I have been following this debate with interest as I need to put together a skeleton argument to support my credit card claim for contractual interest being paid out vs the standard 8% for a hearing to argue the point. I can't find any thread which has such a template. Would it be safe(ish) as far as these things go to use the #2051 argument as a starting point. And yes I do know that these are opinions not facts but I do need to start somewhere. Any help or opinions would be very welcome.
  2. We claimed the contractual rate against Barclaycard. Barclaycard offered to pay 8% in court. We refused. The judge ordered Barclaycard to come up with a defense/skeleton argument to justify why they should only pay 8% by the 11th of Oct. We had to submit a defense thereafter to argue why we had applied for 24.9%. Long and short of it is that Barclaycard have applied for extension to the court so it's the waiting game. Has anyone gotten this far and already possess a skeleton argument that goes beyond the Sempra case?
  3. My husband has a court hearing in September against Barclaycard. We have followed the reclaiming process all the way to exchange of bundles. A letter came through yesterday from the bank informing us of their intention to ask the Courts for a stay of the claim. Are they trying to scare us off and if so, does anyone have any ideas on what response we should make?
  4. I am so excited. My husband lost his job last June and since then it's been a nightmare trying to keep up with payments. All those £22.50 charge letters and £30 further charges and threats and harrassment. There is hope now. I will prepare all my letters now to get cracking!
  5. I just wanted to let everyone know that following the advice received from this website I have managed to claim £400 from my Halifax credit card and £100 from my capital one account. It may not sound a lot compared to the sums I read of but it has made such a difference to me and in any case who runs around dishing out £500 to people for free?! I'm now gearing up to address my Littlewoods account(nightmare). Thanks to you all out there in helping me get my life a little bit back on track. It's great reading all your stories.
  6. A workmate (dsm) has had us all in a tizzy in the office regaling us with your success stories. I decided to follow suit, sent off 7 letters under her guidance last week and Halifax have already posted out my credit card statements! Today I request my £300+ and hopefully will be able to reduce my balance. Thanks to those who have paved the way.
