  1. Hello, thank you for responding, I’m still not sure I’ve got this 100 %...sorry i make my claim tomorrow. Ok so I’ve only got half my statements - £348 in charges I’ve estimated £350 before that. Total £686. I am presuming that I can do a court claim for the estimate........... Using the 8% spreadsheet I have calculated £722.12. This is what my court claim says..... 1. The Claimant has an account xxxx xxxx xxxx xxxx with the Defendant, opened January 2003 2. Since then the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £686; (b) Interest per S.69 County Courts Act 1984 of 8% - £36.12 continuing at 8% until judgment or settlement at a daily rate of £0.15; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court. Amount claimed - 722.12 Court fees - 80.00 Solicitors cost - 00.00 Total Amount - 802.12 are all the figures right???????? and do I need to send Barclaycard a copy of my full claim? Hi folks, Can someone briefly look over this for me, this is what i sent to barclaycard and since then i have sent the second version similar to this, titled LBA, the scheduale i sent is at the bottom, i havnt included 8% interest???? do i need to contact them again before i do my money claim? (i'm not due to do moneyclaim until 4th Jan but just want to be prepared) Also what do i claim for? Charges Interest £10 SAR FEE Court Fees Postage???? - 4 letters sent recorded delivery so far Printer materials Time and effort??? Merry Christmas to all!!!!!!!!!!!!!!1 Wahoow, what great news, just sent of my LBA to barclaycard with a whopping great estimate for the statements that they would not supply.....i will wait and see there response before proceeding, i wonder wether theyll send me a reply relevent to the LBA or just send the missing satements?????   5. AAAAAAAAAAAAAAAAHHHHHHHHHHHHHHHHHHHH! Why is today going so wrong!!!!! my follow up letter to the SAR is due to arrive at barclaycard tomorrow morning, i realise tonight that theres a typo!!! sh** fu** boll*** why do i realise now, how unproffessional is it gonna look! basically "I am in receipt of your letter dated 31st October 2006, outlining that you could only provide me with printouts covering transactions during the past 17 months on my account, because any earlier information has been archived onto microfiche. " the bit in red should read "during the past 29 months on my account" the 17 months is what im missing! i know its only a minor mistake but im kicking myself cause it looks really bad. what do i do????

Hello it's me again, sorry all i seem to do is ask for help. hopefully when this all pays off i can help others (and donate of course!) but until then im afraid your all gonna have to put up with me!! (thanks!) ok im claiming against bcard. first of all when do i send them the spreadsheet and what spreadsheet do i use, i keep searching threads and ive been to vampiress chambers but im just still confused. Where is everyone getting 8% as the interest figure from??? Do i use the simple or advannced spreadsheet? im clearly not gonna get my statments from before may 04 by the looks of things so do i guess at the rest, if so where do i put this on the spreadsheet? if i have to guess my charges do i have to base them on the statements i have - charges were a lot more regular before may 04 as i was at college and didnt manage my account very well? if any one can help id really appreciate it. Thanks a bunch.

Hello everyone, first and foremost i must say this websites great! ive been posting in random places all night but have just worked out how to start a thread in the right forum! lol after a few months pondering on various websites about whether to pay some company to do my claim for me or whether to go it alone, you wonderfull people have inspired me to just go for it!!!!! im preggers and so am only working part time giving me the perfect oportunity to give this my full attention. Ok so i have sent the subject acess request on 25th oct 06 Bcard replied on 31st oct saying about microfiche and only supplied info back to may 04, so today i have prepared the letter saying that they must still comply and saying about abbey etc. i will be sending that recorded delivery tomorrow. i am presuming they will reply to me with a letter similar to the first from what i have read? And when i get this i just wait for the 40 days to run out. this is where im slightly confused...in what order (once the 40 days is up) do i do the following? Complain to info comissioner send non compliance letter send letter before action calculate estimate (not that im quite sure how to do this yet!) ive read so many threads ive now completely overloaded my brain and confused myself!!! Any help would be greatly appreiciated. THANKYOU XXXXX:)

I love this website you give me so much hope!!! im fighting the whole microfiche rubbish at the mo, just about to send second letter re subject acess request, then theyll send me some rubbish containing pretty much the same as the first letter i.e £3 per statement as on microfiche, then i wait rest of 40 days and send estimate - is this right? Thanks.

Hi, im new to this but i received a reply from SAR today from barclay card, it pretty much said what your email above said, reading another post hills vs barclaycard, i am going to send the ' Abbey letter' found in that post along with the additional parts from the letter in your post above ie the bit about abbeys being told it was relevant info. imsure ill get the same response as you! from what ive read we wait the 40 days and then send the non compliance letter????? someone please tell me if im right?? Thanks.
  12. Thanks, i think i found some info in someone elses post, hills v barclaycard, im sending them a letter originaly drafted for abbey. hope this is the right thing to do!
  13. Hi, im new to this, so forgive me is i get this all wrong but i think im doing things right. Sent of my SAR on 25th October recorded delivery. royal mail say received on 27th. Spoke to barclaycard 1st november says registered on their system on 30th october. today 2nd November received reply, have kept my £10 and given me details of my account back to may 2004 then said the rest is on microfiche and is not readily accesible and so i wil have to pay £3 per statement. i am about to send them the "abbey" letter is this thr right thing to do??? Also when do the 40 days start from? 25th when i sent, 27th when royal mail say signed for, 30th when they say on their system or 31st when reply is dated??? Please help. Thankyou x

Ok so im not good at this, have enough trouble tryna navigate this website!lol sent of my SAR to barclaycard on 25 Oct, today, 1st Nov i have reply, they have given me details of account up to may 04 but go on about micrfiche and stuff saying that for anything before that i must pay £3 per statement!!!!!! up til may 04 i think they took about £300 they shouldnt ov, but you see id grown up a bit by then and my acount was in quite good order, basically i think they took much much more before that. What do i reply??????? i must reply within 8 weeks apparently! Please help me. THANX xxxxx
