  2. Hi there , I am a first timer (so to speak) as well. Barclays have just entered a defence likewise. Also a little panicked! I read earlier in the thread that they normally settle if it is under £500. Well my claim is for about £450. They have entered a defence too. Is this normal??? I'll be miffed if they end up getting the £55 court costs too!!!
  3. Hello, Don't mean to hijack your thread here people.... But a very quick question..... I have sent off my prelim letter, got back the usual offer of just under half. In my first (prelim) letter i gave them an additional 14 days. I should have sent of my LBA last friday. I have been too poorly to do anything this week. Should i send off the letter and give them an additional 14 days from now - or stick to the original 28 days deadline??? Once again - sorry to intrude... HD
  4. Thank you all ever so much. I'm on track now - and it feels good. I'm still not sure why i use the current rates of interest as they were different at the time - but am happy to do this as it works out to my advantage. Less than quarter of an hour until the weekend now too!!! Have a good one guys!! HD
  5. Very interesting... thanks for that Sneaky little blighters aren't they! (polite phrasing for benefit of those who may be easily offended) So i will request the data from BC, and send another data request to Mercers at Barclays address. That should cover all my bases. I'll do a little research on Mercers with Companies house. If they are indeed dormant i'll claim it all from BC. My gut instinct tells me Barclays have a pool of in-house DCA's that they rotate around for this very reason! Thanks HD
  6. Hello, I honestly meant no disrespect to anybody. I realise the time and effort that goes into all this. The problem that i'm having is i don't know what interest rate to use as my account has varied it's rates over it's life, the overdraft limit has gone up and down like a yoyo, the information (my statements from my DAR) from Barclays does not list the interest rates charged. Do you use authorised, or unauthorised? The actual spreadsheet i don't think will be a problem - it's what rate(s) to use. That particular problem doesn't seem to be explained anywhere (and i do apologise if i'm just being a bit dense or missing something obvious:eek: ) Thanks for the replies anyway guys....
  7. Thanks guys.... PS. Priority One - would you specifically ask for information relating to Mercers - or should the Data Request standard letter (in the library) cover referrals to Debt Collection Agencies. Ta
  8. Well i've paid the debt now (it was a couple of years ago). So nobody really owns it. I'm missing some information from a few missing statements so i've got to do Data Request for these missing statements. Can i still use a CCA request if the debt is clear? As i've got to do the Data Request anyway could i ask them to include any debts they have passed on - and to who they passed them on to? Any suggestions greatly appreciated... Ta HD

  10. I'm with you paintball. I'd like to thank everyone who has given me advice - but i also cannot get my head around this - not for lack of reading through things i hasten to add. I think the rule of thumb should be - don't claim back the interest unless oyu know exactly what you're doing. My claim is quite small only £320 - so interest doesn't make a huge difference to me. My BC claim will be significantly larger, i only hope that there is a nice simple way of calculating this before my Data Request comes back. Highly Confusing! HD

  13. Hello All, My head is spinning (not alcohol related - promise...). I've read through this and other threads and i'm still confused. I'm about to send off my letter before action - I was going to claim 8% on every item (some are o/draft charges, some are bounced cheques/direct debits). Please - what interest should i be asking for at this stage? Or should i not be asking for interest at this stage and just wait until it gets to court? Please help I can only apologise for appearing a little bit simple... Ta, HD
  14. Alright. I think i might try to get the money back from BC first - after all they did enable someone to collect the 'debt' unlawfully - if they refuse i'll try direct to Mercers (if they still exist!). Tis all a bit confusing . Thanks guys.
  15. Thank for that. I think the majority of the charges were from Mercers. So i will do that. Thanks. Also a a humourous point i thought i'd tell you that my BC account manager was called Susan Leach. Made me chuckle anyway!
  16. Hello, This is my first post to the site. I am currently pursuing my claim with Barclays Bank. Copies of statements recieved (in time and for no fee - so far so good!). The real question.... I am also just about to embark on my claim with Barclaycard. I have all my statements. I paid just over £200 a few years ago to a DCA (Mercers). When i purue my claim do I claim back from Barclaycard for illegaly instucting a DCA to collect a charge that they were not entitled to claim. Or.... Do I claim directly from the DCA for taking this charge. Or have i forfietted this cash because i paid it at the time? This may well have been discussed before - so apologies if this is the case.
