  1. Hi, The prelim expires tomorrow - and i have not been contacted by Halifax!! Shall i make contact to make sure they rcvd the letter etc [even tho it was sent by recorded delivery! and i checked with royal mail it got there ok!] or should i just send the LBA tomorrow?? Lisa

  4. Thanks, I think i got it. Ok i have picked the s/s which includes contractual interest and not statutory, and is asking me to changed the 8 per cent to my banks unauhtorised or authorised overdraft rate? whats this?
  5. Thanks Guys, It does help. What about the overdraft interest you charge before court action, i tried to use the spreadsheet but could not work it out Also when working out the daily rate once you submit the MCOL when do you start the charge for the daily rate and stop it? Thanks
  6. Thanks, the 'to date' is that todays date or the date they charge me interest? and do i do that for each bank charge? or is this the calculation i use before the MCOL? sorry i just worry
  7. Ok. I am about to send the prelium letter for £1,045.00 do i include the £5 admin charge? I have not included the 8 per cent interest do to the current statge nor the standard interest as i could not work out the spreadsheet i just thought, i'd rather get it right, so i just claimed for charges. Am i guessing the charge for the interest taken back by halifax for the bank charges wont be that much anyway and therefore have done the right thing? Lisa x

Ok, i have recieved my bank statements, albeit the first 5 months - but they are on the way!I am ready to calculate my charges and understand i am not to use the 8 per cent interest at this point, but can use the interest for the overdraft charge only if it was soley due to the overdraft fee - how do i work this out? After reading throught the site, I seen a post saying if you claim tax credits you dont have to pay the costs, but a application needs to be made at the court in person, where you can pick up the forms, rather then online. I guess to provide proof of benefits. Sorry if this is duff information, it's just what I seen, I hope it is true though as I claim tax credits being a working mum and child benefit. Hope this helps

  11. Thanks it has made me feel better. If they do, and they give me notice, then I can arrange something as I do use my overdraft each time, however the fees stem back from my younger days when my limit was different to theirs albeit a 60p or so difference, where they charged me £30 for it, then a further £28 if the funds were not in my account, when it was claimed back Even if they did, it would just make me even more determind to claim MY money back.   13. Hi Lisa 1977, I was wondering as I have a argos card, and notice each month my amount owing in hardly coming down can I ask if you dont mind, are they charging you something you did not know off at first? that i could be missing? Lisa
  14. I was just wondering, I have a overdraft of £600 which I use each month, if i end up taking any sort of action against Halifax, can they canx my agreed overdraft??
  15. I work for a H/A in the rent department, and can I just point out, were not all like the man you have had dealings with. The section 21 is used with assured shorthold TA after of during the fixed term period or after [however slightly different wording of each, depending on when served i.e during or after] I would tend to request one is served when every other aspect for recovering the debt has been attempted [even including third party deductions] If the matter does go to court, I am sorry to say the power the section 21 holds means the Judge has no option but to award the outright possession order, which has intended to be sought by service of the notice. It is unlike the NOSP where a postponed possesion order can be granted or a adjournment granted [where appropiate] Lisa

  18. Hi, I have requested a list of charges for as far back as possible. I have no other bank accounts, only a credit card with capital one, store card with Argos & a Great Universal cataloge - I have not been charged any late payment fees's etc with these company's only with Halifax, & was wondering if there is anything I can do with regards to the high interest re-payment rates However Halifax is my main concern, I have been banking with them for about 6/7 years & i'm nervous as to what the total charges may be. I will await the above requesting information, & hope you will be able to assist me with seeking recovery of payment, I have read a few successful threads and the FAQ'S & all look's very positive. How long do Halifax have to sent the list of bank charges etc? & once I recieve them, is there a standard spreedsheet for calculating the total debt owed to me pior to sending letter requesting re-payment? Once I am in receipt of the request, I will calculate & advise amount due, then confirm it is ok to send the 1st letter. Thanks for your assistance. Lisa
