  1. Last winter my husband lost his job, payment protection was invalid and we accrued arrears in everything. We reclaimed charges and gave the mortgage company a lump sum. We got a suspended possession order in may (he was back in work by then) and always paid on time since. Except in december he was paid a different day and there was a tax error. We only had £700 in the day the standing order went out. The bank system decided to pay council tax before mortgage, so mortgage didn't go. We just found out last week..to top it off the fixed rate ends this month and they want £300 extra a month. We could rent my house for much less than the mortgage repayments! So we are selling up. They say if we get the missed december (actually it was the january payment but it goes out then) payment to them (hoping work can lend it to us) and prove it's on the market they will hold out they will wait for us to sell before enforcing the warrant. How can we believe them? Last time when my husband lost his job they said they wouldn't take it to court as long as we kept them informed. They started proceedings the week he got a new job and we started paying again! I've just heard about the N244. Now would doing this annoy them? Do you have to have sold before filling this out or just prove it's on the market? We really are trying. just to add I can't see CAB until Tuesday (been this week already) as they only have outreach here. You can't get through on the phone ever!
  2. It's still happening. I tested it this month, checked online my balance...knowing I have nothing pending at all. I have £70 left...the cash machine just half hour later says I can have £140. I complained and they just gave mnethe spiel about pending debits..when I know there aren't any!
  3. I wish they'd hurry up. I was just about to start on mcol with them with OFT did this. I am getting increasingly annoyed with Natwest...I swear their cash machines lie about available funds to get me overdrawn and fined on purpose!
  4. I have spoken at length many times to my husband's mortgage company over the past year. My husband on numerous occasions has granted permission as he has very little time at work to call them. Now all of a sudden they reckon I can't talk to them and we urgently need to discuss our account. My husband has written again giving me permission, and emailed and rang but failed to reach the man we need to talk to. When I ring I get through and refuses to tell me what's going on. What can we do? It's like they are doing it on purpose. They have lied in the past about other things too.
  5. Thanks very much. We've had so much money trouble from just a few months out of work. For some reason nobody (CAB, Jobcentre or the utility companies) told us about most things we were entitled too even when we asked many times. It's as if they assume you've been through it before...then when you find out they can't backdate it. but that's a rant for another board I suspect.
  6. I was just about to file the claim in court when the whole OFT thing happened. Thing is my husband lost his job before christmas, now is back in work but we acquired quite a few arrears (council tax and mortgage plus utilities) during the time he was out of work so I think we have a case for financial difficulties. Who is it I contact to get my reclaim looked at in light of my situation?
  7. I sent my lba a couple of days ago and this morning received a letter about the oft stuff. It says the normal timetable for dealing with complaints has been suspended and the FSA says so. Does this mean I can't continue with the normal schedule now?
  8. Thanks for trying! I think perhaps I'm supposed to put something in the interest free overdraft bit. Trouble is I don't know when exactly my overdraft limit changes and it's not interest free, it changes. In 2001 for example it's 16.99% upto £200 after that it's the unarranged fee.
  9. What I mean is sometimes the value in a cell in Q does match the value put in H (on the same line) and sometimes doesn't. Is it meant to match or not?
  10. Sorry I think I am having a blonde moment (or the fact I'm doing this with 3 children to keep eye on too). I've filled in the complex spreadsheet. Not being that good at excel I'm trying to work out how it works exactly. Shouldn't there be a place to put my overdraft limit in or does that not matter? Sometimes the interest on penalties matches the amount in the interest charged cell, but sometimes not. I'm sure I have done something wrong!
  11. Yep I got all of them. I sent my request last week. Got 2001/2002 on wednesday with a note saying rest will follow. Got the rest this morning. Everything is there.

  13. I'm just starting looking at my NatWest. ALl is normal until late 2002 where I just get "charges" with no explanation. At first I get a separate £6 (the advantage gold bit) and a £20. Later on it's combined. I cannot work out what it is for. S'okay...worked out it's unarranged borrowing fee now. I was expecting it to be labelled as such like the other charges are.
  14. I reckon he is who my husband spoke too today. He said it was a really nice sounding man, really friendly and apologetic. Most cross when he found the cheque had been cashed.
  15. We are just about to do a non compliance letter to Barclays. They received our request on the 13th of March. We had a letter on the 22nd saying there's be no charge and they would get the statements to us in 40 days. Not only have they not delivered yet they also cashed the cheque they said they wouldn't (I know I should've cancelled it really). On the phone they say it could still be another 2 1/2 weeks. Hardly compliant!
  16. oh great! Got a letter today offering me the full amount plus court fees. Dated the 6th of february!! So they sent the offer of full amount minus court fees after this letter which we accepted. Blimming royal mail!
  17. I cannot post on the success board so will have to stick this here! Halifax paid up £3,740 last week. It was the original amount we asked for before starting the claim with MCOL. We lost the interest and charges due to our mistake on the MCOL site (I use firefox, and an important box to do with inputting the interest didn't pop up apparently)...we just didn't have the time to start again so accepted Halifax when they made the offer.
  18. Oh this woman said we'd have to start the whole thing again £120 and it would take at least 3 weeks. We do urgently need the money. You don't get help when returning to work after JSA and need the money asap to pay for food and travel to work.
  19. just £500 mcol said we can start again, amend the claim, but it's more time and further costs. My husband had been out of work until recently so this money is urgently needed too. I had listed the amount of interest in my particulars, but mcol said that doesn't count. It had to be added per instruction of the pop up I didn't get. Mcol say they are looking into the issue though.
  20. cos we've lost the interest in our claim! Apparently there's some pop up asking you for the interest but that never popped up. I just thought it was dealt with by the spreadsheet we sent and that there'd be a box down the line dealing with the interest amount (plus I put the interest amount in my particulars) the box never came. Got to starting judgement today and still no box for the interest. The amount I added in my particulars doesn't count apparently. Just found out after calling mcol what had happened. Needs to more obvious! Apparently the reason why they don't say is because mcol doesn't work in firefox usually. The lady was surprised i had managed to even start a claim using it.
  21. I have a similar thing going on. I filed my claim on the 18th of January. Got an offer of the original full amount a couple of days ago. I still want my interest and fees too so I wrote declining informing the of court action etc. Thing is mcol still won't let me start judgement. I thought enough time had passed by now!
  22. Thing is they know this as this offer is replying to a letter I sent saying I'd already started court proceedings. So I don't know if this offer is an acknowledgment. Does that make sense. I'm also worried if I reject it then I'll lose. Oh well I'll just do another rejection of settlement. I've come this far! Also noticed halifax can't spell complaint...twice in one letter too!
  23. What if they've not done any of those! They offered us the original amount in a letter this morning. We asked for £3740 and that's been offered now...however now since starting the claim I now have interest and court costs added. They don't seem to mention the court stuff at all. We were offered a lower amount after issuing the claim. I said I'd take it as partial payment but still continuing with the action. This offer of the amount originally requested is in reply to that letter, but it doesn't read like an ackowledgment to the court claim. iykwim! Do i basically accept as partial but ask for the interest and court charges too. Or does offering the full amount owed originally class as paying up in full?
  24. Thanks that's what I thought. I guess I'd have been sent something if they had responded to the claim! Thought best to check. I don't want to do anything wrong. grr...more waiting! I thought 14 days was it..turns out I have to add another 5 days on now.
  25. Do they write to you or the court when acknowledging or filing a defence? I issued a claim on mcol on the 18th (I make that as 14 days ago now), I've not heard anything, not in the post and when I log on to mcol it doesn't say anything either. No money in the account either. Does this mean I now start judgement?
