  1. Thanks, I have just read that all the defences are now signed by him. I have tried [email protected], but it is rejected. Does anyone have a contact e-mail address for Willem Basson?
  2. I sent the AQ at the start of March and today received a response from the judge ordering a 1 month stay for negotiation. I have compiled a letter to James Arrandale stating a settlement figure and I decided to e-mail it to him. I was suprised to get this response. "James Arrandale is no longer working for Abbey National plc as of 2 May. Your email has not been forwarded" Has this been seen before? I also sent it to Tanya Thwaite so hopefully she will action it.
  3. Today I received a copy of Abbey's standard defence and a standard letter marked "without prejudice" disputing my claim and offering me a 50% offer. I am going to reply on Monday saying I am not going to accept their offer and await the AQ from the court.
  4. Yesterday I received a letter from Angela Stewart saying they have reviewed my case and that they believe the charges are correct and therefore cannot agree to refund any further charges. I also recieved a letter from Abbey stating that a defence would be filed in due course and it would be helpful at this stage if I could provide e-mail and telephone contact details. I will send them on Monday.
  5. Today I received a letter from the court stating that Abbey acknowledged the claim on the 30th Jan and that they have 28 day's to file a defence.
  6. In the last few day's I have received a couple of standard letters from Mark Winder saying that his investigation is taking longer and would need a further 4 weeks........ Today I received a letter from the court saying that the claim is deemed issued on the 28th Jan and Abbey have until the 12th Feb to reply.
  7. It looks to be very similar to the draft order that the CAG are advising we send with the AQ.   8. On the 17th I sent Abbey a letter accepting the GOGW payment as part payment and there will be no extension. Today I posted 3 copies of my N1 with the schedule of charges to my local county court. The fun has just begun!
  9. Received a number of Misc Fee Refunds totaling £110 today. No letter or anything to explain them yet. I guess it is a start! Will be filing an N1 on Friday.
  10. I got the same reply just before I was about to send the LBA. I modified the LBA to say. I am very disappointed that you chose to respond to my letter of the 18th December 2006 with a standard letter and leaflet. Hope this helps, good luck with your claim.
  11. I wrote to the registered address with a cheque made payable to ABBEY. I think this is the recommend approach rather than going through the local branch. The registered address is on the homepage of the ABBEY web site.
  12. I am also claiming contractual but still at the LBA stage! Can anyone advise if you still add the 8% when you file the court claim if you are claiming contractual?
  13. Thanks Cross, So if people are claiming for more than 6 years does this mean that it is allowed? Or does it make it very difficult and possible for the shabbey to defend? I don't want to do the wrong thing but also don't want to give up on £300.
  14. Can someone please advise, I think that I have done something wrong. When Abbey sent me the copies of transactions they dated back to the 30th June 2000. I included these transactions in my PRELIM and LBA but I am now concerned from reading another thread that I can only claim for a maximum of 6 years worth of charges. Should I only claim 6 years from the date of the SAR? The difference amounts to £300! Should I send a revised LBA or wait and send a revised N1? Thanks in advance.
  15. Letter received today from Abbey dated 29/12/06 (Andrew Nanson, Complaints) stating they were investigating my complaint and that "Our research is taking longer than expected......................... we will write to you again in 4 weeks time" !!. I will be sending my LBA tomorrow.

I used the advanced spreadsheet from Vampiress which is in: http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html The three sheets that make up the spreadsheet seem to be very straight forward regarding the 2 types of interest. The first sheet is called 'Notes' and it is where you input your name etc. The second sheet is called 'Charges and Interest' and it is where you input your charges and interest charged while overdrawn. The third sheet is called '8% interest' and it automatically takes the information from the second sheet and applies the 8% interest. This is only used if you get to court. I just inputted all the data and printed the second sheet and sent it with with my PRELIM. Hope this helps.
  17. This is the standard letter that I also got. I got the list of transactions a few day's before the 40 day deadline. You just need to wait for them to arrive. Good luck.
  18. I am no expert but I think you have done it correctly. This is what it say's in the notes section of the Excel sheet. "The turquoise boxes on the right hand side are for any interest you have been charged in the last six years. You need to enter a date, amount and account balance in columns G, H and I accordingly. The best date to use for the interest, is the last date of the interest charge period, e.g. for 1 April 2002 to 30 April 2002 a date of 30 April 2002 would be used. If this date is unavailable, use the date the interest appears on the statement. Enter the balance the account is showing at the date you are stating, using a minus figure for overdrawn balances" I hope this helps
  19. Do you think that I should give them longer than the 14 day's because of all the bank holiday's over Christmas and New Year?
  20. I received a copy of all the statements for the past 6 years yesterday and calculated that they owe me £2464 plus £885.55 interest, which totals £3349.55. This is actually for 6 years and 6 months, will this be a problem? I have written my PRELIM LETTER and will send it by recorded delivery on Monday.
  21. This morning I received a standard looking letter dated the 16th saying that I need to send them £10 and complete their form. I have read on a thread somewhere that I should not complete this form. It looks like this is acting upon my request by phone because it is before the date I sent the SAR. Should I write to them acknowledging their letter and that I have allready sent them the £10 and that they now have only 31 day's remaining, or should I leave them to react to the SAR?
  22. I have received this morning some of the last 12 months statements (3 months missing). Now waiting in anticipation for the remainder of the 6 years!
  23. Thanks Karnevil. I have sent them the SAR today by recorded delivery clarifying the number of day's remaining and the £10.
  24. I have asked for 6 years of statements from Abbey over the phone on the 13th November and they said that they would send me the last year in 7-10 days and the remainder on microfiche in 4-6 weeks. I then found this site, which is excellent and have now seen that I should of sent them a formal letter. Are they going to send me them or will I wait 6 weeks and not get them? Should I send them a letter as well?
