  1. Hubby says it was a debt agency as when we contacted Halifax they advised the debt was now with Blair Oliver Scott.
  2. It was a Halifax credit credit card. They sent a letter accepting 75% of the balance as FFS.
  3. Thanks for the reply. There was no discussion regarding removal of the default - I understand that after six years it will be removed? six years from 2009? Does this default mean that until it has left the credit history we will not be able to get any further credit?

In October last year hubby had a free trial of Experian and got his credit report which despite a default from back in 2009 (default in 2009 because we were struggling back then and the credit card agreed to freeze the amount, not add further interest and take £70 per month) came up as "Good" on Experians overview page. We decided to look around for a better mortgage deal but were declined due to aforementioned default. We decided arrange a full and final settlement with the credit card and were told to wait for it to show up on the credit report. Last week hubby paid £2 for his Experian report and the default is showing as satisfied balance 0.00 so we looked at changing the mortgage again and was declined. We decided it might be a plan to get a small item on interest free credit as we have no other credit except for the mortgage and utilities and thought this might be an issue and as we desperately need a new mattress applied to Bensons for a £1000 mattress on interest free which this morning has been declined due to "credit score". Can anyone advise what action we can take to improve matters? Incidentally, hubby got a mobile phone contract for our teenage son with no trouble just before Christmas. Any tips would be gratefully received!! S
  5. Just to say Barclays called just now and have settled in full!! Just got to await the paperwork and then they will credit my account!! Yay!! DH is still waiting for them to settle his, but his court date isn't until late April....
  6. Right, I chased them yesterday lunchtime and was told that they would be in touch in the next 24hrs. I missed a call whilst doing the school run and rang them again and they said they are still waiting on "confirmation of the figure" (that I am claiming) and would be in touch today. I'm still waiting - do you think I'll p1ss them off if I ring them again?

So, have now spoken to the person dealing with my case and he said that due to the fact that I have only got my court date today they haven't had confirmation yet from "customer services" that the figure I am claiming is correct. The figures will be checked and they should be getting touch to "discuss an offer" within the next 7 days....
  8. OK, just got off the phone to both the court and Barclays. My date (for an "Allocation Hearing") is the 13th March !! How is an Allocation Hearing different to a full hearing? Do we have to go to this hearing and then they decide whether to have a "full" hearing? The chap at the court said it's because these are usually settled out of court and rather than give a full hearing date straight away they do this to give the bank chance to settle. Anyhow, I called Barclays and have been told to call back in 10 minutes when the chap is who is handling my case is off the phone so we can "discuss settlement"!! Fingers crossed everyone!!
  9. When do we need to send the court bundles off and who to? We've got a court date for 26th April for DH's claim but despite submitting my QA on the same day, and regularly chasing I still haven't got a date!! Interestingly, the letter from the Judge with the date said that "the matter should take no longer than 20 minutes as there is no real chance of success by the defendant" :grin: I called Barclays with the date and they said they are dealing with them in order of the date of the hearing and will "be in touch" 2-3 weeks before.
  10. Today I chased the court and was told that the court date for hubby's claim is 26th April :o!! My AQ has not yet been given a date but will be done shortly. I telephoned the litigation department at Barclays and was told that they are contacting people in order of their court dates and therefore we won't be contacted until 2-3 weeks before our court date to see if "we can come to a solution". I asked why they couldn't just discuss it now seeing as I was on the phone and was told they had to follow protocol, blah, blah.... For what it's worth I asked for notes to be put on both mine and hubby's file to say I had called. So, nearly another two months to wait ....
  11. Section G - "Set out any other information you consider will help the judge to manage or clarify the claim" Just checked in the library and it doesn't say what to put and am now panicking, what did you put on yours?
  12. Today I got my AQ with the defence from Barclays attached which is long and involved and full of legalese. Am fretting a bit as it all seems a bit scary now!!
