  3. Brilliant news! Received a letter on Friday offering £750 (claim=1165) so was going to refuse then another letter came through the post on Sat offering full amount yipppeeee!! So happy, thanks to this awesome website and everyone's support. Will send donation as soon as ££ is in the account
  4. Hi Jster, I also have a Prelim hearing date for the 7th June, I received the letter last Fri so not far away. Getting quite worried, even though I'm confident they will settle before its still scary! I going to use your letter if thats OK as I havnt sent anything yet, I'm also going to send a witness statement, draft for directions and try and get a copy of all settled cases so the courts can see how much time the banks are wasting!! I'll follow your thread and see how you get on. Good luck! Kim

Ok this is the Preliminary letter the courts sent last week: District Judge Hamilton has considered the statements of case and allocation questionaires filed and allocated the claim to the SMALL CLAIMS TRACK to consider whether the claim can be disposed of because the defendant has no real prospect of success at a final hearing. It will take place at 1400 on 7th June at Norwich County Court. Before District Judge Hamilton IT IS ORDERED THAT 1) the claim to be allocated to the small claims track 2) The claim be listed for futher direction only at a preliminary hearing on the 7th June (est. time 5mins) 3) At this hearing the court will consider either: a)to stay the claim pending the decision in a test case involving the defendant, or b) To give directions for this claim to be heard as a test case and if necessary to reallocate the claim to the multi-track for that purpose 4) Not less than 14 days before the prelim the defendant shall file with the court and serve upon the claimant details of any cases proceeding as a test case, the decision in which will determine the issues in this claim. Alternatively the defendant shall file with the court and serve upon the claimant draft directions for this case to proceed as a test case 5) The claimant may make representations to the court in writing provided these are received by the court and served on the defendant not less than 5 days before the prelim. hearing. If either party is prepared to abide by the decision of the judge as to the direction to be given that party is excused from attending the prelim. hearing. 25th April Please can someone give me advice- 1 I have read other posts and decided its best if I attend is this a good idea? 2 I am reclaiming bank charges on behalf of someone else so I will be representing that person- should I make the court aware?? 3 I havint sent any 'nudge letters' what are these and should I do so?? My next steps are: To send a witness statement To send a draft for directions To attach all settled cases (cannot access this info??) I will get the court bundle ready as they may treat the prelim as the final hearing. Please help am I on the right track ??
  6. Hey Tori! Thought I'd give you a heads up on my situation being a fellow Norwich lass. Deadline for my AQ was 21st March, this week had a letter from Norwich court for a Prelim hearing 7th June, getting a bit worried but just trying to read up as much as possible so I'm prepared!! Hang in there it'll be worth it xx

  8. I need some advice. I received a letter from courts today and its for a preliminary hearing. The letter reads: to consider whether the claim can be disposed of because the defendant has no real prospect of success at a final hearing. Does anyone know what I need to prepare? Do I attend? I'm a bit unsure?? Cheers
  9. Called the courts today to see if a date had been set, they sent a letter yesterday its 7th June! Hopefully I'll have a bit of spending ££ to go on my hols with then!!

  11. Woolwich have submitted their defence, now in the process of filling out the allocation questionnare. Its got to be back at the court by 21st March.

  15. Hello all, filled in my moneyclaim form, delayed it as much as pos as they were still taking money from my overdrawn account! Today I received the Notice of Issue letter, scary stuff! Should I sent another letter to the Woolwich stating the new amount owed?? If so any ideas what to include?? Cheers

  17. Thanks Allyxia, I hope everyone has had a good Xmas! I havn't sent off my LBA yet as I've received a letter from Barclays offering to settle half of charges, I'm not accepting it, but now who do I send the LBA to? Woolwich, Barclays or both?

  19. Hello all! Sent my Prelim letter off which was received on the 11th Dec. They have sent back the usual bog standard letter- Thank you for taking the time blah, blah, we aim to resolve this matter by 11th Jan yours sincerely Michele Wallis (Sales and Service Manager). So I'm getting ready to send off the LBA, just out of interest does the 14 day rule include weekends? And does it start on the day we post the letter or the day they recieve it? Cheers
  20. Hi all! Thought now is a good time to introduce myself. After reading as much as possible from the FAQ's section I have finally sent off the Prelim. letter. Doing this on behalf of my partner as he doesn't have the time or motivation!! Trying to claw back £761. Plus an extra £35- the letter was sent the same day I sent off the prelim letter, how annoying!! So now £35 in overdraft, could I just refuse to pay this?? Setting up a parachute account so will have the details soon.
