  1. I'm just filing my claim on MCOl and it asks "Does or will your claim include any issues under the Human Rights Act 1998?" what do I answer, yes or no?????
  2. I wonder if you can help? I bought a lovely pink Motorola Razr V3 in April and have been very pleased with it. However, at the beginning of the month it started "playing up" - refusing to charge and doing odd things when I tried to scroll. I called Phones 4U whom I bought it off and they said to take it back to one of their stores who would check the battery and if that was not a problem they would send it off for repair. So I telephoned the local store and they said to bring it in. I did so a couple of days later and was informed by every member of staff in the store that as I has bought it online there was nothing they could do about it. I was not happy and argued that I had been told by customer services to bring it in AND had actually spoken to someone in that store that told me to bring to them also. In the end they agreed to check the battery and as changing it seemed to rectify the situation I took my phone back and went and bought a new battery elsewhere (as Phones 4U don't sell them!!) The phone worked fine for a few days and then started to play up again, going black and refusing to allow me to scroll. This time I decided to cut out the middle man and phoned Motorola. They sent me a pre-paid envelope to return it to them for repair. They advised me they would have it 5 working days. That was 12 days ago so I phoned today to find out what is going on and after first telling me it hadn't been repaired they put me on hold for ages and came back informed me that it had "customer damage" - I was not happy. It has never been dropped or anything. I asked for an explanation and she said it has "components missing from the board" - I asked how that could possibly be the case when it is a sealed unit. She told me to ring the repair centre. I did that and they said the same and that it had "missing tracks". I reiterated my disgust and she has said she will send it for a second opinion. I have no doubt they will say the same. So now what? I spent £100 on this phone (it's a pay-as-you-go) 6 months ago and now it is a write off. I have never dropped or mishandled it. What can I do now?

Just doing the LBA's so I can have them ready to post when due, but am a little confused by: "I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX." What does it mean by "overdraft interest"? How do I work that out? In my Prelim I said: "I calculate that you have taken £815 from a/c #50545171 plus £3025 from a/c #60228974. Total £3840." Do I not just put that again? Sorry to be dozy, maths is not my strong point!!
  4. Sent hubby's Prelim last week (on 8th - his statements took longer than mine to arrive) and we have now both had the "we will get back to you some time in the next seven and a half years" letters. My LBA is due to go off this Thursday......
  5. Just a quick update to say that yesterday I sent my Prelim, so they have until 16th November to reply - here we go!!

  7. So, as we have 2 x joint a/c's and a sole a/c each that we are claiming for we should split it to two claims say for one joint a/c and our sole a/c making it come to less than £5000?
  8. Just a bit confused as to what address I send my preliminary letter to? Do I send it to the account holding branch? Or to the "group" address that is sometimes printed on my cheques (sometimes it just says a/c holding branch name)? Sorry if I should have added this to my OP feel free to move (have asked a couple of questions there too.....)
  9. Hiya, Sorry if this is a daft question.... I had a Dorothy Perkins card that I unfortunately ended up unable to pay for a few months and it ended up as a CCJ which I am now paying off by DD each month to a debt collection agency. I was charged loads on this card, can I still claim back the charges and have them refunded or knocked off the balance I owe on my CCJ?
  10. Oooh, also need to ask - does the fact the claim is going to be over £5000 mean it can't be done through the small claims court? Is it now going to cost us a fortune if we have to go as far as court?
  11. Barclays sent the copy bank statements I requested earlier in the week and on our two joint a/c's and my sole a/c they owe us £6740!! Haven't had hubby's yet as he didn't get round to requesting statements as promptly as me , so we have his to add to that too. So - do we have to wait until we have sent a SAR before we can send the first letter to Barclays?
  12. Hiya, Newbies here saying hi and asking stupid questions !! Hubby and I have four current a/c's between us with Barclays and have been charged LOADS in the past six years (at one point at least £90 per month for each a/c!!) We are going to phone requesting copies of statements tomorrow (won't tell them why) and I understand we should also send off to the Data Protection people for the info through them, is that right? So, do we need to work out what is owed for each account and send individual letters for each? Or can we lump the amount all together and do it all on one letter? Also, does anyone know on average how long this process takes? From reading the post here I gather Barclays are very slow to refund? Thanks for the help - but stand by for further dozy Q's!!