  13. Barclays "acknowledged" my claim on MCOL yesterday. Does that mean I get the AQ and then the court date or vice versa? :-?
  14. So, Phones4U independent repairers also deemed my V3 a write off, but this time they didn't blame me and I am now the proud owner of a nice new one!! Outrageous though that Motorola said it was my fault when the independent guys clearly didn't, something stinks!!....
  15. B*gger, I was hoping that they are all too wrapped up in office parties and "forgot" about me. So, what happened when you clicked the "file for judgement" thingy on MCOL? Did it not let you continue? It's outrageous 14 days should mean 14 days....
  16. My MCOL claim was accepted by Barclays on the 30/11/06, so far they have not replied. Do they have until close of business tomorrow to do so? If it gets to 6.00pm and they haven't replied (fingers-crossed!!) can I file for a judgement, or do I have to wait until the 15th? Sorry to start another thread, I did post on my original thread hoping someone would reply but they haven't yet and I need to know!!
  17. OK, I filed my claim with MCOL on 29th November and Barclays "accepted" it on 30th November and they have 14 days from that date to reply - so far they haven't, what do I do if they don't reply? Is the 14 days up on the 14th or the 15th December?

Ok, have written the following letter - what do you reckon?: "I appreciate you taking seriously my complaints and I am glad that all members of staff concerned have been rebriefed on correct procedure. As you are aware my main concern was the injury I suffered whilst staying in the villa. Since writing to you my nail which was damaged by a splinter from one of your items of furniture has gone brown and begun to lift (picture enclosed) – it seems that I will lose the nail entirely which I am none too pleased about as you can imagine. It is going to take many, many months for my nail to grow back normally due to the damage done to the nail bed by the splinter. I feel that due to the long term nature of this problem that has been caused by furniture in your accommodation (and that was not even removed after I reported it, despite assurances to the contrary) that some sort of compensation is necessary and I feel the offer you made of £60 off a further break with Center Parcs is unsatisfactory. I hope that we can settle this matter satisfactorily but I feel it is only fair to make you aware that I will not hesitate to seek legal advice should that become necessary. I look forward to hearing from you."
  19. OK, hubby got a letter this morning (approx. 7 days after we sent the LBA) offering him £1000 (he's claiming £3260). How do we go about accepting this as an "interim" payment (which I know they will then withdraw)? Is it not a bit odd that hubby has had this letter, yet my LBA deadline was up yesterday and I've heard nothing? (I've now filed with MCOL). Also, the letter with the offer of £1000 has a telephone number to call if we are not happy - is it worth ringing to discuss?
  20. Apologies in advance as this may be long. My family and I went on a midweek break to CenterParcs in September and there was a catalogue of minor disasters. On our return I sent the following letter: "Dear Sirs RE: STAY DATED 25/09/2006 – 29/09/2006 IN VILLA # 917 I am writing regarding our recent stay at the Longleat Holiday Village (dates above). Our party included myself and my husband, our two boys (aged 6yrs & 8yrs) and my parents-in-law. All-in-all our holiday was pleasant but I feel the need to write regarding several matters that marred our stay. I’ll start with the most serious matters. On the morning of Weds 27th Sept I reached down close to the bedside table in our Executive Villa and caught my thumb on it. Imagine my horror to discover that I had the biggest splinter imaginable from the table going under my thumbnail and into my nail bed. The splinter was approx 1.5” long x 1/8” wide (photo # 1 enclosed complete with bloodstain!!). A tiny end protruded from my nail and I screamed for my husband who was able to pull the splinter out from under my nail. Needless to say this was agony!! I felt shaken and a little faint and proceeded directly to the Medical Centre where the nurse applied a Mag Sulph poultice and advised I took painkillers. I spent the whole day unable to swim due to the poultice (in fact, I didn’t swim again as I was afraid of getting an infection in the area) and in considerable pain – today (five days later) the area is still sore and inflamed (see photo #2). Obviously this spoilt things somewhat. The nurse telephoned the relevant department whilst we were present and requested that the offending table be removed from the villa. This never happened. I feel very disappointed that the furniture was not checked for rough edges before it was placed in the villa and