    I have called the court today and they have sent out the AQ. Best to read up on that now!! I was so hoping to get this all sirted by now. I was wondering if I should contact Abbey and see if they want to settle now, does anyone have any advice on this?

    Ok so now the case has been transferred to my local county court. In the letter from Northampton it says 'IT IS ORDERED THAT:- 1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise. Do I now wait to see what my local court send me or start my court bundle?

    I had their standard defence and now I'm waiting for it to be transferred to my local court.

    I posted my spreadsheet to them the day after I made my claim online requesting that they add it to my claim. It states on MCOL that the claim is being transferred, I'm guessing to my local court.

    So now the next bit. According to MCOL Abbey are defending, no doubt I will get the usual defence in the post any day now. Any pearls of wisdom for my next step?

    They have another 14 days to get their defence in. Then its the AQ I believe.

    Abbey have acknowledged the claim so I'll start reading up on the next bit. Shame I was hoping they would forget it was a Bank Holiday and for get to reply!

    Strange I was told they would put £1375 in my account but it was £1190 listed as individual Miscellaneous Fee Refunds of various amounts ie £20, £30 and £35's. As it was a refund of some charges do I need to send them a letter (there was no mention on the letter saying it was an offer or final payment). Also when do I tell the court?
  11. Fingers crossed we won't need to do much more. I am dreading have to photocopy everything. I am still waiting for the goodwill payment to appear in my account. They give 10 working days.
  12. If the court served your particulars of claim in, or with, the claim form, the Form N205A (notice of issue), given or sent to you when you issued the claim, will show the date by which the defendant should reply. This will be 14 days after the defendant was 'served with' (received) your claim form. You must wait until after this date before you can take any action. Quote from the court's online info. Looks like I'll be staying up till midnight to put a tick in the box!!!!!

    Strangly enough the goodwill payment is £75 over my overdraft limit so I am wondering how long it will be before they cancal my overdraft!!

    Got the usual letter offering me £1375.00 goodwill payment. I will wait for it to go into my account then send them the ta for the part payment letter. Do I need to inform the courts yet about the GOGW?
  17. Does this apply to packaging? Would this also apply to goods in cardboard ie lawn seed which may come open in transit.

    And now I have found out why I couldn't open another account. Our local council have wiped me off the electrol roll, and put 2 strangers in my house. They can't see how it happened as the other 2 are registered elsewhere as well. At least they have moved them out of my address but can't add me till begining of June!!!!!

    Recieved my notice of issue today. They have until the 7th May to reply. I'm guessing Abbey will leave it to the last minute and then another 28 days for the next step.

    At which point do we claim for preparing bundles etc as it's a bit early to have it on the court claim?
  21. I have noticed signs in our local store warning you to make sure that you keep the paint tins upright to prevent spillages. If there are warning signs then I am not sure you can claim against them. It may be worth contacting Dulux and claiming off them.

    Claim issued today, wow this is getting so exciting now, best I get reading up on the next step. When I first started this I found it easier to not read too far ahead and confuse myself. Just take it step by step and file everything.

    It's a shame we can't claim unfair hardship due to Abbey taking all this money off us and getting a reduction in court fees!
