  2. How do they get away with doing this then if it's wrong? And in my case, what is it exactly they are doing wrong?
  3. I'll let my mate look over it and see what they say. It won't cost me anything so there's nothing to lose is there? When you say file a CPR request, can you explain what that is? Also, would I have to send the forms back saying I'm going to defend the claim before issuing a CPR request?
  4. Thanks sillygirl, some helpful advice there. I spoke to one of my friends earlier who is a solicitor, but he mainly deals with criminal law. Basically he said that what is on the claim form is not right, and that he wants the claim form and any letters I have from Bryan Carter as he's going to get a partner at his law firm to look it over for me and sort it out.

  6. Can you explain further? I do owe £658 though. If I do nothing, allow a judgement to be passed and then pay £229 within 28 days am I right in thinking that a CCJ will not be recorded on file and they can then not sue me for them remaining balance? So in effect I could pay £229 and "get off" with the rest? Or am I being silly?
  7. Hi all, About 2 or 3 years ago I defaulted on an LXDirect account which had a balance of about £650. When it was passed to a debt collection agency I rang them and offered to pay £50 a month and they said they were not an instalment agency and would only accept half now and half a month later. So I foolishly ignored them. I began receiving letters from various companies about it and yesterday received a county court claim form issued by Bryan Carter Solicitors. I also received a letter from Bryan Carter's today notifying me that they had issued litigation proceedings against me. The amount on the court form is for £229 which includes £50 solicitors fee and £15 court costs, but it states in the particulars of claim that this is part of £658.79(The Debt). What I want to know is what I should do now!! Should I just pay the £229? Don't know how to respond, can someone please advise me?

  9. Hi, I'm just wondering if somene can help me. You know if you have insufficient funds in your account on a day when a direct debit is due, and you pay money into the account the same day, am I right in thinking that Halifax will still pay your direct debit? I know in the past this has always been the case. However, yesterday I paid some money into my account to pay a DD, so from about 10am the money was there. Yet tonight, they've emailed me to say they are charging me £39 due to an unpaid DD. :eek: How come? Maybe a sudden change of the rules since I claimed back my charges?
  10. Hi, due to sickness I've missed almost 3 payments to Ford Credit for my car. They sent me a default letter which had an expiry date of June 22nd on it. I rang them on Thursday and asked if it would be ok to pay the outstanding £635 on June 29th. They told me that I now owe them £788 with the late payment fees and that if I didn't pay £788 by yesterday (22nd) they'de pass the case onto their Litigation & Recovery Dept to recover the vehicle. I bought the vehicle on a 5 year HP agreement which will be paid off in October 2008. Does anyone know what will happen next? They were really unhelpful/unwilling to listen to anything I had to say yesterday. I really need the car to get to and from work and it has me worried sick at the thought of losing it. Once I bring the account up to date then future payments would not be a problem, it's just a case of clearing the arrears. Any help/advice would be greatly appreciated!!
  11. Ok folks, need a bit of advice about the MCOL proceedings. How long does it usually take after lodging your claim for a response from Halifax? Also, if it does go to court, how long would I have to wait for a court date, and if they make a satisfactory offer, am I right in thinking you can halt proceedings? Or would you still have to go to court?
  12. Hi all, arrived back from Norway this morning just in time for another letter to arrive from the Halifax. They're now offering to refund me 6 months charges which totals £320. Again, they say it will be full and final settlement. Obviously I'm not going to accept it, so I guess that I'll have to file against them in the courts. One other thing, the letter I received today says, "I know this won't be the response you were hoping for". :D No s***!!
  13. Hi guys, been working away hence the the delay! I've received a response from Halifax this morning offering me £104 as a goodwill gesture. It says this is full and final settlement! Obviously I'm not accepting it. Should I now send a LBA letter? Or reply in a different way? :?
  14. Cheers!! In the premliminary appraoch letter for repayment it states that you include a schedule of charges. Do you just print off the Excel spreadsheet or just list the date, reason and cost of charges on a seperate page? Sorry for sounding like an amateur .
  15. Hi, We've just changed our holiday from August 2006 to August 2007 because we're buying a new house. Thomson charged us a total of £60 to change the date. That was for 3 people!!

  17. Okay, I'm sifting through my statements and I'm about to enter the details into the Excel spreadsheet. Only trouble is I've never used Excel before and could do with a little guidance. What I'm unsure of is, do I delete the examples of charges that are already in the spreadsheet? Or do I just enter them on page 2 or replace the existing ones with the actual charges?? Sorry for sounding like an absolute gonk but like I say, I'm no good with Excel.
  18. Finally got round to sending the Halifax my DPA letter on May the 8th!! Received a reply last week telling me that my statements would be sent soon but they are not obliged to disclose instances of manual intervention. Anyway, this morning 31 envelopes containing 155 pages of statements dropped through the letterbox. :o Will work through them at the weekend and take things from there.

  20. What a great site!! Over the years Halifax must have stung me for thousands of pounds in charges! So I think it's time I did something about it. Just a couple of questions though. Firstly, can I only claim back the charges where the value of missed DD's is less than the charge? Or can I claim for ALL charges levied against me? Secondly, am I correct in assuming I need to include a £10 fee for disclosing the information under the DPA? Thirdly, where is the FAQ?? Cheers DoubleVee