am just thankful that it was I that got the splinter and not one of my two small sons. Not only that, but I am also cross that despite the nurse requesting the table be removed this was ignored. Another serious complaint is that upon shopping in the ParcMarket on our first day I was browsing the chilled section. I was dismayed to discover not one but numerous items of chilled foods, (Greek Salad containing soft cheese) several days out of date!! I called to a young member of staff and handed him all the offending items – this numbered about 8 pots. My 6yr old then asked if he could have some of his favourite Bernard Matthews “Dinosaur Ham” – due to the dates on the previous items I checked before putting it in the trolley and once again was horrified to discover that the cold meat was several days out of date!! I checked the rest and approximately 90% of the ham was well past its use by date. This time I requested to see the manager and told him in no uncertain terms what I thought about a store that was obviously very slack on checking dates and removing old stock!! The manager seemed bemused but apologetic. I really am at a loss as to how it was the case that in a busy supermarket where you have a captive audience (being the only grocery store on the site) that such lapses could occur. Many people don’t check use by dates being confident that what they buy is ACTUALLY IN DATE – what if someone had gone on to eat these products and become ill? It is more alarming that one of the off products was a cold meat item targeted at children. I have to say that I am disgusted. Other irritations that occurred were as follows: Upon arrival in our villa we lacked several items of bed linen – despite being in an Executive villa and these being included. I had to mess about trying to find a phone number to call (why aren’t the numbers by the phones in the villas?) in order to inform information. The retainer that holds milk, etc in the fridge door kept falling off making it impossible to stand bottles up in the fridge. The DVD player was not working; my husband had to fix it before the children could watch. The included maid service was mediocre at best – all she seemed to do was empty the dishwasher and move things round on the coffee table. We have paid extra in the past for maid service and it has always been very good. Sadly, this time we were disappointed. We asked for extra towels and had to wait 48hrs for them to materialise – and then they were just seemingly slung through the front door. The pillows were horrendous. After our first night we had to adventure to Asda in Frome to buy more. We had to wait over ¾ hour for our lunch order in the Sports Café – upon investigating were told they had “lost us”. We have holidayed with CenterParcs 3 times in all now (once before in Longleat, once in Sherwood Forest) and never before have we had such a catalogue of problems and mishaps to report. We paid a lot this time to have a “special” villa and were looking forward to it a great deal. Unfortunately, our holiday was distinctly spoilt. I will admit we had a pretty good time despite the setbacks, but without those it could have been a WONDERFUL holiday. I feel particularly strongly regarding the splinter and the fact the request by the nurse to have the table removed was ignored, as well as by the Parcmarket selling dangerously out-of-date perishable foodstuffs. They finally got back to me last week with a letter saying all the relevant dept.s had been spoken to and with an offer of £60 off a further break with them (big deal). I am not happy with this. Since writing the first letter my thumbnail has started to lift and it looks as though I am going to lose it: What approach should I use in my reply?
  21. Just an update. I decided to call Phones 4U again and they told me to take it in to my local store and they would send it to their independent repairers - they told me to keep it quiet that it had already been back to Motorola . So, I went to our other local store having been put off by the clueless whippersnappers in the first store. This chap took the phone and got the paperwork for it to go back (if they have paperwork to send a phone back why on Earth didn't the first store know this?!! ) Apparently, I have to wait upto 14 days and they will send it back to me (hopefully fixed)!!....
  22. I've just filed my claim with MCOL for my half of the charges (we have 2 x joint & 2 x sole and they owe us over £7000 so hubby and I are doing a claim each to keep it under £5000). I was wondering how long after filing my claim do you usually get your court date? (not how long until date but how long is the wait to get the date IYKWIM ) Also, how do they let me know, do the court write to me directly? Is the claim automatically filed with your local court? Questions, questions....
