  1. I've just relised, on the defence paper it says they have till the 26th to respond. But the 25th and 26th are bank holidays does that mean they have till the 28th to respond or should I still click the start judgment button on boxing day?
  2. I was under the impression that the mk3s all had cam chains not belts. You may want to find a decent diesel specalest as they will be cheaper than ford direct. Some things they wont be able to do with the ECU but are alot better. Dan
  3. I just relised, I sent a letter on friday about part payment and have now sent the scedule of charges off to DG today without mentioning the offer - should I send DG a letter silimar to the one to friday or will hsbc send it on? dan

  7. I have sent 3 copys to the cc. I have receved a offer or the charges in full but no intrest and fees. The odd thing is this hasnt been sent by DG it's from the customner care team. Dan

  9. Thanks, I only changed the bit about intrest as there's a popup about what you must include when claming intrest. Im also supprised, I wish I'd just done it correctly last night. Both clames have been passed for validation How long does it take for them to withdraw the old one? Cheers dan
  10. Thanks lateralus. As you have worked out I have put a incorrect amount in the 'amount clamed' box. Have called them up and put in for a widthdrall. Though I'm suprised you cannot change your clame before they have looked at it. I have had to change the perticulars of clame to this as it now wont take what I origanaly put in 1. The Claimant has an account with the Defendant, opened 2. Since the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of ; (b) Interest per S.69 County Courts Act 1984 of 8% of continuing at 8% until judgment or settlement at a daily rate of £0.11; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.
  11. The value I put is was for just the charges and not for the intrest upto the clame date Ie, 300 in charges and 100 in 8% intrest I put in 300. dan

  14. Well there 14 days are up for there LBA, with not a peep from them. Will be filing tonight once Ive found the text for accounts opened before 95. Dan

    It's 14 days, I think there refering to there internal complaints procedure. Is the letter the normal, complain letter? If so ignore it and file your clame.

    it's 14days from when they receved it. Did you send it recorded? if so it's the date RM delivered it. Otherwise I beleve it's safe to assume 2 working days after it was posted 1st class. Have just checked the 4th was a sat so I'd use the 8th .
  17. HSBC have 'reviwed' our account and has removed our overdraft facility! Letter will be in the post today!
  18. Right well there's 14days is now up - time to send there LBA. Hopefully I'll get my money before xmas
  19. as jzzey says send the Data Protection Act non compliance letter. Also inform the data commisioner as they have failed to comply with a dpa request.
  20. My advide would be to give mbna a call and find out whats going on - deal with mbna direct (they probably have a local number there) rather than via westcot. Once you have some info from mbna get them to tell westcot to put the account on hold till it's storted. also request your sar etc etc now as it'll take awhile to go though. dan
  21. doh - I mean can you close a hsbc account over the phone? We nolonger need our hsbc account - we havnt used it for a year. Our local branch is closed for a referb, the next nearest closes at 3pm during the week (why 3pm!) . So unless we try to go on a saterday (were not here for the next 3 saterdays) the only way to do it is over the phone.
