  1. Hello all! this is a fantastic forum I would like to say thanks to everyone that can take a time out to help me with my problem. I have owned my property for some time now a small apartment just outside of London. But after losing my job I have fallen behind with payments and now owe the lender around £5000. What I need to know is whether the lender has a right to order repossession although I own more of the building in equity than them. I look forward to hearing your replies on someone with more knowledge on this than me.
  2. Hello Please advise, I have just found out my husband has not been paying our mortgage, and we are having our house taken on the 20th of this month. I have contacted the lenders and they have just said tough luck, I have not spoken to them before, we can pay the money off at 600 a month but they do not want to know, I will signed a statment to prove all this. we do not have any other debts(ive checked). I have offerred to pay £3000 off but they have just said pay it if you want but it wont make any difference to us. Please please help I have tow small girls.

  4. My Partners house has been re-possessed by Arrow Global because her ex husband defaulted on a loan. The house was Mortgage FREE! AG have sold the property (5 bed detached house) for £130,000 Fortunately she issued a Severance of Tenancy via her Solicitor. The Court ordered the proceeds of the sale should be split 50/50 after the sale costs have been deducted and the amount owed by the ex retained from his half of the Money. Today she received a cheque from AG for £56,000 and although she has requested a full breakdown of all costs and payments only the cheque was delivered. We have again requested a full breakdown and await its arrival A simple calculation indicates that at least £18.000 (possibly more) has been deducted for administration costs!! Is this excessive? Without a full break down of costs from AG we are unable to ascertain exactly how much has been charged or if the monies have been split as the Court ordered. What would be considered a reasonable amount of costs on the sale of a property for 130k? If the Actual costs and fees appear to be excessive what course of action should we take?
  5. hi we are at court tomorrow with webb resolutions who want us evicted . we had a suspended order on our home with gmac 14 months ago . gmac have sold our account to webb resolutions. i have 2 children 13/ 20.... my wife is a medically retired asthmatic. 14 months ago i had heart attack from which i recovered and returned to work. but i was victimised at work last august so i walked out or i would have had another heart attack. since then i have struggled to get back in work and have ongoing heart concerns. so i arrears grew again at the begining of april i was offered a new job following lots of trying.. and good recovery from heart problems. so we started to comunicate with the lender again and tryied to set up a new arrangment . they said prove it my new job... so i did .. then they said prove my salary. then i was shocked when they said prove i have a heart condition .i have 5 pills for the rest of my life.. so i proved it .. they said no to new proposal and said we go to court 6th may 10.45 am.. i put in the n244 form to get a hearing and we got abicus ofline a specialist solictor to represent us .. he said he is 99% confident we will be ok .....this is and could be a new start for my wife n family but the lender is causeing undue stress by refuseing to agree. this week in the run up to tomorrow i have had sleepness nights and heart palpatations. from which i have had to use a gt spray.. for the first time ever..... i have had bad thoughts and have spoken to the samaritans and i really concider suicide.. i am a proud man put on this earth to provide for my family and i feel i have failed them..i will not be able to face them tomorrow i cant tell them our home is lost... please what do you think
  6. Hi Just after a bit of advice and resolution. Car has been taken today by order of finance company. Car has 4 missed payments totally £480 in which struggling to pay as not working, cant claim job seekers as previously self emplyed and wont give us income based as my partner earns £1 past the limit. So now household income just over £700 a month before anything is paid. Had Car for 3 years before today overall agreement on BOS for £9500 and paid off £5800 Rang Finance Company today and they said we had to make payment of £900 to keep car which included fees for bailiffs as such, stated couldnt do this for obvious reasons but I am i a position to pay £300 which was declined, it was full or nothing. In end they drove off, no paperwork nothing. Still have V5 etc here, not even sure whre car is being taken to. I have had ongoing battle with this company "Cygnet Finance" as when my partner at time went on maternity we asked to ereduce payments and change payment date for 9 months she was off work, they agreed, letter also stated that after 9 months we would go back to normal. When time came they refused to increase and move dates back, so we ended up paying less but at very awkward time of the month. The issue was though that they reported our payments on 15th each month late as agreement 1st of the month via standing order. Payments were made each month as agreed (letter to hand from Finance company) but still eachmonth late payment. i let this go onto till December Last year and then told them to resolve or would take legal action. In mean time I was told to check that Bill OF Sale had been certified but after writing letter they replied stating they didnt have a copy to hand it was more than likely misplaced but be assured it was and was all above board. To date after twice requesting still had nothing, even issued them Letter and payment for request of all my information they sen tme it but no copy in there either. The Bill Of Sale was include but no stamp like told there should be SO, if there anything I can do, Police did turn up as I noticed car being removed from drive I phoned police reported car being stolen thats when it all kicked off. What rights do I have, been told by fiance company they can tak eit whenever they want and dont need any form of paperwork regardless how much I have paid, even if there was only 1 more payment left that would be irelevant Anyone any advice or guidance. Wouldnt maind but paid off well over half of this car, to settle it they sent me settlement figure of £1400 beginning of year but situation went bad at time so couldnt settle Would of got in touch with solicitor is known this was to happen but she costs too much and cam eout of the blue and she is on holiday today. So hopefully so me kind folks on here can give me some free advice
