yes very surprised at 24.9% gives me £685. i just thought they would be more inclined to settle fast without the interest, trying not to be greedy ONLY want back what they taken off me

Thanks for the link for the spready. Earliest charge march 2010, and totals £624 excluding interest. I think I would be happy if BC refund full charges only, guessing for the interest i would have to involve the courts. I was thinking I would include the schedule of charges but without interest and add a sentence on the prelim letter that unless they refund charges in full within 14 days, I will take them to court and not only claim full charges but also interest and costs. Does that sound sensible? Thanks again to all.

I m trying to claim back charges on my barclay card. I found the prelim letter to use, but not sure if i should include an soc. If this needs to be included with letter, is there sample / template of this on cag site that can help me prepare my soc. Thank you A S

hi i wonder if anyone can help / advise i had mortgae with gmac. i was entitled to housing costs benefit from DSS and this was paid direct into my mortgage account by DSS. in nov 09 they wrote to advise that because of the recent court ruling about unreasonable charges i m entitled to 16.25 refund. i had a quick check on my sttements was surprised they charged me nearly 400 pounds. i called them to ask how they arrived at 16.25 as its actually nearly 400 pounds. they explained as there was a partial payment made into the account every month by dss i am not entitled to any refund. in one month there was no payment made at all so i am only entitled to refund of the charge for that month only. is there anything i can do? thanks a salique

how long did it take to get the information under data protection act? when you apply for this info do you need to qute any act and do you apply at the address where the letter for interview came from? thank you very much

Thanks reesdance. To be honest I was not too concerned about the interest, (about£340) from the start regardless of the amount, just felt interest was not my money that they taken and all i wanted was retrun of all the money they taken plus court fees. How you getting along, did you speak to cobbetts about settleing minus interest All the best asalique

GOOD NEWS Received cheque this morning from Cobbetts by Spec del. Second phone call and some pressure produced the desired result. Informed Cobbetts yesterday only reason for not claiming intererst is to get quick settlement. Given them reasonable time to make improved offer, they failed, and unless I hear from them or receive a cheque by friday I will send my AQ on monday. Advised to call in few days time and cobbetts will do their best to have it sorted out in the next few days. With the cheque they sent Notice of discontinuance and asked to send one copy to court and another to cobbetts. It asks for name of judge granted permission for the discontinue and order date. Not sure if I should send this to court or just a standard letter informing reached settlement. THANK YOU TO EVERYONE FOR THEIR HELP AND ADVICE. A Salique

Thanks, will follow your advice and send aq in the next few days. Thanks to shoreditch court I have a extra week. Northampton gave till 26th feb but Shordicth my local court where case/claim have been transferred sent aq and gave till 2 mar. I phone Northampton to ask which date to follow, they confirmed Shoredictch. asalique

No improved offer yet. called cobbetts advised still waiting instructions from natwest. informed my aq deadline 24 Feb and plan to to aq early next week so need a reply from natwest urgently. advised will chase natwest and I should call court and ask to extend aq deadline by 14 days as currently discussing out of court settlement. not sure what to do, any suggestions?

hello natwesttookmymoney natwest made a offer two weeks ago and i rang them to ask if they could improve the offer to cover all charges and court costs. was advised will not offer anymore other than whats already been offered and i must say yes or no to their offer. i said no, i just hope they have not withdrawn offer.

AQ rec this morning. Had a chat with cobbetts and informed would be willing to accept a improved offer ie refund of all charges plus court costs and would forget the interest. Was advised to send email to comfirm. About 10 mins after sending email,they called me back to say email not received and if i could resend or fax. I did both and they confirmed receipt. On their defence cover letter they stated no schedule received. I asked to double check as i sent it two weeks ago. Was put hold for 5 mins, she returned saying sorry for the delay and also confirmed she now has the schedule, it just was not logged onto the system when drafting the defence and I should not worry about the request for further information.
