A bit confused now. This is were I am at: I have the orginal agreement from 2001, and therefore didn't do a SAR. I went straight to Prelim lettter to ask for ppi premium and orginal interest back. The letter was based on one from this forum. I didn't send the spreadsheet of additional statatory interest (I have since filled in this spreadsheet). So do I do a SAR now, or just wait 14 days for a response to my prelim letter, or resend prelim with spreadsheet with statatory interest attached? I am also in the exact same position on a different loan with HSBC again from 2001. The only difference with this one is that it was settled and the interest rate was 11.9%.

Am I right in saying that I also ask for the 8% statatory interest on the whole amount from 2001 in the Prelim and lba letters by enclosing the interest spredsheet? (I thought this was added at court stage)

I got a default because of this loan, can this be removed?

Just sent the preliminary letter off to MBNA for loan PPI, which amounts to £3.5k. My question is regarding the spreadsheet for interest. Should this have been sent to MBNA with the prelim letter? This loan was sold on to Wescot credit services and has been part of a DMP with payplan for a number of years now. I am still paying this off so where do I stand with the PPI part? what should I do for the speadsheet?

Sent egg a request for return of charges letter and got a reply offering £16 in total! (I had asked for £80 + £63.13 contractural interest) look at 2 and 3 above. 2 says they have estimated their costs to be actual losses to them, how can this be?

it was 2 days from the leter that I sent in the above post. But they were dragging it out prior to that, their offer letter was on 7th march. but they wanted to pay it into my account so the overdraft was paid off without actually saying that. -

I check my HSBC accounts online and it shows the payment in and then out on the 21st, but it was done in the account with the overdraft. This claim was for 2 accounts, so I would have thought that they would have done this for each account? Most of the claim was for the account that has no overdraft now? doesn't matter to me, paid the cheque in today, will just hand fire till thursday to make sure it clears ok, can't envisage a problem there! -

finally got the statements today, with a letter full of nonsense about holding information on microfiche. Anyway they have sent all statements, absolute ****e quality, and some barely legible. Next step now

Letter received today from DG: I want to avoid them sending this to one of the accounts that I claimed for as there is an overdraft on this still, which is part of a payplan agreed monthly payment. The other account is in credit. What are my options? -

still not received anything from DG and also checked the account online. Also spoke to court today who said that they didn't submit their AQ (was due on 10th March) and was goint to go to the judge probably next week. (This court doesn't rush!) what the score here? -
I did an online complaint on the ICO site.

I deceided to take their offer as its better than nothing. probably could carry on fighting but I don't really want to do the court bundle and all that paperwork. Its a bit disappointing that the courts are so leanient with the deadlines. A deadline shout be exactly that. We are working to them so why don't the banks? because the courts let them get away with it:-x anyway, I have asked for a cheque and crossed out the confidentiallity clause. Will they send me a cheque or try and put it into the hsbc bank accounts? (2 claims for different current accounts, 1 has nothing in and the other is £460 in the red from when they withdrew the overdraft, which is on my payplan payments) my worry is they wipe the overdraft and I can only get the remainder:sad: -
still not received any statements as of today 15/3/07 from an initial 40 day application on 13 the december 06! even had ICO write to them and I have done 2 LBAs and still nothing. they are taking the p_ss big time:-x

I have received a letter from my banks solicitors saying that I can't claim back the overdraft interest part for each claim and the 8% statatory court interest. I had used vampires spreedsheet which works out the proportion of this interest in relation to the charge. They want to know the legal basis of my claim in relation to the overdraft interest.They have however offered to settle all charges, plus 8% plus costs so we are talking about £200ish. I had rejected their offer last week, but they are still saying the same thing. Also they have failed to file their aq on the deadline. still don't think they have filed this (it was due on 10th march). can anybody give me some advise on if I should now take the offer or are they trying it on?

Received this letter today from DG after rejecting their last offer: should I accept this? by the way, the court confirmed that they missed the deadline for the AQ submission, but were gving them 2 more weeks! not much point in having deadlines is there? -
