  2. If the 14 days are up send them a LBA (letter before action) which gives them another 14 days to reply if then you dont hear nothing its time for court. I am in the same boat have just sent LBA but heard nothing as yet

Hi everyone have sent postal order off to natwest and have rung them to acknowledge they have received it today and they have, they received it the 6th october but the gentlemen on the phone says the request is there but does not know when they will be sent out. Just wondering how long you all had to wait for yours?
  4. Right i sent my LBA on tuesday of this week as i had letter from katrina downs saying should expect reply by end of october but this was past my deadline. I think i have messed my charges up though as when estimating charges i have estimated from jan 2000 but they didnt introduce them till jan 2001 will they just ignore the ones that are not relevant or will this go against me? dont usually mess things up but my daughter has not been well and i now have a rotten cold. Any help would be great many thanks pebbles26
  5. I am currently paying off capital one through a payment plan with payplan which i have been doing for the last 18 months and they have stopped all interest and charges. However i would carry on paying them because if it goes to court it looks good in your favour that although they are adding extortionate cost's you are still making your monthly agreed payment. I am also in the process of getting my statements from capital one and claiming back all of my charges.

OK How about this just adapted it slightly:- I am in receipt of a letter dated 3rd October from Katrina Downs and acknowledge receipt of the information contained therein I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £1200. Total £1200. I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 28TH September Additionally you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account. In addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notice.   8. Hi everyone thanks for taking time to read. I have received reply from barclaycard stating will let me know by 26th october but this is beyond the 14 days. The 14 days time up is on friday? When i send LBA do i send the template out of the library and just add my details and adapt it or do i put thanks for letter dated ........ at the beginning? Im really unsere so any help would be great.

  11. hi everyone, right sent off S.A.R got two years worth of statements back so estimated the rest. Got a letter from them today saying will hear by them around the 27th october. Do i send my LBA 14 days after they received it and does the 14 days include weekends? ANY HELP WOULD BE GREAT THANKS
  12. Hi everyone, sent my letter of to barclacard asking for statements got them today (only took 4 days) however only go back as far as june 2004 and say wont send anymore. I have totted up exceeded limits charges and late payment charges and they come to £192 pounds but this is without interest? do i add that on now or not until i have to claim. I understand the rest but not sure on this point any help would be great thanks.
  13. In some cases yes but apparently black horse and lloyds are the worst and they keep stalling and adding more money on. I couldnt do an IVA as more than half the money was owed to LLoyds tsb and they had final say and said no. It is also to the judge's discretion i was told but while you keep paying it shows good will on m behalf so if it does go to court the judge can see i am trying to pay it off and getting nowhere fast
  14. Hi, i have just read your post and might be able to help. I am currently paying off my debts through the help of payplan, who i pay one sum a month and they pay the creditors for me. Altogether i have 10 different people i owe money to, Seven of them have stopped all interest and charges but the other 3 are lloyds tsb and they havent as payplan cant gurantee stopping it. For example one of my creditors Black horse (owned by lloyds tsb) have received £1844.40p over the last 15 months and they have taken out of that £1665.00p in interest and charges so it's not really worth paying but if you stop they take you to court, i am in the process of waiting a reply from a letter i posted asking them to freeze all interest and charges and if they dont i will stop paying until they realise there charges are ludicrous.
