MBNA Loan PPI - Claimed: £5239, refund reveived: £1944 MBNA Credit Card PPI - Claimed: £2800, refund recieved: £1880 Doesn't look like 8% interest has been paid, and the loan was sold off after 31 of 60 payments made, but I'm still paying the full amount to a DCA, and this has not been mentioned by MBNA nor any money sent to them. I have sent letters back to MBNA asking for a breakdowns and the remining amounts to be refunded. FOS are looking into the loan a/c, but are not interested in the credit card as it was before July 2001.
  3. Quick update, Recieved a cheque from MBNA for £1880 this morning in full and final settlement, a bit off from the £5239 I had claimed and no breakdown provided. No idea where this figure has come from as the original ppi was £3498 on the agreement (£5239 with 8%), and I am still paying this off with westcot in full?
  4. I did go to the FOS first, but they sent back all the forms and said they couldn't help due to the PPI being taken before July 2001, when they got their juristriction. So basically, I'm on my own and so court is the only route left for me.:-| Anyway I filed at court last week, so clock is now ticking. As for the rebate, there is nothing in the T&Cs from HSBC, but I don't know if they are the full version, as it just seems to list exclusions for the policy. SAR didn't provide anything what so ever in relation to PPI, yet the agreement and t&cs were sent to me as I had asked for a refund! (maybe as it is more than 6 years and paid off?)
  5. This explains why mbna offered me £1900 rather than the £2800 I actually claimed. Do they only have to pay the 8% stat interest on top of the premiums if it goes to court? (I never claimed the contractual interest, only stat 8% as the statments they provided were only transaction printouts, and didn't have the monthly balances on)
  6. Just looking at the loan claim and it is £5239 with the 8%. What happens if I go to court with this one with it being higher than the £5k limit for small claims?
  7. Can someone advise if these POCs are ok, before I send them to court? (I'm asking for 8% interest)
  8. OK, court claim it is then. Do I just use the same POCs as if I was claiming the whole amount? and do I now re do the spreadsheet and show the payment they have just made as part settlement?

Update as to where I am at: MBNA Loan PPI - Received this email from FOS on 16/4/10 MBNA never came back with a refund or offer or cheque as they had promised in their letter received on 15/4/10, so FOS have now passed this on to the adjudication dept. I have yet to hear back from anyone, although FOS were talking about a 10th June deadline for MBNA? MBNA Credit Card PPI: Recieved this by email from FOS on 15/5/10 So I am on my own with this one. Now, MBNA have sent a cheque for £1900ish without much of a fight, but I had claimed £2800, so I wrote back and accepted thier part payment and requested the difference. No breakdown was provided by them, so no idea where that amount came from. I have had a "we are looking into your complaint" letter back from them since. I guess next step would be small claims for the difference.

  11. Is a rebate of PPI always paid when the loan is settled early? I can't remember ever getting a part refund when I refinanced this loan with HSBC, and as it was late 2001, have no records of statements to check, and can't get hold of any. Should I just claim the full amount, and see what they say in defence?
  12. will this be ok for the POCs? and also just want to check when working out the figures to claim, if the loan was paid off early (month 8 of a 48 month term) how is the best way to calculate/show this, for the interest incurred per month at the time?

  14. FOS will not touch anything older than July 2001. I have had some sent back from FOS due to this.
  15. as my other claim with mbna has been rejected by FOS due to it being before july 2001, this will go the same way. any ideas what to do now?
  16. had a letter back from FOS tody regarding the credit card account, basically saying they will not deal with it as it was before July 2001. now I could have a problem as all 4 of my claims are before this date.
  17. Meant to say, It was the same Pre lim and LBA (different sums) sent to both MBNA and HSBC, yet totally different outcomes?
  18. received the cheque yesterday from MBNA for the lower amount, but have wrote back for a breakdown of the figure and just got the standard 'we are looking in to your complaint' letter. Also sent it to FOS.
  19. Finally recieved a response from HSBC and its not good: I have already filed a complaint to FOS before I received this, but should I do anything else now?
  20. Quick update, received another letter from HSBC saying they are still investigating and need more time etc this is like the 4th time they have sent this type of delay letter. so I sent it on the FOS.
  21. Had a reply from MBNA for a credit card PPI claim: The calculation sheet I sent was for about £2800 ish but they are refunding £1944.72 and I have no idea how they got to this figure? what now?
  22. got the SAR back from HSBC and there is nothing of use there. I suspect that all info on the loan has since been destroyed by HSBC as is was settled in 2001. Lucky I have the agreement! They did send a CD of phone calls I had made:eek: (only 3 of them) and nothing to do with this loan, but I was going mad at them over something else. Quite funny listening to that!
