one claim. There is a positive to this as firstly they haven't received the statements from the HSBC credit card or my joint account yet and secondly, the joint account is with my ex husband, so half the moolah is going to him grrrrr.(he hasn't bothered giving me any money to support the kids in 3 months) So things may have got a little complicated if they had all been merged into one. I feel a little embarrassed about this whole situation as 6 months ago I had the money, no problem to file the claims myself. Unfortunately, my son has Aspergers syndrome and did not cope with me working fulltime, so I had to find a job with less hours and less pay, so I could be with him more. I'm currently waiting for a decision about whether we are entitled to benefits for my son at the moment, so if i'd really thought everything through properly, I could have used those back payments to pay my court fee's and enjoyed all of the money for myself Iv'e looked through the terms and agreements of the contract I signed and there is no mention about cancelling the agreement. So far this is the stage i am at: Lloyds N1 being drawn up as we speak for 1039.00 HSBC Prelim sent 16/03/07 HSBC JOINT ACC- request for statements sent 22/2/07 HSBC C CARD- as above
  22. Can I add on an additional charge I received after starting the reclaim process??? Im just about to sign the N1 form and I need to know if I can add the 60 to the form without informing the bank prior to this???? Any help would be gratefully received as I need to know this asap!! Hope this all makes sense!!! thanks caroline
  23. P.S .............does anyone know how i can change the name of my thread!!!!!!!!! e.g Car2 v HSBC+ LLOYDS??????? TA X
  24. THANKS SO MUCH!!!!! Thats really kind of you. There are a couple of things that im not happy about 1. I asked the company to add on an extra charge of 60, this was what i'd been charged whilst going through the re claim system, however they advised me to claim again. I don't really want to claim against my bank twice because I don't want them to close my account, and surely it wouldn't be so difficult to send them a list of revised charges??? Also, i am claiming charges back from HSBC - current account, joint account and credit card. I asked if they would all be put together into one claim, and they said no because they wanted to stay within the limit of small claims- but i KNOW the claims combined would never get past 3000 and 3000 would be a miracle!! Also, they added up my charges and left out one charge of 27.50 which I had to inform them of!!!! Can I have some advice on where I stand with revised charges and bundling claims together please!!!!! Many thanks caroline
